Call to Order and Pledge of Allegiance The regular meeting of the President and Board of Trustees of the Village of Lombard held on Thursday, February 20, 2025 in the Board Room of the Lombard Village Hall was called to order at 6:00 p.m. by Village President Keith Giagnorio. Director of Public Works Carl Goldsmith led the Pledge of Allegiance. II. Committee Reports Community Promotion & Tourism - Trustee Bernie Dudek, Chairperson No report Community Relations Committee - Trustee Dan Militello, Chairperson Village of Lombard Page 1 Village Board of Trustees Minutes February 20, 2025 No report Economic/Community Development Committee - Trustee Anthony Puccio, Chairperson Trustee Anthony Puccio, Chairperson of the Economic & Community Development Committee, reported the following: On tonight’s agenda, you will see that the ECDC considered and unanimously recommended approval of a First Amendment to the Business Retention Economic Incentive and Sales Tax Agreement for Prairie Food Co-op (PFC). The amendment addresses a project completion deadline within the original Agreement. PFC intends to open at their tenant space in Eastgate Shopping Center in the Spring. Also on tonight’s agenda, the ECDC recommended approval of a façade grant with an accessibility component for O’Neill’s Pub located at 236 East St. Charles Road. The ECDC also approved a Downtown Business Grant for a new awning fabric for the proposed Vibe Café at 22 West St. Charles Road. Finance & Administration Committee, Vice Chairperson Dan Militello No report Public Safety & Transportation Committee - Trustee Brian LaVaque Chairperson No report Public Works & Environmental Concerns Committee - Trustee Bob Bachner, Chairperson Trustee Bob Bachner, Chairperson of the Public Works & Environmental Concerns Committee, reported the following: The PWECC met on Tuesday Feb 11 at 6pm. The committee reviewed multiple change orders. After minor discussions they were all unanimously approved. All are on the agenda tonight for Board approval. An amendment to the Illinois Public Works Mutual Aid Network agreement was also reviewed with minor changes also being approved by the committee. The committee also discussed latest reports on the Village’s Sustainability Framework and the Capital Improvement Program budget Lombard Historic Preservation Commission - Village Clerk Liz Brezinski Village Clerk Liz Brezinski, Liaison to the Lombard Historic Preservation Commission, reported the following: Village of Lombard Page 2 Village Board of Trustees Minutes February 20, 2025 The members reviewed and approved the annual report. The report will be transmitted to the Village Board for acceptance. The public hearing was held for the request from Punky's Pub, 16 S. Park, for designation of their sign as an historical sign. The members voted to approve the request and forward to the Village Board for action. VII. Village Manager/Village Board/Village Clerk Comments Trustee Brian LaVaque, Chairperson of the Public Safety & Transportation Committee, thanked Chief of Police tom Wirsing for his years of service to the residents, the community, the Village and the Police Department. He wished him well in his retirement. Village Manager Scott Niehaus also thanked Chief Wirsing and stated he would ask Tom to speak. Chief of Police Tom Wirsing thanked all of the staff and the Village Board for the opportunities he has had over his career. Village President Keith Giagnorio thanked Chief Wirsing and wished him well in his retirement. VIII Consent Agenda . This Payroll/Accounts Payable was approved on the Consent Agenda B. 250086 Approval of Village Payroll For the period ending February 8, 2025 in the amount of $1,065,920.60. This Payroll/Accounts Payable was approved on the Consent Agenda C. 250087 Approval of Accounts Payable For the period ending February 14, 2025 in the amount of $1,148,386.73. This Payroll/Accounts Payable was approved on the Consent Agenda Ordinances on First Reading (Waiver of First Requested) D. 240373 An Ordinance Amending Article XIII of the Lombard Traffic Code to Add Parking Prohibitions on Magnolia Circle and Cherry Lane A Recommendation from the Public Safety & Transportation Committee to amend the Ordinance amending Article XIII of the Lombard Traffic Village of Lombard Page 3 Village Board of Trustees Minutes February 20, 2025 Code to establish parking prohibitions on the north side of Magnolia Circle from Cherry Lane to Lilac Way and the east side of Cherry Lane from Wilson Avenue to the north dead end of street. (DISTRICT #6) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8330 E. 250058 An Ordinance Amending the Village Code to Implement a Non-Home Rule Municipal Retailers' Occupation Tax and a Non-Home Rule Municipal Service Occupation Tax Pursuant to Public Act 103-0781 And Suspending the Collection of Said Taxes Approved by Referendum on March 21, 2006 Recommendation from the Finance & Administration Committee approving an ordinance suspending the current 1% Non-Home Rule Sales Tax and adopting an ordinance to implement a broader use 1% Non-Home Rule Sales Tax. This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8331 Other Ordinances on First Reading F. 250085 Ordinance AmendingTitle III, Chapter 30, Article I, Section 