Call to Order and Pledge of Allegiance The regular meeting of the President and Board of Trustees of the Village of Lombard held on Thursday, March 6, 2025 in the Board Room of the Lombard Village Hall was called to order at 6:00pm by Acting Village President Dan Militello. Director of Public Works Carl Goldsmith led the Pledge of Allegiance. Acting Village President Dan Militello read a letter from Trustee Puccio requesting to be allowed to attend the meeting remotely as he was out of town on business. Request approved. II. This Payroll/Accounts Payable was approved on the Consent Agenda Ordinances on First Reading (Waiver of First Requested) D. 250090 An Ordinance Amending Title IX, Chapter 92, Section 92.17 of the Lombard Village Code in regard to Waste Collection and Disposal Approving an Ordinance updating the Village Code to reflect the solid waste and recycling collection and disposal rates that become effective on April 2, 2025. (DISTRICTS - ALL) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8335 E. 250091 Adoption of Official Zoning Map - 2025 An ordinance approving a Village of Lombard Zoning Map pursuant to State Statutes. This maps does not change the zoning of any properties within the Village's Corporate limits, and is only a graphic depiction of past Zoning actions by the Village Board. (DISTRICTS - ALL) This Ordinance was waived of first reading and passed on second reading with suspension of the rules on the Consent Agenda Enactment No: Ordinance 8336 Other Ordinances on First Reading F. 250041 PC 25-02: Text Amendment - Electric Vehicle (EV) Parking & Director Responsibilities The Plan Commission submits its recommendation to approve, the Village of Lombard, requested text amendments to the following Sections of Village Code: 1. Create a new Section 155.228: Electric Vehicle Parking to establish regulations on requirements such as location and design 2. Amend Section 155.802 to add definitions related to electric Village of Lombard Page 3 Village Board of Trustees Minutes March 6, 2025 vehicle parking 3. Amend Village Code 155 to remove “Director of Community Development” and replace with “Director of Economic Development and Planning” and/or “Director of Building” as applicable 4. Any other relevant sections for clarity and consistency. (DISTRICT ALL) This Ordinance was passed on first reading on the Consent Agenda G. 250082 PC 25-04: 505 W. Roosevelt Road - Drive-through restaurant The Plan Commission submits its recommendation to approve the following action on the subject property located within the B4A Roosevelt Road Corridor District: 1. A conditional use pursuant to Section 155.103(F) of the Zoning Ordinance in order to allow a drive through accessory to a restaurant (see Section 155.417(G)(2)(b)(iv)); 2. A conditional use pursuant to Section 155.103(F) of the Zoning Ordinance in order to recognize existing off-site parking throughout the shopping center (R1972-041405) and allow the use of parking spaces situated at 505 West Roosevelt Road to support use at 1210 Finley Road and 515 W. Roosevelt Road in conformance with Section 155.602(A)(3)(b) while also allowing shopping center cross-parking as covenanted in 1972 (see Section 155.417(G)(2)(c)(ii)); 3. Variations pursuant to Section 155.103(C) of the Zoning Ordinance to allow the continuation of conditions existing since 1977, and later with the expansion of rights of way, to remain: a. From Section 155.417(G)(3), and 155.417(G)(5)(c) which impose certain lot size (40,000 SF) and interior side yard (10 feet) standards subject to compliance with the site plan and landscape plan on file with the Village which shall be deemed part of any ordinance authorizing the variations; and b. From Sections 155.417(G)(9) and 155.417(G)(12) which impose certain landscaping (Article XI), and parking lot design (Article X) standards subject to compliance with the site plan and landscape plan on file with the Village which shall be deemed part of any ordinance authorizing the variations. (DISTRICT #2) This Ordinance was passed on first reading on the Consent Agenda H. 250083 PC 25-05: 1210 S. Finley Road - Smoking Establishment The Plan Commission submits its recommendation to approve the following action on the subject property located within the B4A Roosevelt Road Corridor District: Village of Lombard Page 4 Village Board of Trustees Minutes March 6, 2025 1. A conditional use pursuant to Section 155.103(F) of the Zoning Ordinance in order to allow a smoking establishment that complies with the Illinois Smoke Free Act (see Section 155.417(G)(2)(b)(xi)); 2. A conditional use pursuant to Section 155.103(F) of the Zoning Ordinance in order to recognize existing off-site parking throughout the shopping center (R1972-041405) the use by 1210 Finley Road of off-site parking spaces situated at 505 and 515 West Roosevelt Road in conformance with Section 155.602(A)(3) (b) (see Section 155.417(G)(2)(c)(ii)); 3. A conditional use pursuant to Section 155.103(F) of the Zoning Ordinance in order to allow outdoor services, subject to Section 155.210(C)(2)(b) (see Sections 155.417(G)(2)(a)(vi) and 155.417(G)(10)(b)), provided that no seating area for a smoking establishment shall be placed within thirty (30) feet from the west lot line; 4. Variation pursuant to Section 155.103(C) of the Zoning Ordinance to allow one marquee sign on the building canopy facing Finley Road (east elevation) and one marquee sign on the