MOTION
I HEREBY MOVE that the Council ADOPT the following recommendations in order to effect
settlement in the case entitled Cesar Chavez 888, LLC v. City of Los Angeles, Los Angeles
Superior Court Case No. 24STCP01880. (This litigation concerns a decision on appeal by the
East Los Angeles Area Planning Commission pertaining to a Redevelopment Plan Project
Compliance Review for a 50-unit mixed-use project with five Extremely Low-Income units at 2115-
2125 East Cesar Chavez Avenue and 301-309 North Chicago Street.), SUBJECT TO THE
APPROVAL OF THE MAYOR:
1. AUTHORIZE the City Attorney’s Office to expend up to $173,348.96 in settlement of the
above-entitled matter.
2. AUTHORIZE the City Attorney to pay $170,260.50 for attorneys’ fees plus applicable
interest, and $3,088.46 for costs plus applicable interest, in the above lawsuit, following
a receipt of a Notice of Satisfaction of the attorneys’ fees and costs awarded against the
City.
3. AUTHORIZE the payment of attorney’s fees and litigation costs by drawing demand(s)
from the Liability Claims Fund No. 100/59, Account No. 009798 – Miscellaneous Liability
Payouts. The demand drawn on said fund shall be paid as follows: Jeffer Mangels Butler
& Mitchell LLP Attorney-Client Trust Account in the amount of $173,348.96.
a. $170,260.50 for fees plus applicable interest.
b. $3,088.46 for costs plus applicable interest.
4. AUTHORIZE the City Attorney, or designee, to make necessary technical adjustments,
subject to the approval of the City Administrative Officer, and AUTHORIZE the Controller
to implement the instructions.
This matter was recommended for approval by the Budget and Finance Committee (Yaroslavsky
– Blumenfield – Hutt – McOsker – Hernandez: “Yes”) at its meeting held on October 21, 2025, in
Closed Session as permitted by Government Code Section 54956.9(d)(1).

Telecommunication Relay Services
Telephone communication is one of the most important forms of communication in society today. Due to
advancements in technology, telephone devices have evolved with new services and capabilities. Individuals who are
deaf and hard of hearing, and individuals with a speech disability are following these trends and are rapidly migrating
to more advanced telecommunications methods, both for peer-to-peer and third-party telecommunications relay
service (TRS) communications. Telecommunications Relay Service is a telephone service that allows persons with
hearing or speech disabilities to place and receive telephone calls. TRS is available in all 50 states, the District of
Columbia, Puerto Rico and the U.S. territories for local and/or long distance calls. TRS providers - generally telephone
companies - are compensated for the costs of providing TRS from either a state or a federal fund. There is no cost to
the TRS user.
What forms of TRS are available? There are several forms of TRS, depending on the particular needs of the user and
the equipment available: TRS includes: Text to Voice TIY-Based TRS; Speech-to-Speech Relay Service; Shared Non-
English Language Relay Service; Captioned Telephone Relay Service; Internet Protocol Relay Service; and Video

BASIC CITY COUNCIL MEETING RULES
AGENDAS - The City Council meets Tuesday, Wednesday and Friday at 10:00 A.M. The agendas for City Council
meetings contain a brief general description of those items to be considered at the meetings. Council Agendas are
available in the Office of the City Clerk, Council and Public Services Division, Room 395, City Hall, 200 North Spring
Street, Los Angeles, CA 90012, and on the City's website at lacity.gov or lacouncilcalendar.com.
Ten (10) members of the Council constitute a quorum for the transaction of business. The Council may consider an
item not listed on the agenda only if it is determined by a two-thirds (10) vote that the need for action arose after the
posting of an Agenda. Some items on the agenda may be approved without any discussion, however, any item may
be called "special" by a Councilmember. If an item is called "special" it will be "held" until the remainder of the items on
the Council agenda have been acted on by the Council. An item may also be called "special" if a member of the public
has requested to speak on the item and a public hearing was not previously held.
The City Clerk will announce the items to be considered by the Council, however items will be grouped. For example,
all items for which required public hearings have not previously been held are listed in one section on the printed
agenda. The Council President will ask if any Councilmember or member or the public wishes to speak on one or
more of these items. If anyone wishes to speak on an item, it will be called "special". The remaining items in this
section will be voted on by Council with one roll call vote.
PUBLIC INPUT AT CITY COUNCIL MEETINGS - An opportunity for the public to address the Council on agenda
items for which public hearings have not been held will be provided at the time the item is considered or during the
Multiple Agenda Item Comment period. Members of the public who wish to speak on items shall be allowed to speak
for up to one minute per item up to a total of three minutes per meeting. The Council has determined that a cumulative
total of 20 minutes is a reasonable minimum amount of time for the Multiple Agenda Item segment of each regular
meeting.
The Council will also provide an opportunity for the public to speak on public interest items. Each speaker shall be
limited to one minute of general public comment each regular meeting for a cumulative total of ten (10) minutes. The
Council shall not discuss or take action relative to any general public comment.
If you wish to provide documents to the full Council for consideration on an item, please present the Sergeant-At-Arms
with 35 copies. Otherwise, your materials will simply be added to the official record.

