MINUTES OF MAYOR NELSON AND BOARD OF TRUSTEES FOR THE REGULAR MEETING OF THE VILLAGE OF FLOSSMOOR, ILLINOIS HELD ON JUNE 1, 2026 VILLAGE HALL June 1, 2026 7:00 PM Village Clerk Porter took roll. There was a quorum. PRESENT: Mayor Nelson and Trustees Daggett, Dorsey, Lofton, Mitros, Mustafa, and Rodgers. ABSENT: None ALSO PRESENT: Ann Novoa, Finance Director Carl Estelle, Chief of Police Scott Bugner, Director of Bld & Zoning Douglas Merkle, Deputy Chief of Police John Brunke, Public Works Director Bob Kopec, Fire Chief Bridget Wachtel, Village Manager Nicole Castagna, Asst to Vlg Mgr/Comm. Mgr. Jonathan Bogue, Asst. Village Mgr. Kathi Orr, Village Attorney GENERAL STATEMENT/RULES OF ORDER (Announced by Mayor Nelson): The meeting was streamed via Zoom. Mayor Nelson reviewed the public comment policy, which is available on the Village website. RECOGNITIONS AND APPOINTMENTS: Agenda Item # 1: A Proclamation Declaring June 2026 as Pride Month Mayor Nelson introduced Annie Ford and Amariyah Raickett, both Lighthouse LGBTQ+ Scholarship Recipients, to accept Flossmoor’s Pride Proclamation. Mayor Nelson, after introducing Ms. Ford and Ms. Raickett, reaffirmed the Village’s support of the LGBTQ+ community by reading the proclamation and declaring the month of June as Pride Month. Agenda Item #2: A Proclamation Honoring the 95th Birthday of Richard W. Condon Mayor Nelson introduced Dr. Kris Condon to accept a proclamation on behalf of her father, long-time Flossmoor resident Richard (Dick) W. Condon. In 1932, Richard Condon moved to Flossmoor Park. He is a veteran of the Korean War, Vice-President of the Flossmoor Veterans’ Memorial, and carved the Flossmoor crest which is on display in the boardroom. He has been a tremendous supporter of the community. Mayor Nelson read the Proclamation to honor Mr. Condon and declared his birthday, June 3, 2026, as “Richard W. Condon Day.” Page 1 of 7 MINUTES OF MAYOR NELSON AND BOARD OF TRUSTEES FOR THE REGULAR MEETING OF THE VILLAGE OF FLOSSMOOR, ILLINOIS HELD ON JUNE 1, 2026 VILLAGE HALL June 1, 2026 7:00 PM Agenda Item #3 A Proclamation Declaring June 3, 2026, as Global Running Day Mayor Nelson read the Proclamation to declare June 3, 2026, as Global Running Day to recognize Flossmoor’s embrace of community wellness, health, and recreation as essential components of a thriving and connected community. Mayor Nelson introduced the following to accept the proclamation: • Tamerra Buckhanan: An 82-year-old Flossmoor resident and lifelong runner who recently earned the prestigious Abbott World Marathon Majors Six Star Medal and has completed every Flossmoor Hidden Gem Half Marathon event. • Hidden Gem Half Marathon Organizers: Tom Dobrez and Betsy Cutrara, who were recognized for the race and winning the Chicago Area Runners Association (CARA) “Race of the Year” for three out of the past four years, and Dr. Kalisha Hill, who works on the medical staff. • Homewood-Flossmoor High School Girls Track & Field Team: The team was honored for winning its second consecutive state championship. • Parker Junior High School Track & Field Team: Recognized for earning multiple state titles, setting new records and achieving top finishes across events. PUBLIC WISHING TO ADDRESS THE BOARD: 1. Troy Holmes (Flossmoor resident): Expressed his appreciation for the Village of Flossmoor’s Pride Month and the Pride Flags that are flown in downtown Flossmoor. Discussed why it is important for the Village to fly the Pride flag, the history of the Pride Flag and its symbolism, and the many reasons he was upset when the Village of Homewood chose not to fly it this year. 2. Adam Rogers: Professional saxophonist. Performed music on his saxophone. 3. Pastor Doyle Landry: Discussed mental health issues in his family, the book “Black Pain” written by Terry Williams, and his concerns for high school students, senior citizens, and housing shortages. Mayor Nelson called for a moment of silence in remembrance of Spencer Leak, Jr., Flossmoor resident who recently passed away. Trustee Dorsey so moved, Trustee Daggett seconded. Mayor Nelson asked if there were any items on the Consent Agenda that were requested to be removed for discussion, and there were none. A vote on the Motion was presented and passed unanimously by a roll call vote. AYES: Trustees Daggett, Dorsey, Lofton, Mitros, Mustafa, and Rodgers ABSENT: None ABSTAIN: None NAYS: None REPORTS OF COMMITTEES, COMMISSIONS AND BOARDS: Mayor Nelson stated there were no formal reports from the Committees or Commissions. Mayor Nelson provided information about the Public Art Commission’s upcoming fundraiser (https://www.artflossmoor.com/) and the HF Park District’s Pride Festival that is being held on June 12, 2026, in Flossmoor