City of Joliet 150 West Jefferson Street Joliet, IL 60432 Meeting Minutes - Final Wednesday, February 3, 2021 4:00 PM City Hall, Council Chambers Land Use & Legislative Committee Committee Members Herb Lande Terry Morris Jan Hallums Quillman Land Use & Legislative Committee Meeting Minutes - Final February 3, 2021 Page 1 of 1 Land Use & Legislative Committee Meeting Minutes - Final February 3, 2021 The Governor’s Office and the Illinois Department of Public Health has activated a Tier 1 mitigation plan for Region 7 (Will and Kankakee Counties). Tier 1 limits in-person meetings to 25 people or 25% of overall room capacity (whichever is less). Council Chambers allows for 10 members of the public while adhering to social distancing guidelines. During meetings, any member of the public physically present in the Council Chambers in excess of the limit will be asked to wait in another room with live feed to the meeting until the Citizens To Be Heard on Agenda Items section or Public Comments section of the meeting has commenced. Speakers will be rotated into Council Chambers to allow everyone an opportunity to speak. Pursuant to the Illinois Department of Commerce & Economic Opportunity’s Guidelines, it is recommended that any individual appearing in-person wear a face-covering to cover their nose and mouth. Citizens who are unable to attend the meeting can email comments in advance of the meeting to publiccomment@joliet.gov. ROLL CALL Present Terry Morris, Jan Hallums Quillman and Herb Lande APPROVAL OF MINUTES A motion was made by Jan Hallums Quillman, seconded by Terry Morris, to approve the October 8, 2020 Minutes. Anyone speaking on an agenda item is entitled to speak for a maximum of 4 minutes. Please note speakers who engage in conduct injurious to the harmony of the Land Use & Legislative Committee shall be called to order by the Presiding Officer and may forfeit the opportunity to speak. Mr. John Marquardt voiced concerns about the Police Review Board pertaining to the power that the board will have as well as the possibilities for bias on the board. Ms. Suzanna Ibarra stated her concerns about the Police Review Board. Chairman Morris stated this is the opportunity for the citizens to speak about the Police Review Board and not the only opportunity. Councilwoman Quillman suggested the topic be tabled since Mr. Regis is absent from the meeting but still get input from the citizens that are present. A citizen appeared regarding the Police Review Board and would like an opportunity to talk about the language in the proposal. HONORARY STREET CHANGE FOR TIMMOTHY D. BAILEY, M.D. Mr. Torri read a report with background information regarding the honorary street change request for Mr. TimmothyD. Bailey, M.D. Ms. Natalie Coleman spoke about her God-Brother, Dr. Bailey. Mr. Coleen P. Bailey, his mother, was also in attendance. A motion was made by Jan Hallums Quillman, seconded by Herb Lande, to approve the Honorary Street Change for Timmothy D. Bailey, M.D. The motion carried by the following vote: Aye: Morris, Hallums Quillman and Lande TMP-0858 Attachments: Grant Avenue - Honorary Street Name - Combined Report PUBLIC ALLEY CLOSURE POLICY Mr. Greg Ruddy, Director of Public Works, appeared on behalf of the public alley closure policy. Councilman Lande asked if it would be a permanent closure to the alley or a temporary closure. Mr. Ruddy responded it could be either. Councilwoman Quillman asked who would take care of the alley. Mr. Ruddy responded. Mr. Torri, Interim Director of Planning, explained the different vacation petitions that go through the Plan Commission process. There was lengthy discussion between the Committee members and Mr. Ruddy about the process. Ms. Sabrina Spano, Corporation Counsel, said the Committee can decide what changes they would like to add to the policy and vote to move it to the full City Council with the revisions. Councilman Morris said that Public Works would speak with the Fire Department and the Police Department at the beginning of the process to determine if they need access to the alley. If they do not, it would be permanently closed. They would be reviewed on a case by case basis. If the neighbors want the alley opened back up or closed, they have to have 75% of the neighbors in agreement. A motion was made by Herb Lande, seconded by Jan Hallums Quillman, to recommend for approval by the full City Council the Public Alley Closure Policy with the requested revisions as discussed. OTTAWA STREET. Mr. Keith Jorstad, Director of Neighborhood Services, gave the Committee background information about the Resolution Authorizing the Conveyance of Neighborhood Stabilization Program (NSP) Property at 201 S. Ottawa Street. Councilwoman Quillman asked if the property was zoned for single-family. Mr. Jorstad responded. A motion was made by Herb Lande, seconded by Jan Hallums Quillman, to recommend for approval by the full City Council the Resolution Authorizing the Conveyance of Neighborhood Stabilization Program (NSP) Property at 201 S. Ottawa Street. The motion carried by the following vote: Aye: Morris, Hallums Quillman and Lande Resolution Authorizing the Conveyance of Neighborhood TMP-0851 Stabilization Program (NSP) Property at 201 S. Ottawa Street Attachments: Resolution Exhibit A 201 S Ottawa St - Appraisal ORDINANCE AMENDING CHAPTER 23 OF THE CODE OF ORDINANCES AND ESTABLISHING ARTICLE IV, PAYMENT IN LIEU OF TAXES (PILOT) PROGRAM, SECTION 23-64, TRUCK PARKING OF JOLIET CODE OF ORDINANCES. Mr. Derek Conley, Economic Development Director, gave the Committee background information about the proposed ordinance pertaining to the PILOT program for truck parking and truck terminals. A motion was made by Jan Hallums Quillman, seconded by Herb Lande, to approve the Ordinance Amending Chapter 23 of the Code of Ordinances and Establishing Article IV, Payment in Lieu of Taxes (PILOT) Program, Section 23-64, Truck Parking of Joliet Code of Ordinances. The motion carried by the following vote: Aye: Morris, Hallums Quillman and Lande TMP-0854 Attachments: Truck Parking PILOT Ordinance Page 3 of 7 