BOARD OF APPEALS MEETING MINUTES CITY OF FOND DU LAC, WISCONSIN 160 South Macy Street Meeting Room A October 6, 2025 3:00 PM CALL TO ORDER A. Attendance Present: Misty Snyder Jeffrey Uitenbroek David Vanden Avond Absent: Jeffrey Labahn Tracy Qualmann Administrative Staff: Dyann Benson, Community Development Director B. Declaration Quorum Present Chairperson David Vanden Avond declared a quorum present at 3:00 p.m. APPROVAL OF MINUTES September 15, 2025 A Motion was made by Misty Snyder to approve the minutes of the September 15, 2025 meeting of the Board of Appeals and seconded by Jeffrey Uitenbroek and the motion was Passed. Ayes: Snyder, Uitenbroek, Vanden Avond Absent: Labahn, Qualmann HEARINGS 987 South Main Street (Big Brothers Big Sisters) Appeal 2025-15 Zoning Code Regulations: Section 720-11(C)(19) Accessory Buildings and Uses restricts the location of playground equipment to the rear yard. Proposal: Allow the installation of playground equipment in the front yard along Main Street. Spoke in Support: Tammy Young, Executive Director, Big Brothers Big Sisters (BBBS) Ryan Kamphuis, Board Member BBBS Mike Rosenau, Board Member BBBS Motion made by Jeffrey Uitenbroek to approve a variance to allow the installation of playground equipment in the Main Street front yard because unique property conditions of a lot (s) with no rear yard makes strict compliance with the zoning code difficult. There is no harm to the public interest. The approval included the following conditions: 1. Submit the revised playground location to Inspections. 2. Provide landscaping/screening along Main Street within one (1) year of installation of the playground equipment. 3. Variance approval of 2025-11 is no longer valid and is replaced with Variance 2025-15. No playground may be constructed within the front yard of Mihill Avenue. ROLL CALL VOTE: Aye– Snyder, Uitenbroek, Vanden Avond Nay– None Carried. 147 Sheboygan Street (DJ AMB LLC) Appeal No. 2025-16 Zoning Code Regulations: Chapter 720, Section 11, (C)(13)(d) (2) states the Maximum size: 850 square feet or cover a ground area not greater than the footprint of the dwelling, whichever is less. Building size shall not exceed the sum of the allowable garage area of 720 square feet plus the area of a garden/storage shed as set forth in Subsection C(21)(b), and provided no other accessory building described in Subsection C(21) is sited on the property. Chapter 720, Section 11 (C)(13)(d)(3) states the maximum building height is 15 ft. Chapter 720, Section 11 (C)(13)(d)(7) states the width of a detached garage shall not exceed more than 50% of the lot width. Proposal: Allow construction of a detached garage that is approximately 864 sq ft. Allow the construction of a detached garage that is 16 ft in height. Allow for the construction of a detached garage that is 60% of the lot width. Spoke in Support: Doug Duitman, Applicant, 1229 Primrose Lane Motion made by Misty Snyder to approve an accessory structure 864 sq ft in size; 16 ft in height and 60% of the lot width based on findings referenced herein, and specifically because the property is located within the East Division/Sheboygan Street Historic District and the size of the principal structure would support a larger garage in proportion to the larger principal structure on an older lot of record makes strict compliance with the zoning code difficult. There is no harm to the public interest. Seconded by Jeffrey Uitenbroek. ROLL CALL VOTE: AYE– Snyder, Uitenbroek, Vanden Avond Nay- None Carried. ADJOURN A Motion was made by Misty Snyder to adjourn at 3:20 p.m. and seconded by Jeffrey Uitenbroek and the motion was Passed.