south elevation in order with a combined area not to exceed 100 square feet to comply with prior and current staff interpretation of Section 153.505(B)(17)(a)(i)(a) which limits the area of marquee signs by regulating them as wall signs and limiting them a combined area of one times the lineal front footage of the property per façade of street front exposure or a maximum of 100 square feet; 5. Variations pursuant to Section 155.103(C) of the Zoning Ordinance to allow the continuation of conditions existing since 1977, and later with the expansion of rights of way, to remain: a. From Section 155.417(G)(3), Section 155.417(G)(4), and Section 155.417(G) (5)(c) which impose certain lot size (40,000 SF), lot width (150 feet), and interior side yard (10 feet) standards subject to compliance with the site plan and landscape plan on file with the Village which shall be deemed part of any ordinance authorizing the variations; and b. (DISTRICT #2) This Ordinance was passed on first reading on the Consent Agenda Ordinances on Second Reading Village of Lombard Page 5 Village Board of Trustees Minutes March 6, 2025 I. 250085 Ordinance AmendingTitle III, Chapter 30, Article I, Section 30.05 of the Lombard Village Code in Regard to Board of Trustees Regular Meeting Agendas An ordinance amending Village Code proving for a manner by which elected officials may place items onto a Village Board agenda. This Ordinance was passed on second reading on the Consent Agenda Enactment No: Ordinance 8337 Resolutions J. 250036 16 S. Park Avenue; Punky’s Pub Old Style Sign - Request for Historical Sign Designation Finding of Fact from the February 11, 2025 Public Hearing meeting, that the sign at 16 S. Park Avenue meets the criteria for designation as a historical sign. (DISTRICT #1) This Resolution was adopted on the Consent Agenda Enactment No: R 13-25 K. 250094 Lombard Meadows - Phase IV, Resident Engineering Services Approving a contract with Thomas Engineering Group of Oak Brook, Illinois an amount not to exceed $409,573.84 for Resident Engineering Services. This selection was made from the current Resident Engineering Short List, which consists of five (5) firms. (DISTRICT #6) This Resolution was adopted on the Consent Agenda Enactment No: R 14-25 Other Matters L. 250093 Gasoline and Diesel Fuel Purchase Request for a waiver of bids and award of a contract to Al Warren Oil Company, Inc. of Hammond, Indiana. The price for gasoline is the low rack average daily OPIS price plus (0.045) per gallon for delivery. The price for diesel is the low rack average daily OPIS price plus (0.045) per gallon for delivery. This purchase will be made through a joint fuel purchase (DuPage County Bid #23-011-FM). The terms of the contract allows local municipalities to extend the contract for two additional one-year periods. This contract extension would be the second of three extensions possible under the current contract terms. This Bid was approved on the Consent Agenda M. 250096 Lombard Meadows - Phase IV Project Award of a contract to John Neri Construction, Inc. of Addison, Illinois, the lowest responsible bidder of three (3) bids received, in the amount of Village of Lombard Page 6 Village Board of Trustees Minutes March 6, 2025 $3,598,123.35. The Lombard Meadows - Phase IV project area involves the reconstruction of Hawthorne Circle and Cherry Lane, South of Magnolia Circle to East Wilson Avenue. (DISTRICT #6) This Bid was approved on the Consent Agenda N. 250019 Local Tourism Grant Application 2025 - Lombard Cycling Classic Recommendation from the Community Promotion & Tourism Committee to approve a grant request from the Prairie State Cycling Series, LLC in the amount of $10,000 plus Village services from Hotel/Motel funds for expenses related to the fees associated with the event. The event is scheduled to take place on July 22, 2025. (DISTRICT #1) This Request was approved on the Consent Agenda O. 250020 Local Tourism Grant Application 2025 - Food Truck Social Recommendation from the Community Promotion & Tourism Committee to approve a grant request from the Lombard Historical Society in the amount of $4,075 from Hotel/Motel funds to cover the costs of entertainment for the Food Truck Social on Maple Street. The event is scheduled to take place on September 6, 2025. This Request was approved on the Consent Agenda P. 250021 Local Tourism Grant Application 2025 - Spooktacular Recommendation from the Community Promotion & Tourism Committee to approve a grant request from the Lombard Area Chamber of Commerce in the amount of $10,000 inclusive of Village Services from Hotel/Motel funds to cover the costs of Waste Management, Village Services, and non-funded activities. The event will take place on October 19, 2025. This Request was approved on the Consent Agenda Q. 250022 Local Tourism Grant Application 2025 - Candy Cane Lane Holiday Market Recommendation from the Community Promotion & Tourism Committee to approve a grant request from the Lombard Area Chamber of Commerce in the amount of $2,000 plus Village Services from Hotel/Motel funds to cover the cost of blocking off South Park Avenue between St. Charles Road and Michael McGuire Drive and the costs of patio heaters and street decorations. The event will take place on December 6, 2025. (DISTRICT #1) This Request was approved on the Consent Agenda R. 250057 Illinois Municipal League Membership Request for approval of the Village Board for