I. CALL TO ORDER
Mayor Habib called the meeting to order at 5:30 pm.
II. BUSINESS ITEM(S)
a. A RESOLUTION APPROVING AN ANNUAL ASSESSMENT REPORT AND AN UPDATED ASSESSMENT
ROLL FOR THE CARNES CROSSROADS IMPROVEMENT DISTRICT AND CONFIRMING THE
COLLECTION OF ASSESSMENTS THEREIN FOR THE 2025-2026 ASSESSMENT YEAR

Mr. Thad Wilson of Water Street Public Finance, the City’s assessment consultant for the Carnes
Crossroads district, provided City Council with a thorough briefing of the Annual Assessment
Report and the Assessment Roll for Carnes Crossroads. There were no questions.
b. DISCUSSION REGARDING THE PROPOSED TECHNOLOGY FEE ON NEW CONSTRUCTION AND
INCREASING THE EXPRESS BUSINESS LICENSE FEE
Mr. Tyler Howanyk thoroughly briefed City Council on the proposed Technology Fee for new
construction, which will help to subsidize the licensing and permitting software, to include the
proposed increase for the Express Business License Fee from $500 to $750, which has not been
adjusted since the early 2000’s. He stated based on the 2024 statistics on the number of
residential permits that were processed, it will bring in approximately $147,000 in revenue and
this would help pay for another building inspector. If approved, it would be included in the Master
Fee Schedule through a Resolution at the August City Council Meeting and also incorporated in the
proposed Fiscal Year Budget for 2025. Mayor Habib stated the City has essentially eaten the costs
for the necessary software and he has no problem increasing the fees. All of City Council’s
questions were answered.

c. DISCUSSION REGARDING POLICY FOR PUBLIC ACCESS TO VIDEO AND AUDIO RECORDINGS ON
MUNICIPALITY PROPERTY
Mr. Tyler Howanyk reminded City Council of the discussion City staff had with them many months
ago concerning a proposed policy for public access to video and audio recordings on municipal
property. He stated the proposed policy has been streamlined and tailored to where video and
audio recordings can take place and it defines and limits access areas, to include protecting the
privacy of residents/customers performing transactions and business with the City. Mr. Howanyk
and Mrs. Zeigler thoroughly answered all of City Council’s questions and stated it would go before
City Council through a Resolution at the August City Council Meeting.
d. DISCUSSION REGARDING TITLE XV: LAND USAGE, CHAPTER 151: ZONING, SECTION 4.2: TABLE
OF PERMITTED USES REGARDING DRIVE-THROUGH FACILITY
Mrs. Kendra Wise thoroughly reviewed and briefed City Council concerning the proposed changes
to Title XV: Land Usage, Chapter 151: Zoning, Section 4.2: Table of Permitted Uses Regarding
Drive-Through Facility. She reminded City Council they passed the Zoning Code Ordinance change
in 2024 and it continues to be a work in progress. She stated one of the items city staff wished to
discuss with City Council had to do with the Village Node Zoning District. She stated that district
focuses specifically on pedestrian oriented commercial development; however, the City might not
be as pedestrian friendly as we hope to be in the future and at present, the zoning for Village Node
does not permit pedestrian friendly drive-through facilities within the Village Node District. She
stated they are currently conditionally permitted through specific zoning standards. Mrs. Wise
reviewed the standards with City Council of drive-throughs throughout the City. Mrs. Wise, Mrs.
Zeigler and Mr. Cook thoroughly answered all of City Council’s questions. Mayor Habib
recommended city staff place it on a future workshop agenda to be discussed again with the
recommended changes.
e. DISSCUSSION OF ANNEXATION OF TMS# 244-01-04-023 ON LINDY CREEK ROAD
Mrs. Alexis Kiser stated there was a zoning error found on the proposed Annexation Ordinance that
went before City Council at their regular meeting in July; therefore, it would need to go back
through the process to bring it before City Council at their meeting in August. She stated the
proposed annexation will be Residential Single Family zoning. All of City Council’s questions were
thoroughly answered.
