Troy Miller READING AND DISPOSAL OF THE JOURNAL A motion was made by Ginther, seconded by Mentel, to Dispense with the reading of the Journal and Approve. The motion carried by the following vote: Affirmative: 7- Michael Mentel, Charleta Tavares, Andrew Ginther, Priscilla Tyson, Eileen Paley, Hearcel Craig, and A. Troy Miller EMERGENCY, TABLED AND 2ND READING OF 30 DAY LEGISLATION ZONING: TYSON, CHR. CRAIG GINTHER MILLER PALEY TAVARES MENTEL 0917-2009 To rezone 5700 NORTH HAMILTON ROAD (43054), being 3.31± acres located on the east side of Hamilton Road, 438± feet north of Preserve Boulevard, From: CPD, Commercial Planned Development District, To: CPD, Commercial Planned Development District (Rezoning # Z08-048). A motion was made by Tyson, seconded by Ginther, that this matter be Waived the 2nd Reading. The motion carried by the following vote: Abstained: 1- Michael Mentel Affirmative: 6- Charleta Tavares, Andrew Ginther, Priscilla Tyson, Eileen Paley, Hearcel Craig, and A. Troy Miller TABLED UNTIL 01/11/10 A motion was made by Tyson, seconded by Ginther, that this matter be Tabled to Certain Date. A motion was made by Tyson, seconded by Tavares, that this matter be Approved. The motion carried by the following vote: Affirmative: 7- Michael Mentel, Charleta Tavares, Andrew Ginther, Priscilla Tyson, Eileen Paley, Hearcel Craig, and A. Troy Miller 0702-2009 To rezone 3100 COOPER ROAD (43081), being 21.18± acres located east of the intersection of Forest Hills Boulevard and Cooper Road, From: L-AR-12, Limited Apartment Residential District, To: L-AR-12, Limited Apartment Residential District (Rezoning # Z08-066). A motion was made by Tyson, seconded by Tavares, that this matter be Tabled Indefinitely.