Village participation in the Illinois Municipal League for FY 2025 in the amount of $2,500.00. Village of Lombard Page 7 Village Board of Trustees Minutes March 6, 2025 This Request was approved on the Consent Agenda S. 250076 Historic Preservation Commission - 2024 Annual Report Request from the Lombard Historic Preservation Commission that the Village Board acknowledge receipt of the LHPC 2024 Annual Report. This Request was approved on the Consent Agenda T. 250088 Recommendation of Proposed Three (3) Year Waterfall Suspension to the Pension and Economic Development Fund Reserves Recommendation from the Finance & Administration Committee to suspend the Waterfall to the Pension & Economic Development Fund Reserves for three years (2024-2026) to prioritize funding of the Building Reserve Fund for construction of a new Public Safety Building. This Request was approved on the Consent Agenda U. 250100 Agreement with Lombard Firefighters' Union , Local 3009 of International Association of Firefighters, AFL-CIO, CLC Approving an Agreement between the Village of Lombard and the Lombard Firefighters' Union Local 3009 of International Association of Firefighters, AFL-CIO, CLC which will run from January 1, 2026 through December 31, 2028. Items for Separate Action Ordinances on First Reading (Waiver of First Requested) A. 250089 Recommendation of Proposed $1 Million Transfer from the Hotel/Motel Tax Fund to the Building Fund and An Ordinance Amending the Village's Fiscal Year 2025 Budget to Account for the $1 Million Transfer of Funds. Waiver of first reading is requested. (2/3 vote of Corporate Authorities required, 5 of 7) Recommendation from the Finance & Administration Committee to transfer $1 million from the Hotel/Motel Tax Fund to the Building Fund for Village of Lombard Page 8 Village Board of Trustees Minutes March 6, 2025 construction of a new Public Safety Building. The motion carried by the following vote: Aye: 5- Brian LaVaque, Anthony Puccio, Bernie Dudek, Dan Militello, and Bob Bachner Absent: 1- Keith Giagnorio Enactment No: Ordinance 8338 Other Ordinances on First Reading Ordinances on Second Reading Resolutions Other Matters B. 250018 Local Tourism Grant Application 2025 - Lombard Brew Fest Review of a Local Tourism Grant application from the Lombard Junior Women's Club and Community Promotion and Tourism Committee recommendation in regards to the 2025 Lombard Brew Fest. The event will take place on July 19, 2025. Trustee Bernice Dudek, Chairperson of the Community Promotion & Tourism Committee, made the following statement: This became a little more complicated I think than it needed to be, so I just want to provide a little context. This grant request was presented to the Community Promotions and Tourism Committee on February 4th. After much discussion amongst the committee, it was decided to recommend approving a lesser amount than requested and that motion was approved and forwarded for tonight’s vote. I want to thank my committee for their vigorous conversation and debate regarding this - and all grant requests- that come before us. They take their role seriously and they did their job perfectly acting on their responsibilities as stewards of Lombard’s hotel/motel tax revenue resources. In my role as committee chair, I have a responsibility to support the decisions my committee makes. As trustee, I have a few additional considerations. The Lombard Brew Fest has been a village mainstay with different names for many years and the Lombard Junior Women’s Club has resurrected and responsibly executed it for the past two years, making it one of the Village’s most popular events. The fest may not generate overnight hotel stays like we’d Village of Lombard Page 9 Village Board of Trustees Minutes March 6, 2025 prefer but it definitely brings the community together which is also very important. I initially intended to vote no against this request tonight as a show of solidarity with my committee, but I ultimately decided that does not make sense. The Committee did choose to vote in favor of the event, but for the lesser amount. It is my opinion, after further discussions with the Lombard Junior Women’s Club, fellow trustees, and Village staff that the original request is fair and reasonable. As a reminder, this is the maximum amount we will reimburse after the event and after the expenses have been tallied and submitted to us. There is a very real possibility that the actual expenses will be less than the Lombard Junior Women’s Club is requesting. This year they are requesting $19,000 in village service and funding reimbursements. The request last year was for $17,500. It is a difference of $1,500 and the Lombard Junior Women’s Club has promised that money will be spent to make the event bigger and better than ever. Also, to be perfectly clear the money funding these grants comes from our hotel/motel tax dollars and does not cost our residents anything. And, of course, none of the Village’s funding money will be spent on the purchase of alcohol. Tonight, as a Board, we are obligated to carefully consider the recommendation of my Committee but we are also obligated to consider ultimately what we consider is in the best interests of the Village, as we do with every committee recommendation that appears on our agendas. So, with all that said, I am happy to answer any questions and I am also prepared to make a motion to approve the original request of $19,000.
