CONSENT CALENDAR (1 – 12) 1. 23-51643 Recommendation to authorize City Attorney to submit Stipulations with Request for Award for approval by the Workers’ Compensation Appeals Board, and if so approved, authority to pay $130,282.50 with a life pension thereafter of $85.04 per week subject to COLA increases in compliance with the Appeals Board Order for Craig Carley. Office or Department: City Attorney Suggested Action: Approve recommendation. 2. 23-51644 Recommendation to authorize City Attorney to submit three Stipulations with Request for Award for approval by the Workers’ Compensation Appeals Board, and if so approved, authority to pay 1) $58,290, 2) separate authority to pay $40,020, and 3) separate authority to pay $3,480 in compliance with the Appeals Board Page 1 of 7 CITY COUNCIL AGENDA TUESDAY, JANUARY 9, 2024 411 W. Office or Department: City Attorney Suggested Action: Approve recommendation. 3. 23-51645 Recommendation to authorize City Attorney to submit two Stipulations with Request for Award for approval by the Workers’ Compensation Appeals Board, and if so approved, authority to pay 1) $118,102.50 and also 2) separate authority to pay $30,957.50 in compliance with the Appeals Board Order for Diana Hohman-Aguiar. Office or Department: City Attorney Suggested Action: Approve recommendation. 4. 23-51647 Recommendation to approve the minutes for the City Council meetings of Tuesday, December 12, and December 19, 2023. Office or Department: City Clerk Suggested Action: Approve recommendation. 5. 23-51648 Recommendation to refer to City Attorney damage claims received between December 11, 2023 and December 29, 2023. Office or Department: City Clerk Suggested Action: Approve recommendation. 6. 23-51646 Recommendation to adopt resolution designating the ballot listing of the candidates which have been duly nominated for the City’s Primary Nominating Election on Tuesday, March 5, 2024. (District 2, 4, 6, 8) Office or Department: City Clerk Suggested Action: Approve recommendation. 7. 23-51617 Recommendation to adopt resolution approving the Annual Report for October 1, 2023, to September 30, 2024, for the Belmont Shore Parking and Business Improvement Area, declaring its intention to levy the annual business assessment, and setting the date of hearing for February 13, 2024. OCEAN BOULEVARD CIVIC CHAMBERS, 3:30 PM 8. 23-51618 Recommendation to adopt an updated Disadvantaged Business Enterprise Program and Policy Statement in accordance with Title 49 of the Code of Federal Regulations, Part 26, for projects funded by the United States Department of Transportation – Federal Aviation Administration. (Districts 4, 5) Office or Department: Long Beach Airport Suggested Action: Approve recommendation. 9. 23-51622 Recommendation to authorize City Manager, or designee, to execute all documents necessary to enter into a Reimbursement Agreement with the California Department of Parks and Recreation’s Office of Grants and Local Services through its Outdoor Equity program, to reimburse the City of Long Beach $175,000 in costs to provide an Adventures in Outdoor Education and Exploration Program, for the period of January 1, 2024 to June 30, 2027; and Increase appropriations in the General Grants Fund Group in the Parks, Recreation and Marine Department by $175,000, offset by grant revenue. (District 6) Office or Department: Parks, Recreation and Marine Suggested Action: Approve recommendation. 10. 23-51621 Recommendation to authorize City Manager, or designee, to execute all documents necessary to accept a non-monetary donation of planning, labor, and materials for landscape and lighting improvements to the street medians at East 2nd Street and East Naples Plaza; and, execute a Right-of-Entry Permit, and any related documents, with Naples Island Garden Club, a nonprofit organization, for landscaping improvements, for a term of five years, from January 1, 2024 through December 31, 2028. (District 3) Levine Act: Yes Office or Department: Parks, Recreation and Marine; Public Works Suggested Action: Approve recommendation. 11. 23-51619 Recommendation to receive and file the application of SF Markets, LLC, dba Sprouts Farmers Markets #487, for an original application of an Alcoholic Beverage Control (ABC) License, at 4600 East Pacific Coast Highway; determine that the application serves the Public Convenience and Necessity, submit a Public Notice of Protest to ABC; and direct City Manager to withdraw the protest if a Conditional Use Permit (CUP) is granted.
