REQUEST:
We respectfully request the City Council with Mayor Presiding allow the Mayor of Burlington
to execute the two Decisions on the Condemnation proceedings on behalf of the entire body
of representatives of the City Council with Mayor Presiding.
BACKGROUND:
At 8:30 a.m. on May 21, 2026 the City Council with Mayor Presiding (CC w/MP) held a site
inspection, which was followed on May 21, 2026 at 6:00 p.m. by hearings on whether the public
good, necessity, and convenience of the inhabitants of the city require the Project; and
compensation for said takings.
The CC w/MP closed the Necessity Hearing, supporting the acquisition, via condemnation of the
easements of certain property interests in support of the Project, and voted to direct staff to
prepare written findings of the Decision on May 21, 2026.
The CC w/MP opened the Compensation Hearing for the project, that was subsequently
continued until June 1, 2026 where the CC w/MP moved to close the Compensation Hearing and
directed staff to prepare written findings of the Decision.
These Decisions have been attached here for the consideration of the CC w/MP.

Decision and Order of the City Council with Mayor Presiding

For the Alteration of a Public Intersection known as the Colchester Avenue

5000(29), and for Condemnation of a Portion Thereof
The City Council with Mayor presiding (“Council”) of the City of Burlington,
Vermont (“City”), by its own motion made and passed at a duly warned meeting of the
board on April 13, 2026, initiated proceedings pursuant to Chapter 7 of Title 19 of the
Vermont Statutes to alter an intersection and to begin condemnation proceedings for a
portion of the intersection project known as the Colchester Avenue, Riverside Avenue,
Barrett Street, and Mill Street Intersection Project STP 5000(29) (“Project”).
Notice of the condemnation site visit and hearing was given in accordance with 19
V.S.A. § 709 and the City Charter, with written notice being given in the following
manner to the following individuals and entities:
By certified mail to the individuals and entities noted in Attachment A and by posting in
the City Clerk’s office, the Public Works Department, and the Fletcher Free Library, and
by publishing in a local newspaper of general circulation, the Seven Days, on April 22,
2026 and by notification to the City’s Planning Commission.
At 8:30 a.m. on May 21, 2026 the Council held a site inspection, which was
followed on May 21, 2026 at 6:00 p.m. by a hearing on whether the public good,
necessity, and convenience of the inhabitants of the City require the Project. The Board
also took up the question of whether portions of the properties of Isabella B. Bennett,
located at 448-450 Colchester Avenue (PO1), Daniel K. Oren and Milagros T. Ibarra
located at 457 Colchester Avenue (PO8), and Burlington Estates, LLC located at 465-467
Colchester Avenue (PO10) would need to be condemned for the Project. At the hearing,
testimony of the Project team and interested persons and evidence was taken, with all
attendants being given the opportunity to question the witnesses by cross examination.
During the site inspection, the Council and others visited the location where the
intersection would be altered as well as the particular properties being considered for
condemnation. City staff marked off the existing right of way and indicated the areas
being considered for condemnation. The hearing followed that evening, in which the
following individuals testified: Stephen Spear of HNTB; Rosa Benoir, Right of Way
Appraisal Chief at VTrans; Madeline Suender, Burlington Public Works Engineer;
Barbara Dimick-Rowell, VTrans Right-of-Way Agent; and Dr. Isabella B. Bennett,
property owner of PO1. All parties present were afforded the opportunity for cross
examination of any witnesses testifying and all persons in attendance were afforded the
opportunity to present evidence. The proceedings were videotaped.
During the hearing, the following exhibits were introduced:

No party raised any objection to the admission of any exhibits, and therefore,
every exhibit listed above was admitted into evidence. Based on the evidence,
testimony, and exhibits presented at the hearing, the Council makes the following
findings of fact:
1. The Project is intended to improve safety and mobility for users, simplify the
intersection, enhance the gateway into Burlington, and manage traffic
congestion.
2. A scoping study completed between 2017 and 2019 analyzed alternatives and
ultimately recommended the Project and described the Project’s purpose and
need.
3. Among the determinations of the scoping study were a need for designated
bicycle lanes and improved safety for pedestrians.
4. The scoping study was completed in 2020 and went through a refinement in
2023, both of which were approved by the City Council.
5. The Project is bundled with the Winooski bridge project and has a September
federal construction funding deadline, which requires all property rights being
secured by that date.
6. The new roadway on Colchester Avenue will include two northbound approach
lanes and one southbound lane.
7. Two lanes northbound will improve traffic flow across the bridge.
8. The new roadway on Colchester Avenue will include buffered bike lanes, wider
esplanades, and sidewalks to improve safety and mobility for all users of the
intersection.
9. The Project adds a pedestrian phase to the traffic signal which does not exist in
the current intersection. The pedestrian phase will increase safety for pedestrians
as well as other users.
10. The delay created by the pedestrian phase is intended to be balanced by including
two northbound approach lanes, which will increase safety and allow more cars
to pass.
11. The new roadway on Colchester Avenue will include sidewalks that transition
into a shared use area.

12. The steep slopes on the east side of Colchester Avenue, driveways on both sides of
Colchester Avenue, and the plan to underground utilities impacted the design of
the Project.
13. To proceed with the Project, the City requires easements over PO1 including
temporary construction easements for driveway construction to match the new
sidewalk grade slightly outside the right-of-way, replacement of existing steps,
and lawn restoration.
14. To proceed with the Project, the City requires easements over PO8 including
permanent easements for retaining wall construction and access for future wall
maintenance and construction; a temporary construction easement for slope
grading and lawn restoration behind the retaining wall, walkway construction,
and contractor access; and permanent utility and temporary driveway easements
for underground utilities and driveway reconstruction following the
undergrounding of utilities.
15. To proceed with the Project, the City requires easements over PO10 including
permanent easements to install and maintain a retaining wall and provide access
for future wall maintenance and construction; temporary construction easements
for slope grading and lawn restoration behind the retaining wall, walkway
construction, replacement of an existing porch, and contractor access; and
permanent utility and temporary driveway easements for underground utilities
and driveway reconstruction following the undergrounding of utilities.
16. Utilities currently overhead on Colchester Avenue will be moved underground to
the back side of the properties on the east side of Colchester Avenue.
17. The undergrounding of utilities will enhance the gateway into Burlington and
remove visual clutter.
18. The easements over PO1, PO8, and PO10 will have no or minimal impact on the
grand list.
19. Dr. Isabel Bennet, owner of PO1, testified that she signed the requested easement
for the Project.
20.Barb Dimick-Rowell of VTrans testified that she received the signed easement.
Because the easement had not been supervisor approved, the City requested that
PO1 remain under consideration for condemnation.
21. Dr. Bennet also testified as to slope concerns with the Project and Stephen Spear
testified that geotechnical engineers have been involved with and will continue to
be involved with the Project.
22. Property owners of PO8 and PO10 did not testify at the hearing or submit
evidence.
23. The City notified persons owning or interested in the lands through which the
Project will pass or abut by certified mail of when the City Council would inspect
the site and receive testimony.
24.The City posted notice of the hearing in three public places in the City pursuant to
19 V.S.A. § 709.
25. A notice of the hearing was published in a newspaper of general circulation not
less than ten days before the hearing.
26.Proposed deeds or agreements of temporary rights were provided to the owners
of PO1, PO8, and PO10 for the proposed portion of the properties to be acquired
for the Project.