COUNCIL DISCUSSION AND TIME LIMITS - Councilmembers requesting to address the Council will be recognized
by the Council President in the order requested. For any item, the Chairperson of the Committee, or the maker of the
original motion, or the member calling a matter "special" shall have up to six (6) minutes to discuss the item. All other
Councilmembers may speak up to three (3) minutes each on the matter. After all members desiring to speak on a
question have had an opportunity to be heard once, the time for each Member desiring to speak again shall be limited
to a maximum of three (3) minutes.
A motion calling the "previous question" may be introduced by any member during a Council debate. If adopted, this
motion will terminate debate on a matter and the Chair will instruct the Clerk to call the roll on the matter.

VOTING AND DISPOSITION OF ITEMS - Most items require a majority vote of the entire membership of the Council
(8 members). Items which have not been discussed in a Council Committee and have been placed directly on the
agenda will require 10 votes to consider. Once considered, these items will normally require eight (8) affirmative votes
to be adopted. Ordinances require a unanimous vote (at least 12 members must be present) in order to be adopted on
first consideration. If an ordinance does not receive the necessary unanimous vote, it is laid over one calendar week.
The votes required for approval on second consideration vary and depend upon the type of ordinance, but a typical
ordinance requires eight (8) affirmative votes upon second consideration.
When debate on an item is completed, the Chair will instruct the Clerk to "call the roll". Every member present must
vote for or against each item; abstentions are not permitted. The Clerk will announce the votes on each item. Any
member of Council may move to "reconsider" any vote on any item on the agenda, except to adjourn, suspend the
Rules, or where an intervening event has deprived the Council of jurisdiction, providing that said member originally
voted on the prevailing side of the item. The motion to "reconsider" shall only be in order once during the meeting, and
once during the next regular meeting. The member requesting reconsideration shall identify for all members present
the agenda number, Council file number and subject matter previously voted upon. A motion to reconsider is not
debatable and shall require an affirmative vote of eight (8) members of the Council.
When the Council has failed by sufficient votes to approve or reject an item, and has not lost jurisdiction over the
matter, or has not caused it to be continued beyond the next regular meeting, the item is continued to the next regular
meeting for the purpose of allowing the Council to again vote on the matter.
The City Council rules provide that all items adopted by the Council will not be presented to the Mayor, or other
designated officer by the City Clerk until the adjournment of the regular Council meeting following the date of the
Council action. A motion to send an item "forthwith" if adopted by ten (10) votes, suspends these rules and requires
the City Clerk to forward the matter to the Mayor, or other officer, without delay.
RULE 16 MOTIONS - Council Rule No. 16, in part, allows a member to send an item directly to the Council without it
having to go to a Council Committee first, by giving the City Clerk a motion (seconded by an additional member)
during a Council session to be placed on the next regular available Council agenda.

the July 15, 2025 Information Technology Agency (ITA) report,
attached to the Council file.
2. REQUEST the City Attorney to prepare and present an
Ordinance to effectuate said franchise renewal and transfer for

acquisition of the properties located at 1017 and 1023 North Heliotrope
Drive (APN: 5538-019-024) and 1027 North Heliotrope Drive (APN:

Recommendations for Council action, pursuant to Motion (Soto-
Martinez – Hernandez), SUBJECT TO THE APPROVAL OF THE
MAYOR:
1. INSTRUCT the General Services Department (GSD) to initiate
and complete a title search and property appraisal for the
parcels located at 1017, 1023, and 1027 Heliotrope Drive,
including any necessary review documentation, for no more
than $10,000.
2. AUTHORIZE the transfer of up to $10,000 from Council District
13 Public Benefits Trust Fund No. 904 - Affordable Housing sub-

Hutt):
AUTHORIZE the General Services Department and Department of
Recreation and Parks to grant, upon completion of the Bureau of
Engineering’s review and approval, an appropriate use rights
agreement to LANLT for access to the necessary areas at the Watts
Towers Arts Center Campus to perform work needed for the
development of the site in connection with the Watts Tower Arts
Center Campus Project.