30.05 of the Lombard Village Code in Regard to Board of Trustees Regular Meeting Agendas An ordinance amending Village Code proving for a manner by which elected officials may place items onto a Village Board agenda. This Ordinance was passed on first reading on the Consent Agenda Ordinances on Second Reading G. 240397 PC 24-15: 434 E. North Avenue- Motor Vehicle Sales and Service The Plan Commission submits its recommendation to approve the following actions on the subject property located within the B4 Corridor Commercial District: 1. Approval of a conditional use pursuant to Section 155.416(C)(15) of the Lombard Village Code to allow for a motor vehicle sales business; and 2. Approval of a conditional use pursuant to Section 155.416(C)(16) of the Lombard Village Code to allow for a motor vehicle service business. Westmore-Meyers Road - Nine-unit multi-family building The Plan Commission submits its recommendation to approve the following for a property located within the R4 Limited General Residential District: 1. Variation under Section 155.103(C)(8)(c) from Section 155.409(D)(4) which requires 2,800 square feet of lot area per dwelling unit (15.4 dwelling units per acre), and limits the number of dwellings to seven (7), in order to allow nine (9) three-bedroom dwellings (2,248 square feet per dwelling, 19.35 dwellings per acre). This Ordinance was passed on second reading on the Consent Agenda Enactment No: Ordinance 8333 I. 250042 PC 25-03: Text Amendment - Clear Lines of Sight Areas The Plan Commission recommends approval of text amendments to Sections 155.802 (Definitions) and 155.207 (Regulations) as it pertains to clear lines of sight (CLOS) areas. (DISTRICTS - ALL) This Ordinance was passed on second reading on the Consent Agenda Enactment No: Ordinance 8334 Resolutions J. 230131 Prairie Food Co-op Business Retention Economic Incentive Agreement - First Amendment The Economic and Community Development Committee (ECDC) recommends approval an amendment to the Business Retention Economic Incentive and Sales Tax Agreement for Prairie Food Co-op (PFC). The amendment addresses project construction completion deadlines. (DISTRICT #5) This Resolution was adopted on the Consent Agenda Enactment No: R 05-25 K. 250031 FY2024 Sanitary Sewer Lining Program, Final Balancing Change Order No. 3 Reflecting a decrease of $341.00 to the contract with Performance Piping, Inc. The Change Order addresses the agreed-upon final quantities for the project. (DISTRICTS #1 & #2) This Resolution was adopted on the Consent Agenda Enactment No: R 06-25 L. 250055 Large Diameter Combined Sewer Rehabilitation Project, Change Village of Lombard Page 5 Village Board of Trustees Minutes February 20, 2025 Order No. 4 Reflecting an increase of $7,586.33 to the contract with Vortex Lining Systems. The addition of two time and materials billings and the balancing of one pay item quantity to date. (DISTRICTS #1 & #5) This Resolution was adopted on the Consent Agenda Enactment No: R 07-25 M. 250061 East St. Charles Road Sidewalk Improvement Project, Change Order No. 1 Approving an extension of contract with R.W. Dunteman Company. This Change Order extends the deadline for substantial completion from December 31, 2024 to July 22, 2025. (DISTRICT #4) This Resolution was adopted on the Consent Agenda Enactment No: R 08-25 N. 250062 Downtown Sidewalk Improvement Project, Final Balancing Change Order No. 5 Reflecting a decrease to the contract with R.W. Dunteman Company in the amount of $116,167.44. This Final Balancing Change Order includes reducing some of the pay item quantities and reflects a decrease of 4% from the current contract amount. (DISTRICTS #1 & #4) This Resolution was adopted on the Consent Agenda Enactment No: R 09-25 O. 250063 Right-of-Way Tree and Stump Removal Program, Change Order No. 1 Reflecting an increase to the contract with Homer Tree Care, Inc. in the amount of $25,000.00. This Change Order reflects additional quantities to be added to the contract due to the Village receiving a USDA Grant through the Morton Arboretum/CRTI. (DISTRICTS - ALL) This Resolution was adopted on the Consent Agenda Enactment No: R 10-25 P. 250071 Amended Illinois Public Works Mutual Aid Network (IPWMAN) Agreement Recommendation of the Public Works & Environmental Concerns Committee to authorize the proposed amended Agreement with the Illinois Public Works Mutual Aid Network (IPWMAN) and their revised by-laws. The Village has been a member of IPWMAN since it was formed in 2009. This amended Agreement must be approved to continue our membership. (DISTRICT #4) This Resolution was adopted on the Consent Agenda Enactment No: R 12-25 Other Matters R. 250073 Snow and Debris Hauling Request for a waiver of bids and award of a contract to Utility Transport Company of Oak Forest, Illinois, the lowest proposal of three (3) proposals received, in an amount not to exceed $96,870.00. Staff received proposals with updated quantities to more reflect the historical average of number and type of loads. (DISTRICTS - ALL) This Bid was approved on the Consent Agenda S. 230075 PC 23-02: Yorktown Reserve - Final Plat of Subdivision Staff requests to approve the Final Plat of Subdivision for Yorktown Reserve located at 230 Yorktown Center .