Park and supported by the Community Relations Commission. ACTION ITEMS: Agenda Item #8: Consideration of a Resolution of the Village of Flossmoor, Cook County, Illinois to Induce the Redevelopment of Certain Properties within the Proposed Southwest Flossmoor Tax Increment Redevelopment Project Area Mayor Nelson called for a Motion to approve Action Item #8. Trustee Mustafa so moved, Trustee Daggett seconded. This action item was presented by Kathleen F. Orr, Village Attorney who provided information about: (a) the Board having approved a development agreement with OBE Studios for a multi- media entertainment campus; (b) The developer having requested financial assistance from the Village; (c) Investigation supporting the subject property and adjacent properties qualifying as a “redevelopment project area” (a “TIF”) under the TIF Act, and (d) recommendations for the proposed ordinance. The purpose of these recommendations is to assist OBE Studios and the Southland Development Agency in developing this property. Attorney Orr is working with John Brunke and Scott Bugner to prepare the TIF plan. The Board engaged Attorney Orr in discussions that included confirming the parcels to be in the TIF, and that this would not subject the Village to any liabilities. The Board unanimously voiced support for this action item. A vote on the Motion was presented and passed by a unanimous vote. AYES: Trustees Daggett, Dorsey, Lofton, Mitros, Mustafa, and Rodgers ABSENT: None ABSTAIN: None NAYS: None Agenda Item #9: Consideration of an Ordinance of the Village of Flossmoor, Cook County, Illinois Amending Chapter 200 of the Village of Flossmoor Municipal Code (Noise/Nuisance) Mayor Nelson called for a Motion to approve Action Item #9. Trustee Mustafa so moved, Trustee Daggett seconded. This action item was presented by Douglas Merkle, Deputy Chief of Police, who provided information about noise complaints received by the police department, difficulties the police department has with responding to noise complaints and enforcing standards regarding excessive and unreasonable noise within the Village. Attorney Orr stated that the proposed ordinance needs to be amended so that the term “community events” under §200-7-4(D) states the following: Community events: The term “community events" shall include such things as parades, festivals, drum corps, marching band shows, sports events, Fourth of July celebrations, sanctioned or sponsored in whole or in part by local governments, schools, houses of worship, or charitable or service organizations, including school attendance bells, playground noise, church bells, and approved block parties. Mayor Nelson called for a Motion to approve the amendment to Action Item #9 under §200-7- 4(D) “Community Events” of the proposed ordinance. Trustee Mitros so moved, Trustee Lofton seconded. Mayor Nelson asked for questions. The Board responded with questions about the police department’s discretion in noise complaint enforcement, the use of decibel standards, how the Page 4 of 7 MINUTES OF MAYOR NELSON AND BOARD OF TRUSTEES FOR THE REGULAR MEETING OF THE VILLAGE OF FLOSSMOOR, ILLINOIS HELD ON JUNE 1, 2026 VILLAGE HALL June 1, 2026 7:00 PM ordinance will be enforced by police officers using their personal judgment, and fines for noise violations. The Board was in full support of this action item with the proposed amendment. A vote on the Motion to Amend §200-7-4(D) “Community Events” of the proposed ordinance, as stated by Attorney Orr, was presented and passed by a unanimous roll call vote. AYES: Trustees Daggett, Dorsey, Lofton, Mitros, Mustafa, and Rodgers ABSENT: None ABSTAIN: None NAYS: None A vote on the Motion, as amended, was presented and passed by a unanimous vote. AYES: Trustees Daggett, Dorsey, Lofton, Mitros, Mustafa, and Rodgers ABSENT: None ABSTAIN: None NAYS: None DISCUSSION ITEMS: None OTHER BUSINESS: Mayor Nelson stated the Board needed to have an Executive Session, and before doing so, asked if there were any other business. The Board responded as follows: Trustee Daggett: Congratulations to those who have graduates. Praised the accolades of the students. Also praised Public Works on the successful bids for the resurfacing project. Trustee Rodgers: None. Trustee Mustafa: Expressed appreciation to Mr. Richard Condon and his lifetime of contributions. Trustee Mitros: None. Trustee Lofton: Condolences to the Leak family on the passing of Spencer Leak, Jr. and gave information about his family, fraternal background, and their shared history. Clerk Porter: Expressed appreciation for Flossmoor’s upcoming Pride Celebration, the contributions of Flossmoor’s Community Engagement Manager, Stephanie Wright, in starting this annual event, and noted