The applicant has applied for and been granted a license for this annual event many times. Additionally, the applicant applied for a Community-Oriented Event Permit for vending purposes. Criteria for issuing or denying a liquor license per the Carbondale Revised Code: The Commission may grant a liquor license, contingent upon receipt of outstanding items, if it is determined that the grant of the license would not be detrimental to the general welfare of the City. The Commission may deny an application if it finds one or more of the following: 1. The application does not contain all the information, supporting documents, or fees required by this title. 2.The issuance of the license would be in violation of any part of this title. 3.The applicant does not have sufficient financial assets to maintain the proposed liquor establishment or has demonstrated insufficient financial responsibility. 4.The applicant is a convicted felon who has not been adequately rehabilitated. 5.The issuance of the license can reasonably be expected to create excessive noise, traffic, parking, or litter problems. 6.The applicant has a history of problems with regard to violations of health regulations, laws, and ordinances at prior establishments owned or managed by the applicant. 7.The building in whichthe applicant seeks to operate does not meet building and zoning code ordinances and regulations. 8.The issuance of the license can reasonably be expected to create a nuisance such as excessive and repeated breaches of the peace. 9.The applicant has previously had a liquor license revoked or suspended in this or any other state or jurisdiction. 10.The applicant is seeking a restaurant license and does not provide sufficient facilities or menu items to operate as a restaurant. Conditions On Issuance: If the Commission finds that any change in the applicant's plans is/are needed to create grounds for the issuance of such license, the Commission may require such change(s). The action was deferred to a date and time certain, that being October 22, 2024. This continuation was to provide time to rectify certain deficiencies with the application, clarity of ownership, and lease for the business and location. Several factors contribute to the challenges in determining proper ownership of the business and the legality of the lease submitted (see attachment referencing lease agreement); Staff cannot readily provide any recommendations without resolution to the conflicting information. The information below is provided to bring the Commission up-to-date on the application process. Patterson Industries, LLC and Daluxe LLC d/b/a This and That - Case 2024EV256 - Case filed July 31, 2024 - Motion Hearing Scheduled for March 26, 2026 This is an eviction proceeding between the property owner and the lessee. The lessee is listed as Daluxe LLC - not CakeFam, LLC. City and State laws require the license holder to be the lessee. The City Attorney's office continues to monitor the status of this case, as the outcome would have a direct impact on the license application. 235 ILCS 5/6-2. Issuance of licenses to certain persons is prohibited.(a) Except as otherwise provided in subsection (b) of this Section and in paragraph (1) of subsection (a) of Section 3-12, no license of any kind issued by the State Commission or any local commission shall be issued to: (13) A person who does not beneficially own the premises for which a license is sought, or does not have a lease thereon for the full period for which the license is to be issued. Communication with Applicant/Manager - There were ongoing communications between the City Attorney's Office and Ms. Bradley and/or Ms. Bradley-Farr from April 2024 through mid-November 2024. On November 13, 2024, at 3:15 p.m., Ebony Bradley brought in a new application with Arelia Bradley as owner and signer and Takia Holliday as additional signer. The legal entity for this application was listed as CakeFam dba This N' That. Ms. Bradley left before the initial review of the application could occur. The Clerk's Office sent the attached email to itemize some minor issues to be addressed. A background check fee, release, and identification for the new member listed on the updated application have not been received. See attachment entitled "Communication with Clerk Resubmitted Liquor License for This N That November 2024." This was the last known communication until acaller on behalf of This N'That inquired on February 14, 2025, why the license request had not been brought back before the Liquor Commission. Subsequently, emails have been received after the agendas have been published requesting the delay of this item citing illness as the cause of the request. Update Since Continuation Although no notification has been received from the applicant, the annual report filed earlier this month with the Secretary of State for the LLC no longer shows Takia Holliday as a member of the business entity. The criteria, or standards, serve as policy development guidelines representing high-quality service delivery. However, the true indicator of compliance lies with an evaluation by trained, independent professional peers. Establishing meaningful and professional standards and evaluating compliance with those standards are the two fundamentals of an accreditation program. The Tier II accreditation program is the most comprehensive, consisting of 181 standards, including administrative, operational, personnel, and training requirements. An ILEAP official carried out an onsite assessment over two days in December 2024, and the ILEAP Council awarded the accreditation to CPD in January 2025. Currently, 65 law enforcement agencies in Illinois are ILEAP-accredited agencies. Carbondale is now among only 22 law enforcement agencies in the state to have achieved Tier II accredited status. O'Fallon Public Safety Director and Illinois Law Enforcement Accreditation Program (ILEAP) Board Officer Kirk Brueggeman will present a plaque to Mayor Harvey for the Carbondale Police Department's achievement of Tier II accreditation. 6. Public Hearings and Special Reports Subject : 6.1 Presentation by Southern Illinois Historic Preservation on the Northeast Quadrant Building Survey Meeting : Mar 25, 2025 - Local Liquor Control Commission and Regular City Council Meeting March 25, 2025 Type : Reports Goals : Goal #1: Provide a high quality-of-life and foster a sense of community for all residents Goal #2: Establish programs, processes, and networks to address diversity, inclusion, equity, and justice Goal #6: Enhance residential development/rehabilitation Public Content Originating Department: Community Development Background: In 2022, the City of Carbondale was awarded a $21,000 grant from The State Historic Preservation Office of the Illinois Department of Natural Resources' Certified Local Governments matching grants program to conduct asurvey of historic and architecturally significant properties within the northeast quadrant of Carbondale, Illinois. The City contributed a $9,000 match for the grant. The purpose of the survey is to: 1. Inventory properties within the northeast quadrant of Carbondale 2. Identify architectural styles for buildings within