ROLL CALL Present: 13 - Mayor Tom Weisner, Alderman Tina Bohman, Alderman Juany Garza, Alderman Ted Mesiacos, Alderman Bill Donnell, Alderman Mike Saville, Alderman Scheketa Hart-Burns, Alderman Rick Mervine, Alderman Edward Bugg, Alderman Lynne Johnson, Alderman Richard Irvin, Alderman Bob O'Connor and Alderman Carl Franco PLEDGE OF ALLEGIANCE INVOCATION MINUTES OF THE MEETING OF TUESDAY, JULY 28, 2015 15-00696 Approval of the Tuesday, July 28, 2015 City Council Meeting Minutes . A motion was made by Alderman Hart-Burns, seconded by Alderman Irvin to approve the minutes of the City Council Meeting held on July 28, 2015. Motion carried by voice vote. Alderman Mesiacos abstained from the vote. APPOINTMENT OF SERGEANT-AT-ARMS A motion was made by Alderman Hart-Burns, seconded by Alderman Mervice to appoint Officer Hornberg as Sergeant-At-Arms for the meeting. The motion carred by voice vote. PRESENTATIONS 15-00677 A Resolution Celebrating the 25th Anniversary of the Americans with Disabilities Act. Mayor Weisner read the resolution celebrating the 25th anniversary of the Americans with Disabilities Act. The resolution was presented to Lynn O'Shea, President of the Association of Individual Development. She briefly spoke regarding the item and the City of Aurora Page 1 City Council Meeting Minutes - Final August 11, 2015 partnership between her organization and the City of Aurora. This Resolution was approved. Enactment No: R15-222 15-00719 National Night Out 2015 Presentation Mayor Weisner introduced the item and Dan Barreiro, Cheif Community Services Officer, spoke regarding the efforts of the steering committee to coordinate the events around the City of Aurora for National Night Out on August 4, 2015. The volunteer organizers of the twenty (20) events were presented with certificates to recognize the efforts and hardwork performed for each of the events for National Night Out. This Presentation/Proclamation/Recognition/Awards was discussed and filed MAYORAL APPOINTMENTS 15-00689 A Resolution Appointing Alberto Reynaga-Arreola and Janel Cabadas to the Aurora Hispanic Heritage Advisory Board. Mayor Weisner spoke briefly about the nominees and congratulated them on the appointment to the Aurora Hispanic Heritage Advisory Board. This Resolution was approved Enactment No: R15-202 CONSENT AGENDA Approval of the Consent Agenda A motion was made by Alderman Saville, seconded by Alderman Hart-Burns, to approve the Consent Agenda as presented.. Enactment No: O15-046 15-00673 An Ordinance Amending Chapter 13.5, Section 13.5-3 of the City of Aurora Code of Ordinances Entitled "Chief Examiner-Generally" This Ordinance was adopted. Enactment No: O15-047 UNFINISHED BUSINESS 15-00620 A Resolution Approving a Preliminary Plan and Plat for Balaji Homes Condominiums Subdivision Being Vacant Land located at Southwest corner of Sequoia Drive and Randall Road, Aurora, Illinois 60506 Bill Wiet, Chief Development Officer, spoke regarding the item. This item had been presented to City Council in the past, however, the companion ordinance was passed after the resolution and changes made to the ordinance were not incoporated into the resolution. It is the intent to correct this resolution to align with the changes in the ordinance such as: allowance for only one association in the development and that City of Aurora Page 5 City Council Meeting Minutes - Final August 11, 2015 the maximum number of rental units not exceed 25% of the development. A motion was made by Alderman Hart-Burns, seconded by Alderman Mervine, that this agenda item be approved. The motion carried. Aye: 11 - Alderman Bohman, Alderman Garza, Alderman Donnell, Alderman Saville, Alderman Hart-Burns, Alderman Mervine, Alderman Bugg, Alderman Johnson, Alderman Irvin, Alderman O'Connor and Alderman Franco Nay: 1- Alderman Mesiacos Enactment No: R15-220 15-00497 An Ordinance Granting a Special Use Permit for an Automotive Retail (2820) Use with a Final Plan on Lot 9 of Savannah Crossings Subdivision located at 1386 Butterfield Road, Aurora, Illinois, 60502 Bill Wiet, Chief Development Officer, provided an amended change to the proposed ordinance to add one special condition to the agreement as to the following to replace the two previously submitted special conditions. The new special condition would read as follows: 1. The Petitioner acknowledges that additional regulations may be forth coming on outside repair of vehicles related to Automotive Retail uses and further, the Developer acknowledges that any regulations that may affect all other similar Automotive Retail uses shall be applicable to this Special Use Permit. A motion was made by Alderman O'Connor to introduce the item as amended. A roll call vote was taken. The motion to amend was carried unanimously. This Ordinance was adopted as amended Aye: 12 - Alderman Bohman, Alderman Garza, Alderman Mesiacos, Alderman Donnell, Alderman Saville, Alderman Hart-Burns, Alderman Mervine, Alderman Bugg, Alderman Johnson, Alderman Irvin, Alderman O'Connor and Alderman Franco Enactment No: O15-048 15-00652 A Resolution Authorizing the Execution of a Development Agreement between the City of Aurora and Metro 59, LLC for a Partial Building Permit Fee Reduction for Property Known as Metro 59, Station Boulevard, in the City of Aurora Bill Wiet, Chief Development Officer, spoke to address concerns over the ability to convert rental units to condominiums and he read from a letter from Metro 59 that indicated a feasibility study would be performed in 5 years to study this issue. Jim Hughes from Metro 59 then spoke briefly to address a question posed by Alderman Johnson regarding contacting the local school district regarding the land to cash fees agreement between the two entities to be paid. A motion was made by Alderman Hart-Burns, seconded by Alderman Mervine, that this agenda item be approved. The motion carried.
