expenditures in connection with the project Structural Repairs at LaGrave
Fire Station.
2. It is necessary to supplement the project budget for Structural Repairs at
LaGrave Fire Station by transferring previously approved, budget amounts
of $334,863.00 from Capital Improvement Fund Project accounts; therefore
RESOLVED:
1. That the aforesaid Budget Substitution in the amount of $334,863.00 for
Structural Repairs at LaGrave Fire Station be approved and the Budget
Office is authorized to execute the transfer on behalf of the City.

WHEREAS, the Fiscal Committee has considered the attached bids;
therefore
RESOLVED that contracts be prepared between the City and the
following vendors, and that the Mayor be authorized to sign the contracts on
behalf of the City, as follows, in a form to be approved by the City Attorney:
1. Dewpoint
Contract increase for IT as a Service (ITaaS) provisions for the Technology
and Change Management Department from Dewpoint for an annual costs
per Fiscal Year as follows:
FY2023 (July 1, 2022 through June 30, 2023): $4,169,945.00
FY2024 (July 1, 2023 through June 30, 2024): $4,473,761.00
FY2025 (July 1, 2024 through June 30, 2025): $4,405,456.00
FY2026 (July 1, 2025 through June 30, 2026): $4,549,270.00
2. Bolle Contracting
One-year term contract with two, one-year renewal options for “as-needed”
demolition and asbestos removal services for Code Compliance and the
Fire Department from Bolle Contracting for an annual “not-to-exceed”
amount of $60,000.00; the estimated three-year total amount is
$180,000.00.
3. US Golf Cars, Inc.
60-month lease of fifty-four (54) electric golf carts, four (4) turf maintenance
vehicles, and one (1) utility vehicle for the Indian Trails Golf Course from
US Golf Cars, Inc. for an annual “not-to-exceed” amount of $78,000.00,
with a total estimated 60-month total lease cost of $390,000.00.

4. Advanta Health Solutions
One-year term contract with two, one-year renewal options for a wellness
application/solution for the Human Resources Department from Advanta
Health Solutions for a “not-to-exceed” amount of $38,590.00; the estimated
three-year total amount is $115,770.00.
5. O2X Human Performance
Comprehensive and performance training services for the Police
Department from O2X Human Performance for the “not-to-exceed” amount
of $120,000.00.
6. Republic Services
Contract extension for a one-year term with one, one-year renewal option,
at updated unit costs, for the hauling and disposal of non-hazardous waste
residuals for the Environmental Services Department from Republic
Services for the annual “not-to-exceed” amount of $275,000.00; the
estimated two-year total amount is $550,000.00.
7. Traffic and Safety Control Systems
Cooperative purchase through the State of Michigan MiDEAL Contract
#20000000720 for a one-year term contract with two, one-year renewal
options for “as-needed” TIBA parking access and revenue control (PARC)
equipment and installation services for Mobile GR and Parking Services
Department from Traffic and Safety Control Systems for the annual “not-to-
exceed” amount of $700,000.00.
D. COMMUNITY DEVELOPMENT COMMITTEE

WHEREAS:
1. Full of Green Gold Condo Association has requested approval to encroach
into the Fulton Street and Lexington Avenue rights-of-way for purposes of
constructing and maintaining a snowmelt system (the "encroachment")
adjacent to the condominium building located at 621, 623, 625 and 627
Fulton Street W; and
2. Full of Green Gold Condo Association is willing to enter into an agreement
with the City which outlines the conditions under which the City will permit
the aforesaid encroachment; and
3. Full of Green Gold Condo Association agrees to pay all costs associated
with the aforesaid encroachment and snowmelt system; therefore

RESOLVED:
1. That the City of Grand Rapids hereby approves an Encroachment
Agreement with Full of Green Gold Condo Association that consents, with
conditions, to the construction of a snowmelt system in the Fulton Street
and Lexington Avenue rights-of-way, with the understanding that all costs
associated with the aforesaid Encroachment Agreement will be borne by
Full of Green Gold Condo Association; and
2. That the Mayor is hereby authorized to execute the aforesaid
Encroachment Agreement on behalf of the City, contingent upon approval
as to form by the City Attorney; and
3. That the City Clerk is hereby authorized and directed to record the
aforesaid Encroachment Agreement with the Kent County Register of
Deeds.