Land Use & Legislative Committee Meeting Minutes - Final February 3, 2021 ORDINANCE AMENDING CHAPTER 23 OF THE JOLIET CODE OF ORDINANCES AND ESTABLISHING ARTICLE IV, PAYMENT IN LIEU OF TAXES (PILOT) PROGRAM, SECTION 23-65, TRUCK TERMINAL FACILITIES OF THE JOLIET CODE OF ORDINANCES A motion was made by Jan Hallums Quillman, seconded by Herb Lande, to approve the Ordinance Amending Chapter 23 of the Joliet Code of Ordinances and Establishing Article IV, Payment in Lieu of Taxes (PILOT) Program, Section 23-65, Truck Terminal Facilities of the Joliet Code of Ordinances. The motion carried by the following vote: Aye: Morris, Hallums Quillman and Lande TMP-0855 Attachments: Truck Terminal PILOT Ordinance POLICE DEPARTMENT CITIZEN REVIEW BOARD Ms. Spano, Corporation Counsel, said she spoke with Mr. Regis and he explained that this is a rough draft and the first draft. He was looking for Committee input. Councilman Morris feels it should be discussed with the Committee and the citizens to get input on the rough draft of the review board and then it can be revised and come back for discussion again at a future meeting. Councilman Lande stated there are some points that could be sharpened up, however it is only the first draft. Mr. Marquardt had 2 concerns with potential bias because it is proposed to only have 5 members on the board. He is also concerned with the training with the citizens police academy. He suggested to have another meeting to go through the draft and give input to City Legal and City Council about what can be strengthened. Councilwoman Quillman asked if anyone attended the Citizen's Police Academy so that they could be aware of what the police go through. Mr. Marquardt responded. Councilman Lande said everyone's perspective has to be taken into consideration. He also feels some training might or should be required. Councilwoman Quillman suggested that Mr. Marquardt put in writing what he thinks is wrong as well as new suggestions and submit it to Mr. Regis and the City Council so that it can be discussed further at a future meeting. Mr. Richard Rodriguez asked that citizens are a part of the creation of the board. Ms. Colleen Fran spoke about her frustration over the back and forth conversation that took place today. She feels this is a time for the Committee members to listen to the suggestions from the public and get them back to Mr. Regis. Page 4 of 7 Land Use & Legislative Committee Meeting Minutes - Final February 3, 2021 Ms. Suzanna Ibara, Will County Progressives, said that citizens should be a part of the creation of the board and not be left out. A motion was made by Herb Lande, seconded by Jan Hallums Quillman, to approve the laser sights ordinance. The motion carried by the following vote: Aye: Morris, Hallums Quillman and Lande TMP-0869 Attachments: laser sight.pdf KENNELS Ms. Spano, Corporation Counsel, explained the proposed ordinance changes pertaining to kennels. Mr. Torri stated this is not changing the ordinance it is just moving it from the zoning code to the municipal code. Councilwoman Quillman had concerns because a lot of people are fostering pets now which is different than having a kennel. Ms. Spano said you can modify the number of pets that are allowed if that is the will of the Committee. Councilwoman Quillman suggested that maybe more dogs could be allowed and if it becomes a problem then maybe they can be brought in as a public nuisance. Ms. Faye Cartwright, Forest Park Neighborhood Council, said the unfortunate part about pets is that everyone is not respectful. She likes the ordinance the way it is and said everyone should know if they move into Joliet that the limit is 2 dogs. Page 5 of 7 Land Use & Legislative Committee Meeting Minutes - Final February 3, 2021 Councilman Lande inquired about the need for the change with the ordinance . Mr. Torri explained. Councilwoman Quillman asked if the neighbors would be able to sign off on someone allowing them to have more than 2 dogs. Mr. Torri said Staff would prefer not to get into that situation. Everyone should be treated the same. Councilman Morris suggested maybe the number of dogs should be increased across the board. Mr. Torri responded that even if it is increased, that it be put in the Code of Ordinances. A motion was made by Jan Hallums Quillman, seconded by Herb Lande, to table Kennels to the next meeting so that further information can be obtained from surrounding communities on the number of dogs as well as fostering them. A motion was made by Herb Lande, seconded by Jan Hallums Quillman, to approve the ordinance adding Chapter 26, Article X, Section 26-211, Mailboxes Ordinance of the City of Joliet Code of Ordinances. The motion carried by the following vote: Aye: Morris, Hallums Quillman and Lande TMP-0871 Attachments: mailbox.pdf CITY LAND LEASE AGREEMENT Mr. Derek Conley, Economic Development Director, gave the Committee background information about the city land lease agreement for the property located at Caton Farm Road and I-55 Frontage Road. Mr. B.J. Udelhofen appeared on behalf of the agreement. He stated he would be interested in purchasing the property. A motion was made by Jan Hallums Quillman, seconded by Herb Lande, to recommend for approval by the full City Council the City Land Lease Agreement. She stated the Land Use & Legislative Committee had asked that the real estate agents and the other neighborhood organizations get together to talk things over . They did have a couple of meetings but nothing has happened since. The neighborhood organizations have been inquiring about the single-family rental inspections program and said they want to get it taken care of. Councilwoman Quillman asked that Mr. Torri be brought up to speed on the topic and then bring it to the next Land Use Meeting. Tara Weekly, a high school student, spoke about what goes on in Joliet with the Police Department and the citizens of Joliet. Mr. Jerry Hervey said the purpose of argument and dialogue is to gain compromise and understanding. Ms. Suzanna Ibarra commented about the proposals and seven federal lawsuits on the JPD.
