As substituted:
1. The changes suggested by the Auditors are incorporated.
2. The RADR team duties are narrowed to encompass only the Mandatory Compliance
elements (fencing, signs and landscape buffers), rather than RADR being the reviewer
for all site permit applications within the Renew Arlington Zoning Overlay area.
3. Allows the RADR team to, in their discretion, slightly enlarge their scope of review to
encompass other issues related to the site design and the Mandatory Compliance
element. This would avoid the duplicative process of RADR review and conventional
10-set civil plan review for small additional items.
4. Clarifies that the RADR team will give a “preliminary review” of the schematic
designs at which point a determination will be made of whether the design will (a)
require an Administrative Deviation (“AD”); (b) require conventional 10-set review due
to complexity of the site (i.e. change in drainage) or (c) be approved for advancement to
construction drawings.
5. If the design requires an AD, the RADR team will write a report for consideration by
the Zoning Administrator. If the RADR team’s scope of review was slightly enlarged to
encompass another issue, the RADR report to the Zoning Administrator will include this
extra issue.
6. At the point that construction documents are ready for review, the RADR team will
provide the “final review.”
7. Clarifies that an appeal of the AD’s decision must be accompanied by the filing fee
and the cost of letter notification to property owners within 350 feet.
8. Clarifies that in an appeal of the AD’s decision the appellate procedure in Sec.
656.142 (the appellate procedure followed when a decision of the Planning Commission
is appealed to Council).
9. Adds provision that if the appeal is successful at either the City Council level, or the
Court, the filing fee and cost of notification are to be returned to the appellant by the
agency or division collecting the fees. At City Council level, currently this is Legislative
Services.