that Flossmoor is one of the first Chicago suburbs to have a Pride celebration. Village Manager Wachtel: The Village is back on track to have the landscaping work completed, with work to begin by the end of the week. Ms. Wachtel explained that the contract is held by IDOT, and they are coordinating this remaining work. John Brunke, Director of Public Works, responded to questions from Trustee Mustafa about the plants for the downtown area. Mayor Nelson provided the following updates about the Spring legislative session: • No change in the local government distributive fund • The Build Initiative stalled • The E-Bike bill passed and is being reviewed by the Village • The Body Cam bill stalled • No regulations on data centers were passed • Nothing was done with pensions Agenda Item #10: A Motion to go into Executive Session to Discuss the Employment of Specific Individuals, Property Acquisition, and Litigation Mayor Nelson called for a motion to go into Executive Session to discuss the employment of specific individuals. Trustee Lofton so moved, Trustee Daggett seconded. A vote on the Motion was presented and passed by a unanimous vote. Nelson, Mayor of Flossmoor, do hereby proclaim the month of JUNE 2026 as: “Pride Month” and encourage, not only during the month of June, but throughout the year, that Flossmoor residents learn about the struggles and achievements of the LGBTQ+ community that have shaped our history and to practice the values of acceptance and inclusion within the Flossmoor community so that Flossmoor’s LGBTQ+ residents know Flossmoor is a community to call home. Condon on the Occasion of his 95th Birthday WHEREAS, Richard W. Condon celebrates the extraordinary milestone of his 95th birthday on June 3, 2026; and WHEREAS, his life is deeply rooted in the Village of Flossmoor, having moved to Flossmoor Park in 1932 and to Apartment 309 of the Civic Center Building in 1934; and WHEREAS, he began four-year-old kindergarten at Flossmoor School (later Leavitt Avenue School) in 1935, and remained a student there through 8th grade graduation; and WHEREAS, Apartment 309 remained central to his life until 1961, when he married his beloved wife, Maridell, while his parents continued to reside there until 1965; and WHEREAS, these early years reflect a lifelong connection to Flossmoor and that shaped his character and values; and WHEREAS, Mr. Condon honorably served his country in the United States Army during the Korean War, demonstrating courage and patriotism; and WHEREAS, he built a distinguished career as a design engineer, earning 22 patents and contributing his expertise to local causes; and WHEREAS, he is also a talented woodcarver whose artwork is featured on the back wall of the Village Hall Board Room and at Chef Klaus’, a German restaurant in Frankfort; and WHEREAS, he witnessed the 1945 dedication of the original Flossmoor Honor Roll and later served as both inspiration and technical expert for the Flossmoor Veterans’ Wall of Honor, to be completed in 2026. WHEREAS, for nearly two decades, he volunteered with the Homewood Historical Society, helping organize and preserve its collections and strengthening the community’s connection to its shared history; and WHEREAS, even in retirement, he has continued to give selflessly through his time, talents, and civic spirit; and WHEREAS, throughout his 95 years, Mr. Condon has exemplified resilience, wisdom, and unwavering devotion to family, community, and service; NOW, THEREFORE, I, Michelle I. Nelson, Mayor of the Village of Flossmoor, do hereby proclaim June 3, 2026 as: “Richard W. Condon Day” in the Village of Flossmoor, and encourage all residents to join in celebrating this remarkable individual and his lifetime of service, craftsmanship, and community pride. Nelson, Mayor Page 4 of 50 Proclamation WHEREAS, Global Running Day is an annual worldwide celebration held on the first Wednesday in June to encourage people of all ages and abilities to engage in physical activity, originating as National Running Day in the United States in 2009 and expanding globally in 2016; and WHEREAS, the Village of Flossmoor embraces community wellness, health, and recreation as essential components of a thriving, connected community; and WHEREAS, running is an accessible activity that strengthens physical health, supports emotional well-being, fosters lifelong habits, and brings people together through shared goals and support; and WHEREAS, the Village of Flossmoor proudly recognizes residents whose achievements inspire others, including Tamerra Buckhanan, an 82-year-old lifelong runner who has completed every Flossmoor Family Run/Walk “Gem” event and recently earned the esteemed Abbott World Marathon Majors Six Star Medal