CALL TO ORDER ROLL CALL Present Ed Hennessy, Bob Nachtrieb, Jim Riggs, Jim Riggs, Pat McShane, Pat McShane and Ralph Bias Absent Vincent Alessio, Vincent Alessio, Brigette Roehr and Brigette Roehr APPROVAL OF MINUTES October 19, 2023 Zoning Board of Appeals Regular Meeting TMP-6612 Minutes Attachments: 10-19-23 ZBA A motion was made by Jim Riggs, seconded by Bob Nachtrieb, to approve the October 19, 2023 Zoning Board of Appeals Regular Meeting Minutes. The motion carried by the following vote: Aye: Nachtrieb, Riggs, McShane and Bias Abstain: Hennessy CITIZENS TO BE HEARD ON AGENDA ITEMS This section is for anyone wanting to speak regarding agenda items and are allowed a maximum of 4 minutes. OLD BUSINESS: PUBLIC HEARING Page 1 of 4 Zoning Board of Appeals Meeting Minutes November 16, 2023 During the Public Hearing, members of the public will be allowed to present evidence and ask questions subject to the rules of the meeting. PETITION 2023-63: A Special Use Permit to allow a used car TMP-6646 dealership, located at 1101 N. Broadway Street. (Council District #4) Attachments: ZBA 2023-63 (1101 N. Broadway) November Staff Report Packet Mr. Torri read the staff report into the record. Chairman Hennessy swore in Mr. Abraham Garcia, 545 S. Canyon Drive, Romeoville, IL. Mr. Garcia appeared in support of his petition. Mr. Garcia talked about the site history, similar uses nearby and the proposed auto sales use at his location. Mr. Garcia, Mr. Torri and board members discussed some concerns with the site. Chairman Hennessy swore in Ms. Georgene Williams, 811 Elizabeth Street, Joliet, IL. Ms. Williams appeared in opposition to this petition. Ms. Williams stated that she is against this petition because the site has already been used as a auto sales business without approval and the petitioner did not follow through with the landscaping requirement from the previous Special Use Permit approval. Mr. Garcia responded to Ms. Williams' concerns. Mr. Bias asked if there are other locations, Mr. Garcia answered that he has a location on Collins Street in Joliet. Mr. Nachtrieb asked if the seller has to describe what the next business use will be, Mr. Torri said there should be disclosure of the underlying zoning and Special Use Permit approval. Chairman Hennessy asked if there was anyone else who would like to speak on behalf of this petition. No one came forward. A motion was made by Jim Riggs, seconded by Bob Nachtrieb, to deny PETITION 2023-63: A Special Use Permit to allow a used car dealership, located at 1101 N. Broadway Street. (Council District #4). Chairman Hennessy swore in Mr. Thomas Ledwell, 1032 Elizabeth Street, Joliet, IL. Mr. Ledwell appeared in support of his petition. Mr. Bias asked if the extra space above the garage will be living space, Mr. Ledwell said no, Mr. Bias asked what it will be used for, Mr. Ledwell said it is just a part of the garage. Chairman Hennessy swore in Ms. Georgene Williams, 811 Elizabeth Street, Joliet, IL. Ms. Williams appeared in opposition to this petition. Ms. Williams believe the extra space above the garage will be converted to an apartment . Mr. Ledwell responded that the space is just a attic. Mr. Torri explained that staff never received plans that depicted the garage that was constructed. Mr. Ledwell explained that he wanted to build a garage that was unique. Mr. Nachtrieb asked if the second-story space could be used for storage, Mr. Torri replied only with a variance. Chairman Hennessy asked if any one else would like to speak on behlaf of this petition. No one came forward. A motion was made by Ralph Bias, seconded by Bob Nachtrieb, to approve PETITION 2023-65: A Variation to increase maximum wall height for a detached garage from 10 ft. to 17 ft., located at 1032 Elizabeth Street. (Council District #4). The motion failed by the following vote: Aye: Nachtrieb and Bias Nay: Hennessy, Riggs and McShane A motion was made by Jim Riggs, seconded by Bob Nachtrieb, to deny PETITION 2023-65: A Variation to increase maximum wall height for a detached garage from 10 ft. to 17 ft., located at 1032 Elizabeth Street. (Council District #4). The motion carried by the following vote: Aye: Hennessy, Riggs and McShane Nay: Nachtrieb and Bias PETITION 2023-66: A Special Use Permit to allow TMP-6642 construction of a new automatic car wash, located at 1351 Illinois Route 59. (Council District #3) Attachments: ZBA 2023-66 (1351 Route 59) Staff Report Packet Mr. Torri read the staff report into the record. Chairman Hennessy swore in Mr. Brad Odanick, Tidal Wave Auto Spa. Mr. Odanick appeared in support of this petition. Mr. Odanick gave a brief overview of the Tidal Wave Auto Spa company. A motion was made by Ralph Bias, seconded by Jim Riggs, to approve PETITION 2023-66: A Special Use Permit to allow construction of a new automatic car wash, located at 1351 Illinois Route 59. (Council District #3).
