MINUTES LAWTON URBAN HOMESTEADING AGENCY (LUHA) SPECIAL MEETING MAY 23, 2006 - 6:00 P.M. WAYNE GILLEY CITY HALL COUNCIL CHAMBER The meeting was called to order at 6:00 p.m. by Acting Chairman Jeff Patton, Notice of meeting and agenda were posted on the City Hall notice board as required by State Law. PRESENT: Rex Givens, Janice Drewry, Keith Jackson, Jeffrey Patton, Stanley Haywood, Randy Warren. ABSENT: Bill Shoemate, Robert Shanklin. ALSO PRESENT: Larry Mitchell, City Manager; John Vincent, City Attorney; Traci Hushbeck, City Clerk, COL Sonny Uberti, Fort Sill Liaison. CONSIDER APPROVAL OF THE MINUTES OF APRIL 11, 2005 SPECIAL MEETING OF THE LAWTON URBAN HOMESTEADING AGENCY (LUHA). MOVED by Jackson, SECOND by Drewry, to approve the Minutes of April 11, 2006. AYE: Givens, Drewry, Jackson, Patton, Haywood, Warren. NAY: None. MOTION CARRIED. _____________________________________________________________________________________ BUSINESS ITEM: 1. Consider approving Lawton Urban Homesteading Agency (LUHA) policy No. 2, which would permit the Chairman and Secretary to execute releases of mortgage and/or temporary restrictive covenant in instances where the participants in the LUHA housing program have satisfied all of the requirements of their obligations under their agreements with the LUHA and authorize the Chairman to execute the document. Exhibits: Exhibit A: LUHA policy No. 2, Authority to sign releases of mortgage and/or temporary restrictive covenant on Lawton Urban Homesteading Agency (LUHA) funded mortgages and/or temporary restrictive covenants Vincent stated this document is identical to the one that was passed for the City Council for CDBG loans. It allows the Mayor, as Chairman of the Trust, to execute the releases of mortgage and/or temporary restrictive covenant documents, if all the conditions are satisfied and the City Attorney’s office approves. This expedites the process to clear title. MOVED by Warren, SECOND by Haywood, to approve Lawton Urban Homesteading Agency (LUHA) policy No. 2 and authorize the Chairman to execute the document. AYE: Drewry, Jackson, Patton, Haywood, Warren, Givens. NAY: None. MOTION CARRIED. If participation at any public meeting is not possible due to a disability, notification to the city Clerk at (580) 581-3305 at least 48 hours prior to the scheduled meeting is encouraged to make the necessary accommodations. The City may waive the 48 hour rule if interpreters for the deaf (signing) is not the necessary accommodation."