by completing the Chicago, London, New York, Tokyo, Berlin, and Boston Marathons; and WHEREAS, the Village also recognizes the contributions of Tom Dobrez, whose support and advocacy have encouraged community volunteerism and community pride centered around the sport of running; and WHEREAS, the Village additionally celebrates the outstanding achievements of local student-athletes, including the Homewood-Flossmoor High School girls track team for earning back-to-back state championships, as well as members of the Parker Junior High Track and Field team who delivered a historic performance at the state level, earning multiple state titles, setting new records, and achieving top finishes across events. ACTION ITEMS: Agenda Item #9: Consideration of an Award of Contract for the Flossmoor Library Floor Rehabilitation Mayor Nelson called for a Motion to approve Action Item #9. Trustee Daggett so moved, Trustee Mustafa seconded. This action item was presented by Village Manager Wachtel, who provided the history and background about the investigation into the sinkhole at the west side of the library facility that the Village learned about in February of 2025. Village Manager Wachtel discussed the library building ownership, the extensive investigation into the cause of the sinkhole and the results of that investigation. Director Brunke and experts retained by the Village concluded that the clay soil used to backfill the site in 2003/2004, which has now dried out and shrunk, is the root cause of the problem. This cause is not covered by insurance. Director Brunke noted that the cost of the repair could be between $43,000 and $50,000 to address all the voids identified in the survey. The Village has not historically budgeted for building repairs to the Library. Should the Village assume the full cost of the work, the money would either come from fund balance or at the expense of another Village operation (i.e., services like $50,000 less in sidewalk repairs or parkway tree trimming, or a capital asset purchase equivalent to one squad car). The Library’s GASB 54 disclosures show $1.9 million in fund balance (page 97 in the FY27 budget), and FY 27 expenditures total $1.8 million. Through the GASB 54 disclosures, the Library has committed $617,532 toward unassigned major exterior repair and building maintenance, and another $282,884 in unassigned major interior repair and building maintenance. These monies are in addition to another $475,013 in unassigned fund balance. Village Manager Wachtel asked for questions from the Board. The Board engaged in lengthy back- and-forth discussions with Library Board President, Natasha Bergeron, Library Executive Director Jamie Paicely, and Village Attorney Miller, about who was responsible for paying for these repairs. This discussion focused on the following topics: (a) The purpose and intent of the IGA; (b) The roles and responsibilities of the Village and the Library under the longstanding terms of IGA; (c) Attorney Miller’s legal research, and ultimate conclusions that, pursuant to the longstanding and agreed upon terms of the IGA that it is the Library that has 100% financial responsibility for these repairs; (d) Representations by Bergeron and Paicely about how the Library’s attorney, who was not present, told them that the Village should pay for the repairs; (e) The Library having more than enough of its own financial resources to pay for 100% of all of the anticipated costs and expenses associated with the repairs; (f) Trustee Daggett’s suggestion that the Village and the Library share the costs and expenses as a compromise; and (g) How the Village would have to amend the budget it recently passed, and make a decision on what services and capital projects to cut from its budget, if it agreed to the Library’s request to pay for these repairs. There was also much discussion about how the Library has accumulated an incredibly large surplus of funds, and how the Library should be using these surplus funds. A vote on the Motion was presented and by a unanimous roll call vote, the Motion did not pass. Brunke, Public Works Director DATE: June 1, 2026 RE: Consideration of an Award of Contract for the FY27 MFT Street Resurfacing Program On May 20, 2026, sealed bids were opened for the FY27 MFT Street Resurfacing Program. This annual program is part of the Village’s Finance & Facilities Plan. The major component of the program is to mill and resurface approximately 1 to 1 ½ miles of Village streets, depending on available funding. The program also includes spot curb repairs and sidewalk replacement with ADA modifications in the necessary areas on the streets where resurfacing work is performed. In past years, the program included mid-block