the quadrant 3. Recommend properties and structures for potential historic designation This survey will help guide historic preservation efforts in the city and will be incorporated into the next update of the Historic Preservation Plan. In August of 2023, the City Council authorized the City Manager to enter into a professional agreement with Southern Illinois Historic Preservation to begin work on the survey. City staff worked with the consultant from August 2023 to May 2024 to survey and inventory properties in the northeast quadrant of Carbondale. In total, 456 residential, commercial, public, and religious properties were inventoried by architectural style and classification. A draft of the survey was completed in May 2024 and approved by the State Historic Preservation Office in July 2024. Attached for Council review are the following: 1. Map of the survey boundaries 2. Presentation of the survey results The consultants from Southern Illinois Historic Preservation are present to provide City Council with an overview of the results of the survey. It is recommended that the City Council hear a presentation of the Northeast Quadrant Building Survey. The activity, which is the subject of the (type of publication), has been financed (in part/entirely) with federal funds from the Department of the Interior, administered by the Illinois Department of Natural Resources. However, the contents and opinions do not necessarily reflect the views or policies of the Department of the Interior or the Illinois Department of Natural Resources, nor does the mention of trade names or commercial products constitute endorsement or recommendation by the Department of the Interior or the Illinois Department of Natural Resources. This grant is available quarterly for communities with a population under 50,000 to implement shovel-ready projects that enhance community spaces and foster local connections. Communities may receive up to $50,000. Projects selected must be implemented within 12 months of receiving funding. The deadline for submitting applications for the first quarter is March 31, 2025. City Staff are collaborating with staff from Carbondale Main Street to prepare an application for this grant. Staff are seeking $50,000 in funding to install wayfinding signage along the Downtown Campus Connector multi-use bike path to improve multi-modal connectivity between the SIU campus and downtown Carbondale. This will improve the visibility of the bike path, encourage greater use of the bike path, and enhance directional wayfinding to key destinations downtown. Wayfinding signage locations would be consistent with recommendations in the City's Wayfinding Master Plan, and address the following recommendations in the Downtown Master Plan: 1. Implement a wayfinding program to guide travelers and effectively direct movement both to Downtown Carbondale and to key destinations within the Downtown. 2. Enhance the downtown experience through the use of directional signs, maps, kiosks, and banners to create an intuitive navigational system for vehicles and pedestrians. Additionally, funding from the grant would finance cafe lighting at three locations in downtown Carbondale. The three locations are as follows: 1. Alleyway between Aban's Kitchen and Door Christian Fellowship Church 2. Alleyway between Cristaudo's and So Ill Syndicate Downtown Gym 3. Alleyway between Rip's Brick Oven Pizzeria and Legal Smile This will help improve the aesthetics in the downtown, improve safety, and encourage greater visitation downtown, particularly for the City's nightlife. It should be noted that two of the alleyway locations are on private property. If awarded the grant funds, the City would work with Carbondale Main Street and the property owners to approve an agreement for installing and maintaining the cafe lights. Consent Agenda of the City Council Subject : 7.5 Award of Contract for Biosolids Management to Metro-Ag, Inc. of Breese, Illinois Meeting : Mar 25, 2025 - Local Liquor Control Commission and Regular City Council Meeting March 25, 2025 Type : Action (Consent) Recommended Action : Award the Contract for Biosolids Management to Metro- Ag, Inc. of Breese, Illinois Goals : Goal #3: Demonstrate fiscal responsibility and transparency while providing high-quality City services Goal #1: Provide a high quality-of-life and foster a sense of community for all residents Public Content Originating Department: Public Works - Utilities Background: The City issued a Request for Proposals (RFP) for sludge management at the Northwest and Southeast Wastewater Treatment Plants. Biosolids are a byproduct of wastewater treatment, and must be managed properly to maintain regulatory compliance. The most environmentally responsible and economical solution is land application. Thecontract requires the contractor to load, transport, and dispose of dewatered sludge from the Southeast and Northwest Wastewater Treatment Plants. The adjacent City farmland will be used, as well as other nearby farmland. If the City had to dispose of the dewatered sludge at both plants, it would have to be loaded and transported to the Jackson County Landfill for an expensive disposal fee. The following renewal option is stated in the contract:"the term of this Contract shall be for a period of one (1) year, with an option for an additional two (2) years." The exact amount of sludge to be processed each year varies. Approximate yearly totals are included in the RFP for competitive proposal purposes. Unit prices will be paid according to actual services rendered, and all sludge quantities will be weighed, metered, or measured as defined in the contract. City staff has reviewed the submitted proposals, which contain multiple options for sludge management from four (4) vendors. Staff has selected Metro-Ag, Inc. due to proposing both the most practical and lowest cost method. Staff recommends that the attached contract be awarded for a term of up to three (3) years, upon mutual agreement of annual renewal, beginning on March 26, 2025, and ending on March 25, 2028. Phase II of the multi-use path was constructed in 2017, extending the bike path from Mill Street to the path connecting the SIU Recreation Center, Towers, and SIU campus. This path provides a safer, more convenient transportation option for people walking and bicycling to/from SIU to downtown Carbondale. In 2020, a Wayfinding Master Plan was developed for the City identifying specific locations for wayfinding signage, and branding for dedicated off-street paths existing and planned in Carbondale. The Wayfinding Master Plan identified the downtown multi-use path connecting downtown Carbondale to the SIU campus as the "Downtown-Campus Connector". A subsequent Bike Corridors Plan was completed in 2022, that also identifies this bike path as the Downtown-Campus Connector. Staff are seeking grant funding to install wayfinding signage recommended in the Wayfinding Master Plan and, as such, seek to have the multi-use path downtown formally designated as the "Downtown-Campus Connector". This would allow for consistent branding along the path and establish the route as a key anchor in the City's bike and pedestrian network.