GOVERNMENT EFFICIENCY, INNOVATION, AND AUDITS
COMMITTEE REPORT relative to funding from the Innovation Fund
(IF) for the Bureau of Street Lighting (BSL) – 3D Printing for the Public
Right-of-Way Project.
Recommendations for Council action, SUBJECT TO THE APPROVAL
OF THE MAYOR:
1. NOTE AND FILE the City Administrative Officer (CAO) report
dated April 8, 2025, attached to the Council file, relative
to funding from the IF for the BSL – 3D Printing for the Public
Right-of-Way Project.
2. AUTHORIZE the following:

a. The establishment and appropriation of a new
appropriation account entitled BSL – 3D Printing for the
Public Right-of-Way, in the amount of $150,000, within the
IF No. 105/10, from the available cash balance of the IF.
b. The transfer of $150,000 from the IF No. 105/10, BSL –
3D Printing for the Public Right-of-Way, to Fund No.
100/84 as follows: Fund No. 100/84; Revenue Account
No. 008780; Account Name: Street Lighting Improvement
and Supplies; Amount: $150,000.
3. INSTRUCT the BSL to:
a. Separately track all encumbrances and expenditures of
IF monies so that unspent funds can be returned to the
IF at the end of the fiscal year.
b. Report to the Innovation and Performance Commission
(IPC):
i. With an accounting of the funds, the lessons
learned, and any obstacles faced.
ii. If, after the receipt of funds, the scope of the funded
item differs from the scope approved for funding by
the Mayor and the City Council.
c. Include acknowledgment of the IPC on public materials,
as appropriate, such as press releases or websites that
reference the 3D Printing for the Public Right-of-
Way project.
4. AUTHORIZE the BSL to make technical corrections as
necessary to those transactions included in this report to
implement Mayor and Council intentions.
Fiscal Impact Statement: The CAO reports that the recommendation
to note and file this report will have no financial impact. If the Council
approves an allocation of $150,000 to the BSL – 3D Printing for the

Public Right-of-Way project, it would reduce the remaining IF
Balance, which is currently $2,768,922.75. Savings from the IF
Balance may be used to address the current city-wide financial crisis
and the overspending in the 2024-25 Fiscal Year. Additionally, funding
this program may incur unfunded and ongoing costs.
Financial Policies Statement: The CAO also reports that the
recommendation in this report complies with the City’s Financial
Policies.

ENVIRONMENTAL QUALITY ACT (CEQA) FINDINGS, PLANNING
AND LAND USE MANAGEMENT COMMITTEE REPORT, and
RESOLUTION relative to a General Plan Amendment to the Safety
Element to incorporate the most current Local Hazard Mitigation Plan.
Recommendations for Council action:
1. DETERMINE based on the whole of the administrative record,
that the Project is exempt from CEQA pursuant to Public
Resources Code Section 21080(b)(1) and CEQA Guidelines
Section 15308 (Class 8) and there is no substantial evidence
demonstrating that an exception to a categorical exemption
pursuant to CEQA Guidelines Section 15378(b)(5), the Project
is not a “project” as defined by CEQA.
2. ADOPT the FINDINGS of the Los Angeles City Planning
Commission (LACPC) as the Findings of Council.
3. ADOPT the accompanying RESOLUTION, as recommended by
the Mayor and the LACPC, approving the General Plan
Amendment to the Safety Element to incorporate the most
current Local Hazard Mitigation Plan, pursuant to City Charter
Section 555 and Chapter 1A, Section 13B.1.1 of the Los
Angeles Municipal Code.

sensitive biological resources at Ken Malloy Harbor Regional
Park and the Harbor City Waterway, including designating both
as Environmentally Sensitive Habitat Areas as prescribed under
the California Coastal Act.

CD 5 CATEGORICAL EXEMPTION FROM THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO CEQA
GUIDELINES, ARTICLE 19, SECTION 15332, CLASS 32, AND
RELATED CEQA FINDINGS; COMMUNICATION FROM THE LOS
ANGELES CITY PLANNING COMMISSION (LACPC); AND AN
APPEAL filed by Eva Nathanson (Representative: Andrew Sachs),
from the determination of the LACPC in: 1) approving a Density
Bonus/Affordable Housing Incentive Program Determination, pursuant
to Chapter 1 Section 12.22 A.25(g) of the Los Angeles Municipal Code

proposed project is comprised of a six-story, 69-foot in height mixed-
use building, with two subterranean parking levels, the Project includes
96 automobile parking spaces on-site within two subterranean levels,
94 bicycle parking spaces (78 long-term and 16 short-term), and 7,840
square feet of open space, there are three existing street trees in the
public right-of-way adjacent to the project site, the Project will maintain
three existing street trees and plant three new Street Trees and 20

RESOLVE to include in the City’s 2025-26 State Legislative Program
SUPPORT for SB 84 (Niello) to clarify the notice requirements of
disability access-related complaints, allow defendants an opportunity
to fix any barriers to access, and prevent the filing of fraudulent
accessibility-related complaints in California.

COMMITTEE REPORT and RESOLUTION relative to establishing the
City’s position on Assembly Bill (AB) 1088 (Bains) which would add
kratom products containing 7-hydroxymitragynine to the Sherman
Food, Drug, and Cosmetic Law.
Recommendation for Council action, pursuant to Resolution (Padilla –
McOsker), SUBJECT TO THE CONCURRENCE OF THE MAYOR:
