MINUTES CITY OF DEKALB SPECIAL CITY COUNCIL MEETING September 1, 2021 The City Council of DeKalb, Illinois held a Special City Council meeting on September 1st, 2021, in the Yusunas Meeting Room of the DeKalb Public Library, 309 Oak Street, DeKalb, Illinois. A. CALL TO ORDER AND ROLL CALL Mayor Barnes called the meeting to order at 5:00PM. Present were: Ald. Morris, Larson, Smith, McAdams, Perkins, Verbic, Mayor Barnes, Clerk Cohen Ald. Faivre not in attendance B. APPROVAL OF THE AGENDA Alderman Verbic Moved to approve the agenda, seconded by Alderman morris C. PUBLIC PARTICIPATION E. RESOLUTIONS 1. Resolution 2021-079 Authorizing the City Manager to Allocate $100,000 for the purchase of a fuel truck for the Dekalb-Taylor Municipal Airport Moved by Alderman McAdams, seconded by Alderman Smith. We have budgeted for replacement of a fuel truck that has long needed replacing, and due to the nature and speed of the auction cycle for said vehicles, council authorization is required to avoid a public notice process that would make purchasing impossible. As the budget has already been allocated, it makes sense to permit this purchasing. Secondarily authorization is sought to get rid of the old vehicle, either as a trade-in, or on the market. Ald. Smith clarified that this was budgeted for this year- which it was. Motion carries unanimously F. ADJOURNMENT Ald. Verbic moved to adjourn, seconded by Ald. DEKALB CITY COUNCIL AGENDA SPECIAL MEETING SEPTEMBER 1, 2021 5:00 P.M. DeKalb Public Library Yusunas Meeting Room 309 Oak Street DeKalb, Illinois 60115 COVID-19 Notice: The corporate authorities of the City of DeKalb intend to conduct this meeting in-person with a physically present quorum that is open to the public and in compliance with all applicable public health requirements. All persons attending this meeting shall be required to wear protective face masks/coverings in accordance with Governor JB Pritzker’s Executive Order 2021-20 dated August 26, 2021. A. CALL TO ORDER AND ROLL CALL C. APPROVAL OF THE AGENDA D. PUBLIC PARTICIPATION E. RESOLUTIONS 1. Resolution 2021-079 Authorizing the City Manager to Allocate $100,000 for the Purchase of a Fuel Truck for the DeKalb Taylor Municipal Airport. City Manager’s Summary: Fuel sales are the largest source of revenue for the City’s Airport operations and a fuel truck is used every day to tend to larger craft that can’t easily jockey for self-service gas at the pump. When the Airport Board met on August 24, there was considerable discussion about how to deal with our 1991 Avgas 100 LL fuel truck (aviation gasoline; low lead) that has exceeded its useful life. In fact, the truck regularly undergoes some kind of repair as illustrated in the recent picture below. Special Meeting Agenda September 1, 2021 Page 2 of 2 There are funds available (up to $100,000) in our Fund 420 (Capital Vehicle Replacement Fund) that were budgeted for a used fuel truck in FY2021. The City Manager and Airport Manager have been waiting for the market in such vehicles to open up, and it appears that the time has arrived as larger airports begin to turn over their fleets. The ”market” in this context is in internet auction houses that showcase used vehicles on the world-wide web and may entertain final offers within 24 hours. Because the City Manager’s spending limit is $20,000 and it is necessary to provide 48 hours’ notice before a public meeting, it is likely that serviceable vehicle options within the City’s budget allowance will come open and close before a credible offer can be authorized. Accordingly, the City Manager requests the Council’s permission to weigh market internet offerings as they arise over the next thirty (30) days with the Airport Manager and other staff and make nimble offers within the budgeted allocation of $100,000 in Fund 420 to secure the best deal for the City in a timely manner. City Council approval is recommended. F. RESOLUTION 2021-079 AUTHORIZING THE CITY MANAGER TO ALLOCATE $100,000 FOR THE PURCHASE OF A FUEL TRUCK FOR THE DEKALB TAYLOR MUNICIPAL AIRPORT. WHEREAS, the City of DeKalb (the “City”) is a home rule unit of local government and may exercise any power and perform any function pertaining to its government and affairs pursuant to Article VII, Section 6, of the Illinois Constitution of 1970; and WHEREAS, the City owns and operates the DeKalb Taylor Municipal Airport (the “Airport”); and WHEREAS, the City’s corporate authorities may authorize the purchase of personal property which is necessary to maintain and operate the Airport, and the sale of personal property which is no longer necessary or useful to operate the Airport pursuant to 65 ILCS 5/11-76.1-1, 65 ILCS 5/11-76-4, and 65 ILCS 5/11-101-1, et seq.; and WHEREAS, the City’s corporate authorities, City Manager, and Airport Manager find that the Airport’s existing fuel truck identified in Exhibit A attached hereto and incorporated herein (the “Personal Property”) is no longer necessary or useful for the City’s best interests; and WHEREAS, the City’s corporate authorities previously budgeted up to $100,000 for the purchase of a used fuel truck to replace the Personal Property (the “Replacement Fuel Truck”); and WHEREAS, the City’s corporate authorities find that disposing the Personal Property and purchasing the Replacement Fuel Truck are in the City’s best interests and promote the public health, safety, and welfare; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DEKALB, ILLINOIS: SECTION 1: The City’s corporate authorities authorize, approve, direct, and ratify the City Manager or his designee(s) to dispose of the Personal Property attached hereto and incorporated herein as Exhibit A, by sale, transfer, trade-in, exchange, salvage, or such other manner as the City Manager may deem necessary. The Personal Property shall be sold in an “as-is” condition without any representation being made as to its operation or as to its fitness for any particular purpose for an amount deemed acceptable by the City Manager. The funds received for the disposal of the Personal Property, if any, shall be deposited with the City’s Finance Department. If the Personal Property cannot be sold in this manner, the property may be junked or otherwise disposed of in any appropriate manner. The City Manager or his designee shall be authorized to sign any documents necessary to transfer title to the Personal Property and to undertake all acts which may be necessary to effect the disposal of the Personal Property. SECTION 2: The City’s corporate authorities authorize, approve, direct, and ratify the City Manager or his designee(s) to purchase, by internet auction or other such other manner as they may deem advisable, the Replacement Fuel Truck in an amount not to exceed $100,000.00, exclusive of any consideration received for the disposal of the Personal Property provided by Section 1 of this Resolution, and to undertake all acts which may be necessary to effect the purchase of the Replacement Fuel Truck. SECTION 3: This Resolution and each of its terms shall be the effective legislative act of a home Resolution 2021-079 Page 2 of 3 rule municipality without regard to whether such resolution should (a) contain terms contrary to the provisions of current or subsequent non-preemptive state law, or (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the City’s corporate authorities that to the extent that the terms of this Resolution should be inconsistent with any non-preemptive state law, that this Resolution shall supersede state law in that regard within its jurisdiction. SECTION 4: This resolution shall be in full force and effect from and after its passage and approval as provided by law.
