Consideration with possible action on request by Department of Public Works to accept a grant from the
Fund for Lake Michigan (FFLM) in the amount of $150,000.00 for the implementation of “East River Emilie
Park Wetland Restoration for Flood Resiliency” project.
BACKGROUND
The City of Green Bay applied for grant funding from the Fund for Lake Michigan to begin construction of an
11-acre urban wetland within East River Emilie Park. This project will restore historic wetland functions,
reduce flood risks, improve water quality, and enhance wildlife habitat, while offering educational and
recreational opportunities for the community. This is a three-year grant, which coincides with the project
timeline. Additional sources of funding have been secured, and some are pending.
RECOMMENDATION
Staff recommends the I&S Committee accept this grant award.
FISCAL IMPACT
Grant Payment schedule: $100,000 on 9/1/2025; $25,000 on 6/15/2026; and $25,000 on 9/30/2028.

Special Provisions
All grants are made in accordance with current and applicable laws and pursuant to the Internal
Revenue Code, as amended, and the regulations issued thereunder.
Please read the following carefully:
I. EXPENDITURE OF FUNDS
This grant is to be used only for the purpose described in the grant application and in
accordance with the approved budget. The program is subject to modification only with
prior written approval from the Fund and the Foundation.
A. The grantee shall return to the Foundation any unexpended funds:
1. if the Fund or Foundation determines that the grantee has not performed in
accordance with this agreement and approved program/budget,
2. if the grantee loses its exempt "public charity" status under Section 501(c)(3) of the
Internal Revenue Code, or
3. if the grant period has ended.
B. No funds provided by the Foundation may be used for any political campaign, legislation,
candidates, or office holders, or to support attempts to influence legislation or public
policy positions by any government body, other than through making available the results
of nonpartisan analysis, study, and research. Grantees may be required to note in
presentations or printed publications resulting from the grant that such conclusions do
not reflect the position of the Fund for Lake Michigan or the Greater Milwaukee
Foundation.
C. Unless specifically authorized by the Foundation, expenses charged against this grant may
not be incurred prior to the effective date of the grant or subsequent to the termination
date, and may be incurred only as necessary to carry out the purposes and activities of
the approved program.
D. The grantee organization is responsible for the expenditure of the funds and for
maintaining adequate supporting records consistent with generally accepted accounting
practices.
E. Private entities receiving funds from the Fund must solicit competitive bids for all
contracts and other expenses estimated to be over $50,000. Public entities receiving
funds from the Fund must follow their own procurement laws and policies.

II. SIGNAGE AND PUBLICITY
A. The grantee will include the Fund’s logo and denote the Fund as a supporter of the
project on printed materials, event announcements, the grantees or project’s website,
and other media.
B. When applicable, Fund staff will be included in major press announcements involving
the project described in the proposal, such as groundbreakings, ribbon cuttings, and
award ceremonies.
C. The grantee is encouraged to acknowledge the Fund’s support on social media and to
follow the Fund for Lake Michigan on Twitter, Facebook, and LinkedIn.
D. The grantee will periodically share other photos, video clips, news articles, and other
outreach materials that show the impact of the Fund’s grant. These materials can be
sent directly to Fund staff.
E. The grantee will, when asked, report on efforts to recognize the Fund for its support.
III. OPERATIONS AND MAINTENANCE
For all on-the ground restoration and infrastructure projects, the grantee will maintain
the project for at least five years. If the Project fails to perform as anticipated, or if
maintaining the Project is not feasible, then the grantee will provide a report to the Fund
explaining the failure of the Project or why maintenance is not feasible. Failure to
maintain the Project may make the grantee ineligible for future Fund for Lake Michigan
funding, until the grantee corrects the maintenance problems.
IV. REPORTING REQUIREMENTS
Reports will be submitted according to the following schedule:

Consideration with possible action on request by Department of Public Works to renew the annual
cooperative recycling agreement with Brown County for 2026.
BACKGROUND
Brown County serves as the coordinating Responsible Unit for recycling activity on behalf of multiple
municipalities within the County. An intergovernmental cooperative recycling agreement has been in place
for over 20 years. To allow for Green Bay to continue with the cooperative agreement, DPW must annually
renew the agreement with Brown County. This agreement has been mutually beneficial to Brown County
and the City of Green Bay, and the County is a good partner. It is in the City’s best interest to continue the
agreement.
RECOMMENDATION
Deparment of Public Works Operations recommends that the City of Green Bay renew the annual
cooperative recycling agreement with Brown County for 2026.
FISCAL IMPACT
There is no fiscal impact to the City if the agreement is continued. However, if the agreement is not
continued, there could be fiscal impact associated with the City needing to find an alternative vendor for
proper processing and disposal of recyclable material.

