Call to Order and Pledge of Allegiance The regular meeting of the President and Board of Trustees of the Village of Lombard held in the Board Room of the Lombard Village Hall on Thursday, December 7, 2023 was called to order at 6:00 p.m. by Village President Keith Giagnorio. Director of Public Works Carl Goldsmith led the Pledge of Allegiance. II. This Payroll/Accounts Payable was approved on the Consent Agenda Ordinances on First Reading (Waiver of First Requested) E. 230027 An Ordinance Amending Schedule XII of the Lombard Traffic Code to Prohibit Right Turn on Red at the Intersections of Parkside and Main and Hickory and Main A Recommendation from the Public Safety & Transportation Committee to amend the Ordinance amending Schedule XII of the Lombard Traffic Code to prohibit right turn on red at the intersections of Parkside and Main and Hickory and Main. The Committee recommends amending the Village Traffic Code to add the language "when pedestrians are present" to the prohibition of right turns on red signals for westbound Hickory Street onto Main Street. Staff is requesting a waiver of First Reading. (DISTRICT #4) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8213 F. 230382 An Ordinance Authorizing a Real Estate Purchase and Sales Contract and Accepting a Grant of Ingress, Egress and Water Main Easements Approving an Ordinance Authorizing a Real Estate Purchase and Sales Contract (Lot Two (2) in the Hoffman-Lombard Subdivision, Lombard, Illinois) and Accepting a Grant of Ingress, Egress and Water Main Easements Comprising a part of the Butterfield-Yorktown TIF District and a part of the Butterfield Road/Yorktown Business District Number Two (2) of the Village of Lombard, Illinois. The property will be utilized for the construction of the South Elevated Water Tower. Staff is requesting a waiver of Fist Reading. (DISTRICT #3) Village of Lombard Page 3 Village Board of Trustees Minutes December 7, 2023 This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8214 G. 230393 Amending Title XI, Chapter 112, Section 112.13(A) of the Lombard Village Code - Alcoholic Beverages Ordinance increasing the number of authorized licenses in the Class "GG" liquor license category by one and granting a Class "GG" liquor license to Aldi, Inc. d/b/a Aldi Battle, located at 205 W. Roosevelt Road, Lombard, Illinois. (DISTRICT #2) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8215 H. 230394 Amending Title 11, Chapter 112, Section 112.13 (A) of the Lombard Village Code - Alcoholic Beverages An Ordinance decreasing the number of Class "AB-II" liquor licenses by one (1) due to a change in ownership of Nine Six 96 LLC d/b/a Rosemary and Jeans at 116 S. Main Street, and the creation of one (1) new Class “AB-II” liquor license for Saverio LLC d/b/a Rosemary and Jeans at 116 S. Main Street, under new ownership. (DISTRICT #4) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8216 H-2. 230415 Purchase of Four (4) Ford Interceptors and an Ordinance Declaring Certain Municipal Vehicles as Surplus, and Authorizing Sale Thereof Request for a waiver of bids and award of a contract to Haggerty Ford in the amount of $206,760.00. The vehicles will be purchased through the Suburban Purchasing Cooperative (SPC Contract #204), of which the Village is a member. Approval of an Ordinance declaring Units PP796, a 2018 Ford Interceptor Utility, PP797 a 2018 2018 Ford Interceptor Utility, PP798 a 2018 Ford Interceptor Utility, PP716 a 2018 Ford Interceptor Utility, as surplus and authorizing their sale and/or disposal. Staff requests a waiver of first reading. This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8217 Other Ordinances on First Reading I. 220185 Yorktown Reserve Economic Incentive Agreement - First Amendment: Village of Lombard Page 4 Village Board of Trustees Minutes December 7, 2023 A recommendation from the Economic and Community Development Committee to approve a First Amendment to the previously approved economic incentive agreement between the Village and Lombard Development Manager LLC. The amendment would modify various established benchmarks and timelines, as well as providing for an amended funding dispersal approach for the proposed greenspace (Business District #2 funding source) elements . (DISTRICT #3) This Ordinance was passed on first reading on the Consent Agenda Enactment No: Ordinance 8181 J. 230350 Text Amendments to Sections 150 of the Village Code: Miscellaneous Amendments The Board of Building Appeals recommends approval of the following code amendments to the Lombard Building Code (Title 15, Chapter 150 of Village Code): 1. Applying the provisions of Section 150.040 to all construction projects; 2. Clarifying bedroom door minimum widths; 3. Adding bridging requirements for floor joists; 4. Clarifying when permits are required for residential driveway repairs and replacements; 5. Amendments to reference IRC requirements for plan submittals; and 6. Striking provisions set forth within Chapter 150.160 through 150.207 pertaining to unsafe structures, as those provisions are already addressed within the International Property Maintenance Code (IPMC). (DISTRICTS - ALL) This Ordinance was passed on first reading on the Consent Agenda K. 230351 Text Amendments to Village Code of Ordinances - Section 150.105 Valet Trash Service The Board of Building Appeals recommends approval of a new Section 105.6.51 added to the International Fire Code for Valet Trash Service. Valet trash is a service that collects a limited amount of occupant-generated combustible trash or recyclable materials left outside of a dwelling units for scheduled pick-up. This Ordinance was passed on first reading on the Consent Agenda L. 230353 Text Amendments to Section 152.24 of the Village Code - Address Sizing on Buildings The Board of Building Appeals recommends approval of a Text Amendment to Chapter 152, Article II of Village Code. The amendment proposes to reduce confusion by adopting the size provisions referenced