sidewalk replacement work in order to have a fully restored street section once the program was completed on that street. Due to current construction costs, Staff moved away from this model for this year in order to complete as much street resurfacing work as possible with the program budget. By making this change, only the ADA sidewalk improvements at the intersections will be completed with the resurfacing program, and any mid-block sidewalk in need of repair will need to wait for the sidewalk replacement program to capture and repair. The FY27 approved budget for this program is $500,000 (Motor Fuel Tax Fund). This is the same grant that offset the installation of cameras in the downtown area. Through this grant, Meijer Inc has agreed to allow the camera to be on their property and use Meijer’s electrical power. A Memorandum of Understanding (MOU) to place the cameras on Meijer’s property has been drafted, reviewed, and signed by the legal representation of Meijer Inc. The Village Attorney has also approved the MOU. The location of Meijer’s property is 3740 Vollmer Road-Meijer Gas Station. The camera will be pole-mounted adjacent to the gas station marquee sign. The installation of cameras near retail centers helps the Police Department monitor, investigate, and track trends in retail theft crimes. The Police Department and the local businesses will benefit from the installation of these cameras. The cameras in Flossmoor's downtown district were instrumental in the investigation of traffic crashes and theft of catalytic converters, as well as the successful charging of a burglary of a business and a hate crime involving graffiti on public buildings and public art. The second phase will fund the camera installation on Meijer’s gas station property. These cameras will directly monitor the AT&T strip mall and Meijer gas station while covering Traditions Drive and the Meijer parking lot. The second phase also funded the installation of a camera near the Flossmoor Commons strip mall. This camera covers the Governors Highway entrance into the Flossmoor Commons parking lot as well as the alley behind the Flossmoor Commons. With the above considerations in mind, staff recommends that the Village Board approve the attached ordinance approving a license and a memorandum of understanding for a camera installation at 3740 Vollmer Road. In order to finance the project, the Developer has requested financial assistance from the Village and after an investigation of the Subject Property and adjacent properties, it was determined that the Subject Property and adjacent properties could qualify as a “redevelopment project area” (a “TIF”) under the TIF Act. Assuming the Village is able to establish a new TIF, the Village could use incremental revenues available to it as the result of the adoption of the TIF Act to reimburse the Developer for eligible redevelopment project costs. Accordingly, it is recommended, while the Village is working on the establishment of a new TIF, that the expenses the Developer must incur for architectural and engineering plans for the project be considered as eligible redevelopment project costs, in the event a redevelopment agreement is approved. The proposed Ordinance, in the form attached, is the means by which the current costs and expenses for the Project may be reimbursable in the event, and only in the event, a TIF is established and a redevelopment agreement is approved. This Ordinance does not commit or obligate the Village to proceed with a TIF or approve a redevelopment agreement. 1 Page 39 of 50 Resolution No. 2026- ____ A RESOLUTION OF THE VILLAGE OF FLOSSMOOR, COOK COUNTY, ILLINOIS, TO INDUCE THE REDEVELOPMENT OF CERTAIN PROPERTIES WITHIN THE PROPOSED SOUTHWEST FLOSSMOOR TAX INCREMENT REDEVELOPMENT PROJECT AREA WHEREAS, the Village of Flossmoor, Cook County, Illinois (the “Village”), is a duly organized and validly existing non-home rule municipality of the State of Illinois pursuant to the 1970 Illinois Constitution and the Illinois Municipal Code, as from time to time amended (the “Municipal Code”) (65 ILCS 5/65-1-1-2, et. seq.); and, WHEREAS, the Mayor and Board of Trustees of the Village (the “Corporate Authorities”), have authorized an eligibility study and report with respect to certain properties within the Village generally described as the vacant parcels fronting Vollmer Road from Central Park Avenue to the Meijer’s gas station and the parcels fronting 198th Street from the Public Works facility on the west and then east to Crawford Avenue north of the Meijer store (the “Proposed Project Area”) for the purpose of determining if the Proposed Project Area qualifies as a “blighted area” under the Tax Increment Allocation Redevelopment