CALL TO ORDER The September 6, 2023 meeting of the Police Pension Board was called to order by President Monson at 4:30 at the Glen Ellyn Civic Center, Galligan Board Room and went directly into the Public Hearing on application for Disability Pension Benefits of Thomas Hartzell (see transcribed record for details). B. PUBLIC COMMENT – None C. APPROVAL OF MINUTES FROM MARCH 2, 2021 EXECUTIVE SESSION MOTION TO APPROVE MINUTES FROM MARCH 2, 2021 POLICE PENSION BOARD EXECUTIVE SESSION MOTION BY: John Adduci, Trustee SECONDED BY: James King, Trustee RESULT: UNANIMOUS APPROVAL AYES: Terranova, Monson, Adduci, Housey, King Police Pension 2 September 6, 2023 D. Approval of Membership/Withdrawals from Fund 1. Motion to approve Tom Roman refund and pension re-calculation. Attorney Reimer states Attorney Brian LaBardi submitted a memo to the Police Pension Board on August 21, 2023 regarding the refund and recalculation. The Police Pension Board reviews the memo. Trustee Terranova moves to authorize Lauterbach & Amen to conduct the financial review as outlined in the memo. This review will be coordinated with attorney Brian Labardi, who will work with the Pension Board President to ensure the accuracy of the payments and the clawback. Trustee King seconds the motion. MOTION TO AUTHORIZE LAUTERBACH & AMEN TO CONDUCT THE FINANCIAL REVIEW AS OUTLINED IN THE MEMO. THIS REVIEW WILL BE COORDINATED WITH ATTORNEY BRIAN LABARDI, WHO WILL WORK WITH THE BOARD PRESIDENT TO ENSURE THE ACCURACY OF THE PAYMENTS AND THE CLAWBACK. Public Hearing on application for Disability Pension Benefits of Thomas Hartzell – (See transcribed record for details). F. Motion to Adjourn to closed executive session for the purpose of considering the evidence produced at the public hearing, provided that a written decision setting forth the Police Pension Board’s determinative reasoning is issued thereafter pursuant to 5 ILCS 120/2 © (4). Trustee Adduci motions to adjourn to closed executive session and Trustee Terranova seconds the motion. The closed executive session adjourned at 9:10 p.m. for purposes of deliberation. (see transcribed record for closed session) MOTION TO ADJOURN TO CLOSED EXECUTIVE SESSION FOR THE PURPOSE OF CONSIDERING THE EVIDENCE PRODUCED AT THE PUBLIC HEARING, PROVIDED THAT A WRITTEN DECISION SETTING FORTH THE POLICE PENSION BOARD’S DETERMINATIVE REASONING IS ISSUED THEREAFTER PURSUANT TO 5 ILCS 120/2 © (4). Return to Open Session for Vote on Decision – Trustee Housey motions to return to open session and Trustee Terranova seconds the motion. The open session resumed at 10:35 p.m. Motion to award a Non-Duty Disability Pension to Thomas Hartzell. Trustee Terranova motions to award a non-duty disability pension to Thomas Hartzell that would be effective retro to June 10, 2022; Trustee Housey seconds the motion. MOTION TO AWARD A NON-DUTY DISABILITY PENSION TO THOMAS HARTZELL THAT WOULD BE EFFECTIVE RETRO TO JUNE 10, 2022. MOTION BY: Anthony Terranova, Trustee SECONDED BY: William Housey, Trustee RESULT: UNANIMOUS APPROVAL AYES: Housey, Terranova, Monson, Adduci, King Motion to deny the Line of Duty Disability claim to Thomas Hartzell. Trustee King motions to deny the line of duty disability claim to Thomas Hartzell; Trustee Terranova seconds the motion. MOTION TO DENY THE LINE OF DUTY DISABILITY CLAIM TO THOMAS HARTZELL MOTION BY: James King, Trustee SECONDED BY: Anthony Terranova, Trustee RESULT: APPROVAL 4-1 AYES: Housey, Terranova, Monson, King NAYS: Adduci H. ADJOURNMENT – Trustee Monson moves and Trustee Adduci seconds to adjourn the meeting.
