Village Hall Village of Lombard 255 East Wilson Ave. Lombard, IL 60148 villageoflombard.org Minutes Economic & Community Development Committee Anthony Puccio, Chairperson Reid Foltyniewicz, Alternate Chairperson Dennis McNicholas, Garrick Nielsen, Matthew Pike, Paula Dillon, Laine Vant Hoff, Gregory Ladle, Alan Bennett and Patrick Kennedy Staff Liaison: William Heniff Monday, February 10, 2020 7:00 PM Village Hall 1.0 Call to Order and Pledge of Allegiance Trustee Puccio called the meeting to order at 7:00 p.m. The Pledge of Allegiance was recited 2.0 Roll Call Present 8 - Anthony Puccio, Dennis McNicholas, Garrick Nielsen, Matthew Pike, Paula Dillon, Laine Vant Hoff, Alan Bennett, and Patrick Kennedy Absent 1 - Gregory Ladle Also present: William Heniff, AICP, Director of Community Development; Jennifer Ganser, AICP, Assistant Director of Community Development. 3.0 Public Participation None 4.0 Approval of Minutes On a motion by Mr. Pike, and seconded by Ms. Dillon, the minutes of the December 16, 2019 meeting were approved by the members present. 5.0 Unfinished Business 6.0 200069 Humane Animal Ordinance Discussion Based on resident feedback at the December 5, 2019 Board of Trustees meeting, staff is bringing the subject of a Humane Animal Ordinance back to the Economic and Community Development Committee (ECDC). Village of Lombard Page 1 Economic & Community Minutes February 10, 2020 Development Committee The speakers expressed concerns about the retail sale of animals in Lombard that may have been from facilities that are otherwise deemed inhumane. Ms. Ganser reviewed the staff memo. Based on resident feedback this item is before the ECDC. It was discussed at the ECDC in 2013. The residents were concerned about Lombard’s regulations on the sale of animals. As is practice on other ECDC discussions on business regulations, staff did invite Happiness is Pets, Beach for Puppies, and Trop Aquatics. A Humane Animal Ordinance prohibits the sale of dogs/puppies (and possibly other animals) from commercial breeders or “puppy mills.” Pet Stores can still be allowed, but those in business would need to sell animals from shelters only. She reviewed the attorney memo and the potential options. She noted that Lombard is not home rule and there is no case law to support a non-home rule community passing a humane animal ordinance. The options are: do nothing/status quo, recommend an ordinance with a standard of care, recommend a humane animal care ordinance, or defer legislative actions to another level of government. Mr. Heniff noted the Villages authority ends at its corporate limits and if an ordinance was passed we would need to determine how it would be enforced and regulated. Trustee Puccio opened the discussion to the public. Ms. Tracey Gzamouranis said the regulations on pet stores are not enforced and there are sick puppies. The stores vary with their guarantees. She asked to consider the parents of the puppies as there are no regulations on breeding. She volunteers for a dog rescue and has seen dogs with health issues. She said Lisle and Crest Hill passed an ordinance and they aren’t home rule. Mr. Jon Berning said his family has owned Happiness is Pets since 1986. He said the pets have warranties and they have an A+ rating with the BBB. He said quality control standards are needed and they use the Purdue University Canine Care Standards. They are the only pet store that uses the standards that address both the puppies and the parents. He said breeders are inspected. He said the standards exceed the breed clubs. He said there is a market for pure bred dogs. He said there is the same number of puppy mills today as in 2013. Ms. Peggy Grandahl said she is involved in animal rescues and these products are part of the family. She said the industry has consumer fraud with sick dogs and high interest rates. She said the Purdue University Canine Care Standards are not available to the public. She Village of Lombard Page 2 Economic & Community Minutes February 10, 2020 Development Committee said the business practices lead to the dogs being bred more. She said she visited Beach for Puppies and their dogs come from large scale breeders. She said Downers Grove and Naperville passed a humane animal ordinance. Ms. Liz Chaplin said she is on the DuPage County Board District 2. The County has a shelter in Wheaton and they provide veterinary treatment, house animals, and