Roll Call of Members Present 6 - Donald F. Ryan, Ronald Olbrysh, Martin Burke, Ruth Sweetser, John Mrofcza, and Stephen Flint Also present: Jennifer Ganser, AICP, Assistant Director of Community Development and Jason Guisinger, legal counsel to the Plan Commission. Chairperson Ryan called the order of the agenda. Ms. Ganser read the Rules of Procedures as written in the Plan Commission By-Laws. Public Hearings 170027 PC 17-04: 211B Eisenhower Lane South, 10th Planet Jiu Jitsu Lombard Requests that the Village grant a conditional use, pursuant to Section 155.420 (C) (18) of the Zoning Ordinance, to allow for a Learning Center (indoor athletic training facility) within the I Limited Industrial District. (DISTRICT #3) Chairperson Ryan asked if any person would like to speak in favor or against this petition, or for public comment including the petitioner and staff to please stand and be sworn in. Sworn in to present the petition Village of Lombard Page 1 Plan Commission Minutes January 23, 2017 was Wilfredo Ocasio. Mr. Ocasio stated his request to teach martial arts at 211 Eisenhower Lane South. He currently teaches at a Lombard location and would like to open his own business. Chairperson Ryan asked if any person would like to speak in favor or against this petition. Hearing none, he asked for the staff report. Ms. Ganser presented the staff report, which was submitted to the public record in its entirety. The petitioner, Mr. Ocasio, is proposing an indoor athletic training center in an existing tenant space without assembly functions. The building is located in the York Brook industrial park surrounded by light industrial land uses. The site maintains 143 parking spaces to be shared by all tenants of the building. The majority of the tenants are manufacturing and ware- house uses. The petitioner is requesting to occupy approximately 3% of the total square footage of the building. In addition, when reviewing parking needs, the petitioner will be utilizing his space at off hours compared to the other businesses in the building. A conditional use is required in the industrial district for the use of an indoor athletic training facility and staff supports the petitioner’s request. Chairperson Ryan asked for public comment, and, hearing none, opened the meeting for comments among the Commissioners. Commissioner Sweetser asked the petitioner if he was planning to bring in any equipment into the space as the response to the standards indicated that he is not. Mr. Ocasio responded that his written statement of no equipment is correct. A motion was made by Commissioner Sweetser, seconded by Commissioner Olbrysh, to recommend to the Corporate Authorities approval of this petition subject to the following five (5) conditions. 1. The conditional use permit for an indoor athletic training facility is exclusively for the tenant space at 211B Eisenhower Lane North. Any expansion of the establishment within the existing building beyond the plans submitted as part of PC 17-04 shall require an amendment to the conditional use; 2. All business activity associated with the indoor athletic facility shall be conducted within the existing building; 3. The petitioner shall satisfactorily address all comments noted within the Inter-Departmental Review Committee Report; 4. The parking lot shall be configured so as to meet all Illinois Accessibility Code requirements; and 5. This relief shall be valid for a period of one year from the date of approval of the ordinance. If the learning center is not established by said date, this relief shall be deemed null and void. The motion carried by the following vote: Aye: 5- Ronald Olbrysh, Martin Burke, Ruth Sweetser, John Mrofcza, and Stephen Flint Public Participation There was no public participation. DuPage County Hearings There were no DuPage County hearings. Chairperson's Report The Chairperson deferred to the Assistant Director of Community Development. Planner's Report The Assistant Director of Community Development had no report. Unfinished Business There was no unfinished business. New Business There was no new business. Workshops Rear Yard Setback Review Ms. Ganser said staff is introducing a possible relaxation of the rear yard setback requirements in the R2 Residential Zoning Districts from thirty-five feet (35’) to twenty-five feet (25’) from the rear property line. Staff is introducing this discussion based upon past precedence of Zoning Board of Appeals petitions for the past seventeen (17) years as well as consideration of desired building and structures by property owners. Only one case was not approved by the Village Board. She said previously the setback was 30 feet and increased to 35 feet in 1990. Maintaining a smaller rear yard provides greater flexibility for property owners while the net loss of non-buildable space between two abutting rear yards would be minimal. Revising the rear yard setback to twenty-five feet is anticipated have little negative impact on the overall character of established neighborhoods. Even if a proposed 25 foot rear yard setback is established, it would still mean that the two abutting rear yards of residential properties could provide for at least fifty feet (50’) of open space between the constructed houses. Commissioner Sweetser asked what prompted looking into this item. Ms. Ganser said by reviewing past ZBA cases and the past precedence. She also noted that staff encounters many property owners that decide not to pursue the process due to time or money yet are nonetheless frustrated by this restriction. Commissioner Olbrysh confirmed that the 50% open space would still be maintained and Ms. Ganser said yes. Commissioner Flint noted that last year he took a project to the ZBA and lost time starting the project. Commissioner Mrofcza said he was curious why the setback was increased to thirty-five feet (35’) in 1990. He said fifty feet (50’) between homes is probably sufficient. Ms. Ganser noted open space would still be a concern and issue. She also said this includes a deck attached to house as well as an addition. Commissioner Burke noted that many of the approved variances were Village of Lombard Page 4 Plan Commission Minutes January 23, 2017 under twenty-five feet (25’) and that he is in support of the petition. Adjournment A motion was made by Commissioner Flint, seconded by Commissioner Sweetser, to adjourn the meeting at 7:16 p.m. The motion passed by a unanimous vote. __________________________ Donald F.