WHEREAS, bids were received on December 13, 2022, for the
following project:
Roof Replacement at Garfield Park
(hereinafter referred to as the “Project”)
and Ostrander Windows, Siding and Roofing, Inc. (Ostrander) submitted a bid
of $290,700 for which the engineer’s estimate, prepared by DLZ Michigan, Inc.
(DLZ) is $352,000; therefore
RESOLVED:
1. That the bid of Ostrander be accepted and that, upon approval as to form by
the City Attorney, the Mayor and City Clerk be authorized to execute the
contract documents for the Project on behalf of the City.
2. That total expenditures for the Project be authorized in an amount not to
exceed $374,750 which includes the costs of the construction contract,
previously authorized design phase services by DLZ, construction phase
services including inspection by DLZ, engineering/inspection/administration,
and contingencies. Said amount of $374,750 to be charged to the applicable
Parks Millage Fund codes.

3. That the City Comptroller is hereby authorized and directed to make
payment, in amounts and to said payees, as the City Engineer or his
designee requests in connection with the Project.

WHEREAS, it is necessary to approve a Construction Agreement and
accept a Warranty Deed and dedicate public right-of-way for the construction of
public storm sewer facilities and improvements in connection with
Improvements in Grove Place (Lofts on Grove); therefore
RESOLVED:
1. That the aforesaid Construction Agreement between the City of Grand
Rapids, and Lofts on Grove Holdings, LLC (Developer) be approved and
that, upon approval as to form by the City Attorney, the Mayor and City
Clerk be authorized to execute said Agreement on behalf of the City; and
2. That the City accept a Warranty Deed for the construction and maintenance
of public utilities from the following property owner, for the nominal
considerations as noted, which were paid by the developer:
Lofts on Grove Holdings, LLC $1.00

Grand Rapids, MI 49512
A. That the above-described property be and is hereby
dedicated to street and highway purposes.
B. That, subject to the supervision and control of the City
Manager, the Director of Public Service shall manage and
have charge of the above-described property in accordance
with Title VI, Section 9, of the Charter of the City of Grand
Rapids.
C. That the City Engineer and other affected City officials and
departments are hereby directed to designate and delineate
said property on the official maps and records of the City as
public right-of-way to be known as Hastings Street for the
use and benefit of the public at large.
D. That the City Clerk be authorized and directed to notify the
State Treasurer of the State of Michigan of the dedication of
the aforesaid property by the City of Grand Rapids as public
right-of-way.

3. That the City Clerk is hereby authorized and directed to record the aforesaid
Warranty Deed with the Kent County Register of Deeds.

WHEREAS:
1. On April 12, 2022 (Proceeding No. 91589), the City awarded a contract to
Davis Construction, Inc. (Davis) for the following project:
Improvements to Pumps at Franklin Water Pump Station
(hereinafter referred to as the “Project”); and
2. As of January 2023, the Grand Rapids division of Davis is demerging and it
is necessary to reassign the contract to RK Davis, Inc. (RK Davis); therefore
RESOLVED:
1. That upon approval as to form by the City Attorney, the Mayor and City Clerk
be authorized to execute the Consent to Assignment of Contract to RK
Davis.
2. That the City Engineer or his designee is hereby authorized to execute the
necessary change order to the aforesaid contract with Davis.
3. That the City Comptroller is hereby authorized and directed to make
payment, in amounts and to said payees, as the City Engineer or his
designee requests in connection with the Project.

WHEREAS, bids were received on December 13, 2022 for the
following project:
Replacement of Kingsbury Sanitary Lift Station
(hereinafter referred to as the “Project”)
and Kamminga & Roodvoets (K&R) submitted a bid of $1,926,262 for which the
engineer’s estimate, prepared by Progressive AE, Inc. (PAE), is $1,631,531;
therefore
RESOLVED:

1. That the bid of K&R be accepted and that, upon approval as to form by the
City Attorney, the Mayor and City Clerk be authorized to execute the
contract documents for the Project on behalf of the City.
2. That total expenditures for the Project be authorized in an amount “not-to-
exceed” $2,538,400 which includes the costs of the construction contract,
previously authorized design phase services by PAE, construction phase
services including inspection by PAE, Consumers Energy overhead electric,
easement acquisition, previously authorized geotechnical services by
Materials Testing Consultants, Inc., administration, and contingencies. Said
amount of $2,538,400 to be charged to the applicable Sewer System Fund
codes.
3. That the City Comptroller is hereby authorized and directed to make
payment, in amounts and to said payees, as the City Engineer or his
designee requests in connection with the Project.
4. That the City of Grand Rapids, pursuant to Section 1.150-2 of the Treasury
Regulations promulgated pursuant to the Internal Revenue Code of 1986,
as amended, declares its intent to reimburse itself the costs of the Project
and other related costs in an amount not to exceed $2,538,400 (Sewer
System Fund) through the issuance of tax-exempt bonds.
5. That a copy of this resolution be available for inspection at the City Clerk’s
Office, 2nd Floor, City Hall, 300 Monroe Avenue N.W., Grand Rapids,
Michigan 49503.