do educational programs. Many dogs are sick or have emotional issues, some have been surrendered. She said the County is discussing the issue this week. Mr. Brian Krajewski said he is the former Mayor of Downers Grove and now on the DuPage County Board as the Chair of the Animal Services Committee. He said SB3078 was introduced and he is behind the bill. He said some states, like Maryland, banned puppy mills. Ms. Dawn Grana said she is resident of Lombard. She said many dogs are euthanized. Some dogs are bred at six months old. She said there are shelters for specific breeds of dogs. Ms. Bridget Welninski said she has lived in Lombard for 12 years and owned dogs for 22 years. She spoke about the health guarantees from pet stores. She said children get attached to the dogs. She said the parent dogs are often kept in cages. Ms. Deanna Breen said in 2003 she started working at an animal hospital for 11 years and encountered many new sick dogs that came from pet stores. She asked what happens after you return a dog to a pet store because its sick. She said children get attached to the dogs and the dogs have hard lives. Ms. Maya Domiano said she is the Outreach Coordinator with Companion Animal Protection Society (CAPS). She said she understands Lombard is not home rule. She mentioned a class action lawsuit CAPS had with a pet store. She said the organization is happy to provide additional information on licenses. Trustee Puccio said public comment is closed and opened the discussion to the ECDC members. Mr. McNicholas said he is in favor of a humane animal ordinance. He suggested Lombard talk with other non-home rule municipalities. Ms. Dillon asked about the two ordinances provided by Naperville. Ms. Village of Lombard Page 3 Economic & Community Minutes February 10, 2020 Development Committee Ganser said option A is a human animal ordinance that was recently passed. The second is option B. It did not pass, but would have enabled animal care standards. Ms. Vant Hoff asked what happened to the stores in Downers Grove and Ms. Ganser said they closed because they could not comply with the ordinance. She asked how Lombard would enforce this and Mr. Heniff said that would need to be reviewed. Mr. Bennett said our actions are limited to our boundaries. He suggested we see what Lombard could do to support the County or State or DuPage Mayors and Managers Conference. Mr. McNicholas asked if a humane animal ordinance could be passed while grandfathering in the existing businesses in Lombard. Ms. Ganser said staff would need to research that. Trustee Puccio suggested the matter be continued to April. Ms. Vant Hoff made a motion to continue the discussion to the April 13, 2020 ECDC meeting. Mr. Bennett seconded the motion adding that staff could look into a resolution of support and more data on the matter. Mr. Nielsen agreed more data was needed since tonight was many anecdotal stories. Mr. McNicholas agreed. On a motion by Ms. Vant Hoff and a second by Mr. Bennett, the ECDC unanimously voted the matter be continued to the April 13, 2020 ECDC meeting. Ms. Ganser reviewed the staff memo. Staff is proposing text amendments to Chapter 119 to match recent zoning text amendments on outdoor dining. These text amendments would allow for outdoor dining to be a permitted use in the Business Zoning Districts and set up business regulations. Mr. Nielsen asked staff to explain the process for the downtown and Mr. Heniff reviewed the process. Mr. Heniff noted that businesses not in the downtown would only be allowed to have outdoor dining on private property. Ms. Dillon asked where Jewel could have outdoor dining, as an example. Ms. Ganser explained they would Village of Lombard Page 4 Economic & Community Minutes February 10, 2020 Development Committee be allowed outdoor dining on their property only and may be required to put up a fence or do other site improvements. Mr. McNicholas asked if staff could remove the word building before the word permit. Mr. Nielsen asked for a sentence about ADA requirements. On a motion by Mr. Bennett and a second by Ms. Dillon, the ECDC recommended approval of the text amendments including the noted revisions to the Village Board. Environmental testing is ongoing. 10 Information Only Ms. Vant Hoff asked about Afterthought Brewery and Mr. Heniff said they will be before the Plan Commission for zoning entitlements in February for 218 E.