Act, 65 ILCS 5/11-74.4-1 et. Seq. (the “TIF Act”); and WHEREAS, in the event the Proposed Project Area qualifies as a blighted area under the TIF Act, the Corporate Authorities have authorized the preparation of a redevelopment project and plan for their review and thereafter to consider the designation of the Proposed Project Area as a “redevelopment project area” under the TIF Act in order to facilitate redevelopment by providing financial assistance through the reimbursement of eligible redevelopment costs as permitted by the TIF Act; and WHEREAS, OBE Studios, LLC, an Indiana limited liability company, (the “Developer”) a multimedia entertainment company specializing in film and television, has submitted a proposal to acquire the property commonly known as 3638 198th Street and 3648 198th Street identified by parcel numbers 31-11-303-007-0000 and 31-11-303-006-0000 (collectively, the “Subject Property”), which parcels are owned by the Village and are located within the Proposed Project 1 Page 40 of 50 Area, for the purpose of constructing a filming center in two phases: (i) the first phase to consist of three buildings including an administration/production building, a soundstage, and a millhouse as well as the construction of internal roadways; and, (ii)the second phase to consist of a building for retail use and a second sound stage ( collectively, the “Project”); and WHEREAS, the Developer has advised the Village that it would be able to proceed with the Project only with financial assistance from the Village in the event the Village adopts the TIF Act as applicable to the Subject Property thereby authorizing the Village to reimburse the Developer for certain “Redevelopment Project Costs” as defined by the TIF Act to be incurred in connection with the Project; and, WHEREAS, the Developer would like to incur certain costs in connection with the future redevelopment of the Subject Property prior to the designation of the Proposed Project Area as a redevelopment project area under the TIF Act and the approval of any ordinance authorizing the execution of a redevelopment agreement between the Developer and the Village, wherein reimbursement for such costs may be considered, subject to certain terms and conditions; and, WHEREAS, this Resolution is intended to allow the Developer to incur certain costs relating to the redevelopment of the Subject Property that may be considered Redevelopment Project Costs, prior to the approval of the Proposed Project Area as a redevelopment project area and approval of any ordinance authorizing the execution of a redevelopment agreement with the Village, subject to the condition set forth in Section 3 of this Resolution. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the Village of Flossmoor, Cook County, Illinois, as follows: Section 1. The foregoing recitals are hereby incorporated in this Resolution as if fully set forth herein. Section 2. That the Village may consider expenditures that are Redevelopment Project Costs, in connection with the redevelopment of the Subject Property incurred prior to the 2 Page 41 of 50 approval of ordinances designating the Proposed Project Area as a redevelopment project area and execution of a redevelopment agreement, to be expenditures that are eligible for reimbursement through the TIF Act, provided that such costs constitute “redevelopment project costs” as defined by the TIF Act; and, that the redevelopment of the Properties shall be in furtherance of the redevelopment project and plan for the overall Project Area. Section 3. That all undertakings of the Village set forth in this Resolution are specifically contingent upon the City approving the designation of the Proposed Project Area as a redevelopment project area and the execution a redevelopment agreement with the Developer which provides for the development or redevelopment of the Subject Property in accordance with the terms and conditions to be negotiated by the parties. Section 4. That any financial assistance rendered to the Developer by the Village shall be contingent upon the authority, restrictions, terms and conditions imposed by the TIF Act. Section 5. That this Resolution shall be in full force and effect from and after its passage and approval as provided by law. The proposed ordinance is intended to provide clear and enforceable standards regarding excessive and unreasonable noise within the Village while balancing the needs of residents, businesses, community organizations, and legitimate activities. The purpose of this amendment is to address situations where excessive, unnecessary, unnatural, or unusually loud noise becomes detrimental to the public health, comfort, safety, welfare, and property of Village residents. Over