Call to Order and Pledge of Allegiance The regular meeting of the President and Board of Trustees of the Village of Lombard held on Thursday, November 7, 2024 in the Board Room of the Lombard Village Hall was called to order at 6:02 p.m. by Village President Keith Giagnorio. The Pledge of Allegiance was led by Daisy Troop #56560. II. Village Manager/Village Board/Village Clerk Comments Trustee Andrew Honig reported that he had won the election to the DuPage County Board. He thanked the Village Board and staff for all of their assistance and support the last five years. He, however, will need to resign his position as Trustee for the Village of Lombard effective November 8, 2024. Attorney Jason Guisinger provided an overview of steps to fill the vacancy that will be created by the resignation of Trustee Honig. Board members thanked Trustee Honig for his service to the residents and the Village of Lombard. VIII Consent Agenda . Payroll/Accounts Payable A. 240332 Approval of Accounts Payable For the period ending October 18, 2024 in the amount of $5,548,593.30. Village of Lombard Page 2 Village Board of Trustees Minutes November 7, 2024 This Payroll/Accounts Payable was approved on the Consent Agenda B. 240333 Approval of Village Payroll For the period ending October 19, 2024 in the amount of $981,441.79. This Payroll/Accounts Payable was approved on the Consent Agenda C. 240334 Approval of Accounts Payable For the period ending October 25, 2024 in the amount of $3,927,266.64. This Payroll/Accounts Payable was approved on the Consent Agenda D. 240343 Approval of Accounts Payable For the period ending November 1, 2024 in the amount of $315,256.57. This Payroll/Accounts Payable was approved on the Consent Agenda Ordinances on First Reading (Waiver of First Requested) E. 240342 An Ordinance Declaring 2012 Ford F250 as Surplus, and Authorizing the Sale Thereof Approval of an Ordinance declaring Unit FR322, a 2012 Ford F250, as surplus and authorizing their sale and/or disposal. Staff requests a waiver of first reading. This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8301 E-2. 240350 Amending Title XI, Chapter 112, Section 112.13(A) of the Lombard Village Code - Alcoholic Beverages Ordinance increasing the number of authorized licenses in the Class "A/B-III" liquor license category by one and decreasing the number of authorized licenses in the Class “A/B-IV” liquor license category by one to reflect a reclassification of Empire Yorktown, LLC d/b/a Empire Burgers and Brew, located at 94 Yorktown Shopping Center, to align with the establishment’s intended operations. (DISTRICT #3) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8302 Other Ordinances on First Reading Ordinances on Second Reading Resolutions Village of Lombard Page 3 Village Board of Trustees Minutes November 7, 2024 F. 230131 Prairie Food Co-op Business Retention Economic Incentive Agreement Request The Economic and Community Development Committee recommends approval of the Business Retention Economic Incentive Agreement Request for Prairie Food Co-op at the Eastgate Shopping Center at 837 S. Westmore-Meyers Road, Unit A4-1. This item was on the October 3, 2024 Village Board Agenda and was tabled to the November 7, 2024 meeting. A revised agreement is offered which amends the payout provisions for the channel letter wall signs for the tenant space. (DISTRICT #5) This Resolution was adopted on the Consent Agenda Enactment No: R 58-24 F-2. 240355 Sidewalk and Curb Improvement Program Change Order No. 1 and Final Reflecting an increase to the contract with Globe Construction, Inc. in the amount of $50,921.80. The increase reflected by this Change Order is due to the increased quantity of material and work that was performed. (DISTRICTS - ALL) This Resolution was adopted on the Consent Agenda Enactment No: R 59-24 Other Matters G. 240335 Purchase of Advanced Life Support (ALS) Ambulance Request for a waiver of bids and award of a contract to Foster Coach of Sterling, Illinois in an amount not to exceed $364,740.00. The Horton ambulance is available for joint purchase through the Suburban Purchasing Cooperative (SPC Contract #214). The Horton dealer in our area is Foster Coach of Sterling, Illinois. This Bid was approved on the Consent Agenda H. 240340 Purchase and Implementation of Automatic Vehicle Location and Dash Cameras in Public Works Vehicles Request for a waiver of bids and award of a three (3) year contract to Samasar, Inc. of San Francisco, California, in the amount of $11,903.00 for Year One and $11,762.40 for Years Two and Three. Following a review of the available companies providing automatic vehicle locations and utilization software and an assessment of our operational needs, it has been determined that Samsara's platform offers the best option for the Village to begin implementing this technology. This Bid was approved on the Consent Agenda Village of Lombard Page 4 Village Board of Trustees Minutes November 7, 2024 I. 240347 Rights-of-Way Tree Pruning and Demand Pruning/Cabling Award of a contract to D Ryan Tree and Landscape LLC, the lowest responsible bidder of the four (4) bids received, in an amount not to exceed $84,625.00. The lowest bid did