CITY OF BUCKEYE SPECIAL COUNCIL MEETING AND COUNCIL EXECUTIVE SESSION SEPTEMBER 2, 2025 MINUTES City Council Chambers 530 East Monroe Avenue Buckeye, AZ 85326 5:00 p.m. 1. Call to Order/Roll Call Mayor Orsborn called the meeting to order at 5:00 p.m. Members Present: Councilmember Youngker, Councilmember Berry, Councilmember Goodman, Councilmember HagEstad, Councilmember Beard, Vice Mayor Heustis, and Mayor Orsborn. Members Absent: None. Departments Present: City Manager Doug Sandtrom, Deputy City Manager Dave Roderique, City Attorney Scott McCoy, City Clerk Lucinda Aja, and Program Management Office Director James Shano. 2. Convene into Executive Session At 5:00 p.m. a motion was made by Councilmember HagEstad and seconded by Councilmember Goodman to convene into executive session pursuant to A.R.S. Sections 38-431.03 A.3 and 38-431 A.4 upon a majority vote, the public body will meet for a discussion or consultation for legal advice with the attorney or attorneys of the public body and for discussion and consultation with the attorney or attorneys of the public body in order to consider its position and instruct its attorneys regarding the public body's position regarding settlement discussions conducted in order to resolve litigation in the City of Buckeye vs. Dusty Cool Ltd. Partnership, an Arizona limited partnership, Maricopa County Superior Court Case No. CV2025-023201. Motion passed unanimously 3. Reconvene into Public Meeting At 521 p.m. a motion was made by Councilmember Goodman and seconded by Councilmember HagEstad to reconvene into the Public Meeting. Motion passed unanimously. 4. Non-Consent / New Business 4.A Council directs the City Attorney to negotiate the resolution of the litigation consistent with the direction provided during the Executive Session. A motion was made by Councilmember Goodman motion and seconded by Councilmember HagEstad to direct the City Attorney to negotiate the resolution of the litigation consistent with the direction provided during the Executive Session. Motion passed unanimously. 5.