time, the Police Department has responded to numerous complaints involving loud music, disruptive gatherings, vehicle noise, shouting, construction activities, and other noise-related disturbances that negatively impact neighboring residents and their quality of life. While officers have attempted to address these issues through voluntary compliance and existing nuisance provisions, the Village currently lacks a comprehensive noise ordinance that clearly defines prohibited conduct and establishes objective standards for enforcement. The proposed amendment would prohibit excessive, unnecessary, or unusually loud noise that disturbs the peace, comfort, health, or safety of others. The ordinance establishes a measurable standard by prohibiting noise that is plainly audible at a distance of fifty (50) feet from its source. This objective standard provides residents, businesses, and law enforcement personnel with a clear understanding of what constitutes a violation. The ordinance identifies specific activities that are considered loud, disturbing, and unnecessary noises, including but not limited to: ● Excessive vehicle horn use except in emergencies. ● Loud radios, stereos, musical instruments, and sound-producing devices that disturb neighboring residents. ● Commercial advertising through amplified sound projected onto public streets. ● Unreasonable yelling, shouting, hooting, whistling, or singing that disturbs others. ● Animals creating frequent or prolonged noise disturbances. ● Vehicles operating in a manner that produces excessive rattling, grinding, or other unnecessary noise. ● Construction, demolition, excavation, and repair activities conducted outside designated hours. Page 44 of 50 ● Noise that interferes with the operation of schools, hospitals, churches, and similar institutions. ● Unreasonable operation of snow removal equipment, blowers, and other noise-producing machinery. Recognizing that certain activities serve important public purposes, the ordinance also includes reasonable exemptions. Emergency operations, activities required by law, emergency utility and street repair. These exemptions ensure that necessary activities may continue while still protecting residents from unreasonable disturbances. The approval of this amendment will provide the Village with a modern and practical tool to address recurring noise complaints, improve neighborhood quality of life, promote peaceful enjoyment of residential property, and provide clear guidance for both residents and enforcement personnel. The ordinance is designed to encourage voluntary compliance while providing a fair enforcement mechanism when necessary. Page 45 of 50 FMC Ordinance No. 2026 ___________ AN ORDINANCE OF THE VILLAGE OF FLOSSMOOR, COOK COUNTY, ILLINOIS AMENDING CHAPTER 200 OF THE VILLAGE OF FLOSSMOOR MUNICIPAL CODE (Noise/Nuisance) WHEREAS, the Village of Flossmoor, Cook County, Illinois (the “Village”) is a duly organized and validly existing non-home-rule municipality created in accordance with the Constitution of the State of Illinois of 1970 and the laws of the State; and, WHEREAS, the making of excessive and unnecessary noise are detrimental to the health, safety and welfare of the residents of the Village and therefore limitations and prohibitions on excessive noise is in the best interests of all Village residents. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village of Flossmoor, Cook County, Illinois, as follows: Section 1: The Village of Flossmoor Municipal Code is hereby amended by adding a new Article 7 to Chapter 200 as follows: Article 7 Noise. §200-7-1. Findings. The making, creation or maintenance of excessive, unnecessary, unnatural or unusually loud noise which are prolonged in time, place and use are detrimental to the public health, comfort, safety, welfare and property of residents of the Village and are deemed a nuisance. §200-7-2. Prohibition. It shall be unlawful for any person to make, continue, or cause to be made or continued any excessive, unnecessary or unusually loud noise or any noise plainly audible at a distance of fifty 1 Page 46 of 50 (50) feet in any direction from the origin of such noise which either annoys, disturbs, injures or endangers the comfort, repose, health, peace or safety of others, within the limits of the Village. §200-7-3. Noises prohibited. A. The following acts, without limitation, are declared to be loud, disturbing and unnecessary noises in violation of this chapter: (1) The sounding of any horn or signaling device on any automobile, motorcycle or other vehicle on any street or public place of the Village, except as a danger warning: the creation by any such signaling device of any unreasonably loud or harsh sound; and