not meet the requirements for qualified bidders. This is a one-year contract with two one-year renewal options upon mutual agreement. (DISTRICTS - ALL) This Bid was approved on the Consent Agenda J. Parkway, Turf and Landscape Restoration Contract Award of a contract to Advanced Landscaping, LLC, the lowest responsible bidder of three (3) bids received, in an amount not to exceed $55,275.00. This is a ten (10)-month contract starting in March 2025 and running through December 2025 with two one-year renewal options subject to mutual agreement. (DISTRICTS - ALL) This Bid was approved on the Consent Agenda K. 240339 Increase to 2024 Contract with MGT of America Consulting, LLC (previously GovTemps, USA) Motion to authorize the Village Manager or Human Resources Director to increase the contract with MGT of America Consulting, LLC (previously GovTemps, USA) by $20,000 for temporary employee services as needed in an amount not to exceed $140,000 for 2024. This Request was approved on the Consent Agenda L. 240183 PC 24-07: Pinnacle at Meyers Subdivision - Final Plat Staff requests to approve the Final Plat of Subdivision for Pinnacle at Meyers located at 1308, 1312 and 1320 S Meyers Road . (DISTRICT #6) This Request was approved on the Consent Agenda Enactment No: Ordinance 8290, 8291, 8292 M. 240345 Appointment to Zoning Board of Appeals Request for concurrence of the Village Board in the appointment of Anthony Uriaus to the Zoning Board of Appeals to fill a vacancy created by the resignation of Mary Newman with a term to May 2029. This Appointment was approved on the Consent Agenda N. 240346 Appointment to Plan Commission Request for concurrence of the Village Board in the appointment of Brendan Flanigan to the Plan Commission to fill a vacancy created by the resignation of Kevin Walker with a term to May 2025. A motion was made by Trustee Brian LaVaque, seconded by Trustee Bernie Dudek, that the Ordinance adopting the Village of Lombard budget for FY 2025 be passed on second reading. The motion carried by the following vote: Aye: 5- Brian LaVaque, Anthony Puccio, Bernie Dudek, Andrew Honig, and Dan Militello Absent: 1- Bob Bachner Enactment No: Ordinance 8303 B. 240267 Four (4) Ordinances Amending Title 5, Chapter 50 of the Lombard Village Code in Regard to Water and Sewer Rates 1. An Ordinance Amending Title 5, Chapter 50, Section 50.114 of the Lombard Village Code in Regard to Water Rates Effective January 1, 2025, this ordinance amends Section 50.114(A) to increase the variable water rate both within and outside Village limits by 3.50% for operations and 6.50% for capital needs each year, for the next five years (2025-2029). Section 50.114(B) amends the flat fixed administrative service charge to $5.23 per billing period, effective January 1, 2025, and increases this fee by 3.50% each year, for the next four years (2026-2029). Section 50.114(C) establishes a flat fixed cross connection fee for non-residents of $5.10 per billing period for the next five years (2025-2029). Section 50.114(D) establishes a flat fixed capital fee of $6.39 per billing period, effective January 1, 2025, and increases Village of Lombard Page 6 Village Board of Trustees Minutes November 7, 2024 this fee by 6.50% each year for the next four years (2026-2029). 2. An Ordinance Amending Title 5, Chapter 50, Section 50.106(B) of the Lombard Village Code In Regard to Wastewater Collection and Treatment Charges Effective January 1, 2025, this ordinance amends Section 50.106(B) to increase the wastewater collection and treatment variable charge, within and outside Village limits 3.50% for operations and 6.50% for capital needs each year, for the next five (5) years (2025-2029). 3. An Ordinance Amending Title 5, Chapter 50, Section 50.113(A) of the Lombard Village Code in Regard to Sanitary Sewer Service Only Rates Effective January 1,2025, this ordinance amends Section 50.113(A) to change the administrative service charge to $5.23 per billing period and increases this fee by 3.50% each year for the next four years (2026-2029). Effective January 1, 2025, this ordinance also amends the flat fixed capital fee to $6.39 per billing period and increases this fee by 6.50% each year for the next four years (2026-2029). 4. An Ordinance Amending Title 5, Chapter 50, Section 50.110(A) of the Lombard Village Code in Regard to Non-Village Metered Sewer Charges Effective January 1, 2025, this ordinance amends Section 50.110(A) to increase the daily variable charge for non-village metered residential sewer charges within the Village limits by $0.03 and outside the Village limits by $0.04 or $0.05, each year for the next five years (2025-2029). This ordinance also increases the daily variable charge for non-village metered commercial sewer charges within the Village limits by $0.17 and outside the Village limits by $0.25 or $0.26, each year for the next five years (2025-2029). The Finance and Administration Committee unanimously recommends these amendments. A motion was made by Trustee Andrew Honig, seconded by Trustee Dan Militello, that the four ordinances Amending Title 5, Chapter 50 of the Lombard Village Code in regard to Water and Sewer Rates be passed on second reading.