27. The easements are limited to what is necessary for the Project.
28.The scenic and recreational values of the highway will be improved with the
alteration and undergrounding of utilities, and the undergrounding of utilities
will accommodate present and future utility installations.
Based on the evidence presented and testimony heard at the hearing, and pursuant to 19
V.S.A. § 710, the Council determines the following:
1. The public good, necessity and convenience of the inhabitants of the City of
Burlington require that the lands described and depicted on the survey/plans,
known as Colchester Avenue, Riverside Avenue, Barrett Street, and Mill Street
Intersection Project STP 5000(29), be altered.
2. The public good, necessity and convenience of the inhabitants of the City of
Burlington require that the easements as described in the deeds, agreements of
temporary rights, and easement descriptions for PO1, PO8, and PO10 be
condemned.
Prior to this decision being issued, the City received signed easements or
agreements for PO1 and PO10 which eliminated the need to condemn those properties.
Based on the preceding findings and conclusions of law, the Council orders the
alteration of the Colchester Avenue, Riverside Avenue, Barrett Street, and Mill Street
Intersection Project STP 5000(29) as described on the survey/plans entered into
evidence and condemnation pursuant to the proposed Warranty Deeds of Easement to
the City of Burlington for property owned by Daniel K. Oren and Milagros T. Ibarra
located at 457 Colchester Avenue (PO8).
The landowners affected by this order shall have a period of 60 days from the
date of this order to remove all fences, timber, wood and trees, from the area now
covered by the public right of way, after which the City shall assume control of the land
over which it passes, for purposes of highways.
Any person interested in this decision to alter the Colchester Avenue, Riverside
Avenue, Barrett Street, and Mill Street Intersection Project STP 5000(29) may appeal
this decision to the Chittenden County Superior Court, Civil Division within 30 days of
the decision, in writing. V.R.C.P. 74; 19 V.S.A. § 740.

Decision and Order of the City Council with Mayor Presiding
City of Burlington, Vermont
Determination of Compensation for the Taking of Land for the Alteration of
a Public Intersection known as the Colchester Avenue Riverside Avenue,
Barrett Street, and Mill Street Intersection Project STP 5000(29)
The City Council with Mayor presiding (“Council”) of the City of Burlington,
Vermont (“City”), by its own motion made and passed at a duly warned meeting of the
board on April 13, 2026, initiated proceedings pursuant to Chapter 7 of Title 19 of the
Vermont Statutes to alter an intersection and to begin condemnation proceedings and to
determine compensation for a portion of the intersection project known as the
Colchester Avenue, Riverside Avenue, Barrett Street, and Mill Street Intersection
Project STP 5000(29) (“Project”).
Notice of the compensation hearing was given in accordance with 19 V.S.A. § 709
and the City Charter, with written notice being given in the following manner to the
following individuals and entities:
By certified mail to the individuals and entities noted in Attachment A and by posting in
the City Clerk’s office, the Public Works Department, and the Fletcher Free Library, and
by publishing in a local newspaper of general circulation, the Seven Days, on April 22,
2026 and by notification to the City’s Planning Commission.
At 8:30 a.m. on May 21, 2026 the Council held a site inspection, which was
followed on May 21, 2026 at 6:00 p.m. by a hearing on whether the public good,
necessity, and convenience of the inhabitants of the municipality require the Project.
The Board also took up the question of whether portions of the properties of Isabella B.
Bennett, located at 448-450 Colchester Avenue (PO1), Daniel K. Oren and Milagros T.
Ibarra located at 457 Colchester Avenue (PO8), and Burlington Estates, LLC located at
465-467 Colchester Avenue (PO10) would need to be condemned for the Project.
Following the hearing, the Council determined that the public good, necessity, and
convenience of the inhabitants of the City require the alteration of the Colchester
Avenue, Riverside Avenue, Barrett Street, and Mill Street Intersection Project STP
5000(29) and condemnation of portions of PO1, PO8, and PO10. Following the
condemnation hearing and before the Council issued its written decision on
condemnation, the PO1 and PO10 property owners executed easements to the City
which eliminated a need to condemn or determine compensation for those properties.
Ultimately, the City Council ordered condemnation of a portion of property owned by
Daniel K. Oren and Milagros T. Ibarra located at 457 Colchester Avenue (PO8).
Following the hearing on necessity on May 21, 2026, the Council opened a
hearing on determination of damages and compensation. At the hearing, the following
individuals testified: Gosia Carr, VTrans Right of Way Appraiser III; Steven Spear of
HNTB; Barbara Dimick-Rowell, VTrans Right-of-Way Agent; and Kristin Barany,
VTrans Right of Way Agent. The Council recessed the hearing and continued it until
June 1, 2026 at 7:00 p.m. All parties present were afforded the opportunity for cross