the sounding of any such device for an unnecessary and unreasonable period of time; and the use of any horn, whistle or other such signaling device when traffic is for any reason held up. (2) The using, operating or permitting to be played, used or operated of any radio receiving set, musical instrument, phonograph, or other machine or device for the producing or reproducing of sound in such manner as to disturb the peace, quiet and comfort of the neighboring inhabitants or, at anytime, with louder volume than is necessary for the convenient hearing for the person or persons who are in the room, vehicle or chamber in which such machine or device is operated. The operation of any instrument, machine or device in such manner as to be plainly audible at a distance of 50 feet from the building, structure or vehicle from which the noise is generated shall be prima facie evidence of a violation of this section. (3) The using, operating or permitting to be played, used, or operated of any radio receiving set, musical instrument, phonograph, loudspeaker, sound amplifier, or other machine or device for the producing or reproducing of sound which projects sound upon the public streets for the purpose of commercial advertising or attracting the attention of the public to any building or structure. 2 Page 47 of 50 (4) Unreasonable yelling, shouting, hooting, whistling, or singing at any time or place so as to annoy or disturb the quiet, comfort, or repose of persons in any office, or in any dwelling, or other type of residence, or of any persons in the vicinity. (5) The keeping of any animal or bird causing frequent or long continued noise which disturbs the comfort or repose of any person in the vicinity. (6) The use of any automobile, motorcycle, or vehicle out of repair, customized in such manner to create loud unnecessary grating, grinding, rumbling, rattling or other noise. (7) The erection (including excavation), demolition, alteration or repair of any building other than between the hours of 7:00 a.m. and 9:00 p.m., except in case of urgent necessity in the interest of public health and safety, and then only with a permit from the Village, which permit may be granted for a period not to exceed three days or less while the emergency continues and which permit may be renewed for periods of three days or less while the emergency continues. (8) The creation of any excessive noise on any street adjacent to any school, institution of learning, hospital or church while the same are in use, which unreasonably interferes with the workings of such institution, provided conspicuous signs are displayed in such streets indicating that the same is a school, hospital or church. (9) Enforcement of Section A, subsections (1) through (8)8 shall be strictly enforced without exception between the hours of 9 p.m. and 7 a.m. (10) The operation of any noise-creating snow removal equipment, blower or power fan or any internal combustion engine, generator or electric motor, unless the operation of such snow removal equipment is necessary or reasonable under the totality of the circumstances. In determining whether such operation and use is necessary or reasonable, the time of day, the amount of existing or predicted snowfall, the relative need for access unobstructed by snow shall be taken into consideration. 3 Page 48 of 50 §200-7-4: Exemptions: A. Emergency operations: Emergency short-term operations which are necessary to protect the health and welfare of the citizens, such as emergency utility and street repair, fallen tree removal or emergency fuel oil delivery shall be exempt, provided that reasonable steps shall be taken by those in charge of such operations to minimize noise emanating from the same. B. Noises required by law: The provisions of this section shall not apply to any noise required specifically by law for the protection or safety of people or property. C. Powered equipment: Powered equipment, such as lawn mowers, small lawn and garden tools, riding tractors, and snow removal equipment which is necessary for the maintenance of property is exempt between the hours of 7:00 a.m. and 9:00 p.m. D. Community events: The term “community events" shall include such things as parades, festivals, drum corps or marching band shows, sports events, Fourth of July celebrations, sanctioned or sponsored in whole or in part by local governments, schools or charitable or service organizations, including approved block parties. Section 2: The Village of Flossmoor Municipal Code is hereby amended by deleting Chapter 200 Article 4 Section 4 in its entirety. Section 3: This Ordinance shall be in full force and effect upon its passage, approval, and publication in pamphlet form as provided by law.