WHEREAS:
1. On May 23, 2017 (Proceeding No. 86766) the City Commission approved a
consent resolution for the vacation of VanderVeen Court from 235 feet West
of Eastern Avenue to Eastern Avenue that was that was approved by the
Kent County Circuit Court on December 11, 2017, and recorded in
Instrument No. 201712150105032, Kent County Register of Deeds. An
amended plat was completed in connection with the aforesaid vacation that
is recorded in Instrument No. 201802160012294, Kent County Register of
Deeds; and
2. The City's consent resolution, the court judgment and the amended plat all
preserved a utility easement that has been abandoned by the City. The
easements can be released and the property owner will be responsible for
any remaining utilities; therefore

RESOLVED:
1. That a Release of Easements is hereby approved to the following property
owner and/or its successor(s) in interest, for the easements recorded in
Instrument No. 201712150105032 and Instrument No. 201802160012294,
Kent County Register of Deeds for nominal consideration of One Dollar
($1.00):

E. COMMITTEE OF THE WHOLE

RESOLVED:
1. That the attached ordinance amending sections of Article 2,Chapter 7, Title
I of the Grand Rapids City Code, being the Police and Fire Retirement
System, be published as part of the proceedings; and
2. That pursuant to Section 10(b) of the Title V of the City Charter, the City
Clerk shall publish the attached summary of said ordinance in a newspaper
of general circulation in the City; and
3. That the proposed ordinance shall subsequently be considered of adoption
on January 24, 2023.
AN ORDINANCE AMENDING SECTIONS 1.242 AND 1.258 OF “POLICE
AND FIRE RETIREMENT SYSTEM”, BEING ARTICLE 2, CHAPTER 7,
TITLE I OF THE GRAND RAPIDS CITY CODE
ORDINANCE NO. 2023 - __

THE PEOPLE OF THE CITY OF GRAND RAPIDS DO ORDAIN:
Section 1. That Section 1.242(3) of Article 2, Chapter 7, Title I of the
Code of the City of Grand Rapids be amended to read as follows:
“(3) Allowance payments shall be suspended for any retirant who is
employed by the employer for more than seven hundred (700) hours in
a calendar year. Allowance payments shall be suspended immediately
upon attainment of seven hundred (700) hours worked and shall
remain suspended for the duration of that calendar year that the
retirant continues to work for the employer. Any such retirant so
employed shall not become a member of the system or gain any
credited service or other allowance enhancements as a result of time
worked after retirement. The employer shall notify the Retirement
Systems of the employment of a retirant and upon the completion of
seven hundred (700) hours worked by that retirant. Effective July 1,
2022, the limit for retirees of the Grand Rapids Police Officers
Association Officer & Sergeant Unit shall be one thousand forty (1,040)
hours per calendar year.”
Section 2. That Sections 1.258(4)(a) and 1.258(4)(b) of Article 2,
Chapter 7, Title 1 of the Code of the City of Grand Rapids be amended to read
as follows:
“(a) Firefighter Members. Member contribution rates for Firefighters
hired prior to January 10, 2012 shall be payable in accordance with
the following table. Determination of the rate to be paid shall be
based upon the prior December 31 valuation date, and any change in
member contribution rates shall be for the next ensuing employer
fiscal year following the determination.