examination of any witnesses testifying and all persons in attendance were afforded the
opportunity to present evidence. The proceedings were videotaped.
During the hearing, the following exhibits were introduced:

No party raised any objection to the admission of any exhibits, and therefore,
every exhibit listed above was admitted into evidence. Based on the evidence,
testimony, and exhibits presented at the hearing, the Council makes the following
findings of fact:
1. The Council found that the public good, necessity, and convenience of the
inhabitants of the City of Burlington required alteration of the intersection
project known as the Colchester Avenue, Riverside Avenue, Barrett Street, and
Mill Street Intersection Project STP 5000(29) and condemnation of PO1, PO8,
and PO10.
2. The property owners of PO1 and PO10 executed easements to the City which
eliminated the need to condemn those properties or to determine just
compensation.
3. The property owner of PO8 is entitled to just compensation for the condemnation
of their property.
4. VTrans prepared a waiver valuation for PO8.
5. Waiver valuations, rather than appraisals, are performed for easements where
the taking is not complicated and where the easement value is under $35,000.
6. The valuations are determined by factoring the assessed land value, adjusting for
the common level of appraisal, to determine the per square foot price.
7. For temporary easements, the value is calculated by the number of years the
easement will be in place.

8. The easements over PO8 include permanent easements for retaining wall
construction and access for future wall maintenance and construction; a
temporary construction easement for slope grading and lawn restoration behind
the retaining wall, walkway construction, and contractor access; and permanent
utility and temporary driveway easements for underground utilities and driveway
reconstruction following the undergrounding of utilities.
9. The value of the permanent and temporary easements over PO8 were determined
by VTrans to be $20,600. This amount included $9,200 for permanent rights,
$9,600 for temporary rights, and $1,800 for the cost to cure value of two trees.
10. Compensation cannot be provided for issues that are not related to the specific
easements being obtained.
11. General construction impacts are not compensable.
12. Changes in the mode or extent of access are not compensable.
13. Offers and proposed deed or grants of temporary rights were provided to all
impacted property owners.
14. VTrans confirmed that they had been in touch with the PO8 owner and the PO8
owners had obtained the offer.
15. The PO8 property owner did not attend the hearing or submit evidence.
16. The PO8 property owner did not object to the compensation offered in the waiver
valuation.
17. The City notified persons owning or interested in the lands through which the
Project will pass or abut by certified mail of when the City Council would inspect
the site and receive testimony.
18. The City posted notice of the hearing in three public places in the City pursuant to
19 V.S.A. § 709.
19. A notice of the hearing was published in a newspaper of general circulation not
less than ten days before the hearing.
Based on the evidence presented and testimony heard at the hearing, and pursuant to 19
V.S.A. § 712, the Council determines the following:
1. Daniel K. Oren and Milagros T. Ibarra, owners of property located at located at
457 Colchester Avenue (PO8), shall be compensated in the amount of Twenty
Thousand, Six Hundred Dollars ($20,600) for the property interests that have
been condemned by the Council.
Based on the preceding findings and conclusions of law, the Council orders payment to
Daniel K. Oren and Milagros T. Ibarra, owners of property located at located at 457
Colchester Avenue (PO8), in the amount of Twenty Thousand, Six Hundred Dollars
($20,600) for the property interests that have been condemned by the Council.
Any person interested in this decision to alter the Colchester Avenue, Riverside Avenue,
Barrett Street, and Mill Street Intersection Project STP 5000(29) may appeal this