Intergovernmental Cooperative Agreement to Satisfy Eligibility for the Wisconsin Recycling Consolidation
Grant for Calendar Year 2026
This agreement is made by and between the Cities of De Pere and Green Bay, the Villages of Allouez,
Ashwaubenon, Bellevue, Denmark, Hobart, Howard, Pulaski, Suamico, Wrightstown, and the Towns of Eaton,
Glenmore, Green Bay, Holland, Humboldt, Lawrence, Ledgeview, Morrison, New Denmark, Pittsfield, Rockland,
Scott and Wrightstown, each of which is a municipal corporation, and the Oneida Nation, a federally recognized
Indian tribe, all of which are a Responsible Units as defined in Section 287.01(9) of the Wisconsin Statutes
(collectively referred to as the “Responsible Units” or “RUs”) for purposes of implementing efficiencies related to
operating an effective recycling program in accordance with ss. 287.11 and 287.24, Wis. Stats., and ch. NR 542,
Wis. Admin. Code. This agreement is intended to qualify for the 2026 Wisconsin Recycling Consolidation Grant.
WHEREAS the RUs believe that, by working together in this cooperative agreement, they can more effectively
and efficiently provide for the recycling education needs of their citizens; and
WHEREAS the RUs desire to collaborate in an effort to educate about recycling; and
WHEREAS the RUs recognize the importance of educating residents about recycling and their RU responsibility to
do so; and
WHEREAS Brown County partnered with Outagamie and Winnebago Counties, collectively known as Tri-
County Recycling, to fund, host, and promote the Tri-County Recycling Guide; and The ABC's of Recycling Right
book and:
WHEREAS Tri-County Recycling will continue to fund, host, and promote the smartphone recycling app
Betterbin; and
WHEREAS Tri-County Recycling will continue to fund, host, and promote the Waste Wizard Material Search
Engine tool; and
WHEREAS the Tri-County Recycling Guide, the Betterbin smartphone app, and the Waste Wizard Material
Search Engine provide comprehensive information on single-stream recycling guidelines, recycling plastic bags,
proper medical sharps disposal, electronics recycling, universal waste recycling, household hazardous waste
programs, pharmaceutical drop boxes and waste reduction tips; and
WHEREAS Section 66.0301(2) of the Wisconsin Statutes authorizes cooperation between municipalities and
between municipalities and Indian tribes, and allows municipalities to contract with each other and with Indian
tribes for the receipt or furnishing of services or the joint exercise of any power or duty required or authorized by
law; and
WHEREAS each participating RU will maintain a copy of the other above listed RUs' cooperative agreements on
file, given that not all cooperating RUs will be able to sign a single document;
NOW THEREFORE IT IS AGREED THAT the above listed RUs have and will continue to make available to its
residents the Tri-County Recycling Guide, The ABC's of Recycling Right, the Tri-County Recycling Betterbin
smartphone app and Waste Wizard Material Search Engine (https://recyclemoretricounty.org/waste-wizard/),
recognizing additional and consistent education will reduce contamination and improve recycling, thereby
enabling the processing and marketing of these recyclables in the most efficient and cost-effective manner

promptly and ensure completion in time for sledding operations this fall. Bid results will be provided at the

Award of the contract to Peters Concrete Company in the amount of $137,250.90.
FISCAL IMPACT
RPA funds in the amount of $102,922.00 are allocated for this project. The remaining balance of $34,328.90

Report the expenditures for emergency storm sewer repairs at the East River and Webster Avenue.
BACKGROUND
The City maintains two emergency sewer repair contracts for emergency storm and sanitary sewer repairs
throughout the year. A storm sewer at the East River and Webster Avenue and adjacent to a building
structure had failed requiring emergency repair. The repair required replacement of the storm sewer
outfall, which required the placement of a coffer dam within the East River. Repairs under the emergency
sewer repair contract typically do not exceed $50,000; however, due to the placement of the coffer dam and
the difficulties making the repair adjacent to the structure, the total cost of this repair was $94,904.12.
RECOMMENDATION
FISCAL IMPACT
$94,904.12 which is budgeted for under the Stormwater Utility budget.

Brush collection is on-going and rack cards (brochures) have been developed and shared on social media
promoting the program.
Bulk Waste Collection will occur September 22 – 26, 2025.
Leaf collection will begin on Monday, October 13, 2025.