During the period of July 1, 2009 through June 30, 2011 the member
contribution rate for Police Officers & Sergeants shall be 4.00%, regardless of
the annual actuarial valuation results. During the period of July 1, 2011 through
January 7, 2012 the member contribution rate for Police Officers & Sergeants
shall be 4.66%, regardless of the annual actuarial valuation results. During the
period of January 8, 2012 through June 30, 2013 the member contribution rate
for Police Officers & Sergeants shall be 5.86%, regardless of the annual
actuarial valuation results.
After June 30, 2013, should the System funding level, as determined by the
System actuary, be 120% or greater, the member contribution rate for Police
Officers & Sergeants shall be 5.86% for one full fiscal year following such
determination. Effective the subsequent fiscal year (i.e., after a delay of one [1]
fiscal year from the time the funding level is determined to be 120% or above
and the member contribution rate for Police Officers & Sergeants has been
5.86% for that one [1] year period) and each fiscal year thereafter the member
contribution percentage for Police Officers & Sergeants shall be determined
based on the prior December 31 valuation date and effective for the next
ensuing employer fiscal year.
Member contribution rates for Police Officers & Sergeants hired on or after
December 20, 2011 shall be payable in accordance with the following table.

OF CERTAIN EMPLOYEES IN THE CITY OF GRAND RAPIDS CLASSIFIED
IN CLASS TITLES WHICH ARE WITHIN THE UNIFORMED EMPLOYEE
BARGAINING UNIT; TO ADOPT A SCHEDULE OF ANNUAL PAY RANGES
FOR SUCH EMPLOYEES: TO PROVIDE FOR THE ADOPTION OF RULES
PRESCRIBING THE METHOD OF PROVIDING FOR INCREASES AND
DECREASES IN COMPENSATION WITHIN THE PAY RANGES
ESTABLISHED BY THIS ORDINANCE; TO PROVIDE FOR THE
REGULATION OF OTHER PERSONNEL MATTERS AND TO REPEAL ALL
ORDINANCES IN CONFLICT HEREWITH, SAID REPEAL TO BECOME

THE PEOPLE OF THE CITY OF GRAND RAPIDS DO ORDAIN:
Section 1 There is hereby established the following schedule of annual
and hourly pay ranges which shall be the basis for establishing the rates of
compensation for all employees in the classes of positions described in Section
1.1, 1.2 and 1.3 inclusive, and which shall be effective July 1, 2022.
Section 1.1 Effective July 1, 2022, the following classifications shall be

Each of the foregoing salary ranges shall consist of a minimum rate, which is
the lowest amount in the columns opposite the range number; a maximum rate,
which is the highest amount in the columns opposite the range number; and

Section 2. No employee shall be paid at a rate lower than the
minimum or higher than the maximum rate of compensation in the salary range
established by Sections 1.1, 1.2 and 1.3 for the class to which their position
has been allocated, provided that any employee who upon the adoption of this
Ordinance is receiving a rate of compensation higher than the maximum rate
herein established for their position shall receive the rate of compensation now
in effect and subsequent generally applied increases.

Adopt To accept or approve; i.e., an ordinance, a resolution, a motion, etc.

Call to Order Formal opening of a meeting.
City Charter Legal document establishing a municipality (city).
City Commission Local form of government consisting of the Mayor and six Commissioners.
City Officers Includes: Mayor, President of the City Commission, City Manager, City Attorney,
City Treasurer, and City Clerk.
Consent Agenda Matters listed as Consent Agenda items are considered to be routine or matters
of unanimous consent by the City Commission. There will be no separate
discussion of these matters, and they will be enacted by one motion.
Executive Session A meeting in which the proceedings are of a confidential nature. Only members
and invited guests may attend, and all are honor-bound to maintain
confidentiality.
Motion A proposal that the Commissioners take a specific action or stand on an item
being presented to the City Commission.
Ordinance A piece of legislation enacted by a municipal authority.
Postpone A motion to postpone is made if the City Commission needs more time to make

Quorum Number of voting members who must be present in order that business can be

Rescind (Repeal) Allows the City Commission to repeal an action previously taken; i.e.,

Suspend the Rules This motion is used when the City Commission wants to do something that
violates its own rules. The motion does not apply to an organization’s bylaws,
local, state, or national law; or fundamental principles of parlia-mentary law. An
appropriate suspension of the rules, used on occasion by the City Commission,
would be a motion to change the agenda.
Table, Lay on the This motion puts aside an item, and everything adhering to it, currently being
presented to the City Commission. The item remains “on the table” until taken
off.
Table, Take (Remove) from the The motion to Take from the Table is used when the City Commission wants to
continue considering a motion that was Laid on the Table earlier in the present
session or in the previous session of the City Commission. When a motion is
Taken from the Table, it has everything adhering to it exactly as it was when it
was Laid on the Table.