within the 2018 International Property Maintenance Code (IPMC) to be Village of Lombard Page 5 Village Board of Trustees Minutes December 7, 2023 the standard and will provide the best opportunity for emergency response personnel and visitors to properly identify specific buildings. (DISTRICTS - ALL) This Ordinance was passed on first reading on the Consent Agenda M. 230372 PC 23-22 Text Amendments to Village Code - Landscape Requirements The Plan Commission submits its recommendation to approve the text amendments to the following sections of the Village Code: 1. Amend Section 155.706 of the Village Code, Parking lot landscaping, to reference tree species in conformance with Section 99.04 of Village Code. 2. Amend Section 155.707 of the Village Code, Transitional yard landscaping, to reference tree species in conformance with Section 99.04 of Village Code; and to amend and clarify the requirements for transitional landscape yard improvements. 3. Amend Section 155.709 of the Village Code, Perimeter lot landscaping, to reference tree species in conformance with Section 99.04 of Village Code; and to clarify requirements for properties adjacent to detention ponds, wetlands, floodplains or similar. 4. Amend Section 155.712 of the Village Code, Changes to approved landscape plans, to clarify that approved landscape plans must be maintained by current and future property owners for the life of the development. (DISTRICTS - ALL) This Ordinance was passed on first reading on the Consent Agenda N. 230373 PC 23-23 Text Amendments to Village Code - Exterior Lighting The Plan Commission submits its recommendation to approve the text amendments to Village Code Section 155.417(G)(14), and any other relevant sections for clarity and consistency, as it pertains to exterior lighting in the B4A Roosevelt Road Corridor District. (DISTRICTS - ALL) This Ordinance was passed on first reading on the Consent Agenda O. 230374 PC 23-24 Text Amendments to Village Code - Wall Signage The Plan Commission submits its recommendation to approve the text amendments to Village Code Sections 153.506 and 153.507, and any other relevant sections for clarity and consistency. The proposed text amendments clarify the total amount of wall signage permitted on properties with more than one street frontage in the B5 Central Business District and the B5A Downtown Perimeter District. (DISTRICTS - ALL) This Ordinance was passed on first reading on the Consent Agenda P. 230398 FY 2024 Salary Ordinance Ordinance setting rates of pay and salaries for Village of Lombard Village of Lombard Page 6 Village Board of Trustees Minutes December 7, 2023 employees effective January 1, 2024. This Ordinance was passed on first reading on the Consent Agenda Q. 230402 Ordinance Adopting the Human Resources Policy for Paid Leave Benefits Ordinance adopting the Paid Leave Benefits Policy for Village employees that is required by State Statute. This Ordinance was passed on first reading on the Consent Agenda Ordinances on Second Reading Resolutions R. 230267 First Amendment to Memorandum of Understanding with the Helen Plum Library Relative to The Elmhurst Memorial Hospital Parking Lot Approving a Resolution authorizing the Village President and Village Clerk to enter into a First Amendment to the Memorandum of Understanding with the Helen Plum Library for a portion of the Elmhurst Memorial Hospital Lot. The Village will have full access to 44 spaces in the Elmhurst Hospital Lot.The current Memorandum expires December 31, 2023. The Parties have agreed to extend the Memorandum of Understanding until such time as the property is conveyed to the Lombard Park District or July 1, 2024. (DISTRICT #1) This Resolution was adopted on the Consent Agenda Enactment No: R 63-23 S. 230331 Downtown Improvement & Renovation Grant; 244 E St Charles Road (Lombard Veterinary Hospital) - Amended Grant Request A recommendation from the Economic and Community Development Committee to approve a Downtown Improvement and Renovation Grant Program (also known as the Facade Grant Program) for the Lombard Veterinary Hospital property. The applicant is redeveloping the entire subject property with an expanded veterinary hospital plus a 2,400 square-foot second building for future commercial use. The grant request is for partial funding to provide for the relocation and burial of an existing Com Ed transmission line with companion AT&T and Comcast pole co-locations, consistent with grant provisions and in an amount not to exceed $50,000.00 per the Renovation & Improvement Grant Policy. (DISTRICT #1) This Resolution was adopted on the Consent Agenda Enactment No: R 65-23 T-2. 230322 SUB 23-01: Resolution Approving and Authorizing the Execution of a Final Plat of Subdivision for the 600 to 690 East Butterfield Road Property (Hoffmann - Lombard Subdivision, Lombard, Illinois), as Part of a Redevelopment Project Within the Butterfield - Yorktown TIF District and the Butterfield Road/Yorktown Business District NO. 2 of the Village of Lombard, Illinois The Plan Commission submits its recommendation of approval for a plat of subdivision for a tract of land located at 600-690 E Butterfield Road. (DISTRICT #3) This Resolution was adopted on the Consent Agenda Enactment No: R 66-23 Other Matters U. 230389 Lombard Surveillance and Access Control System for Fleet Facility Expansion Request for a waiver of bids and award of a contract to Imperial Surveillance Inc, of Arlington Heights, Illinois, in the amount not to exceed $37,464.03. With the expansion of the Fleet Facility. Staff has sought a proposal from Imperial Surveillance for the purchase and installation of access control equipment and video surveillance equipment for the expanded and remodeled facility. (DISTRICT #6) This Bid was approved on the Consent Agenda V. 230401 Rights-of-Way Tree Pruning Contract Renewal Request for a waiver of bids and award of a contract to D Ryan Tree and Landscape LLC in an amount not to exceed $80,000.00.
