Northwest (RISNW).

Council President Coelho presented a proclamation honoring Mayor
Frizzell.

11. APPROVAL OF MINUTES
Moved by Councilmember Decker to approve the minutes of the November 10,
2025, City Council Business Meeting, the November 17, 2025, City Council Work
Session, the November 19, 2025, Finance Committee Meeting, the November
19, 2025, City Council Work Session, the November 24, 2025, City Council
Business Meeting, and the December 1, 2025, City Council Work Session.
Motion Passed.
12. UNANIMOUS CONSENT AGENDA
Councilmember Decker requested the removal of item 12.C, Councilmember
Hurst requested the removal of item 12.D from the Consent Agenda for separate
discussion.
The following items were approved by unanimous consent:
12.A Voucher Approval
Approve claims in the amount of $3,408,774.5 for the period of November
17, 2025, through November 30, 2025. Approve payroll in the amount of
$1,738,353.50, dated November 26, 2025.
12.B 3551 Prosecuting Attorney Contract Increase
Approve the request to increase the monthly contract rate to $67,468.00,
in order to retain prosecuting attorney services.
12.E Reappointment of Planning Commissioners
Reappoint Matthew Cail (position 2) and Dorina Katro (position 3) to the
Planning Commission for a term expiring December 31, 2029.
12.F AXON Contract Renewal
Approve the contract with AXON and authorize use of funds from Fund
105 in the amount of $86,264.63 to cover the cost of the first year on the
contract in 2026.
12.G Reappoint Human Services Commission Member
Reappoint Vanessa Villavicencio (position 1) to the Human Services
Commission for a new term expiring December 31, 2028.
12.H Contract Supplement: Connecting Lynnwood Poplar Way Bridge
Authorize the Mayor to enter into and execute on behalf of the City, a
contract supplement of $1,250,000.00, with Perteet, Inc. for construction
engineering support services related to the Connecting Lynnwood: Poplar
Way Bridge project, in an amount not to exceed a total contract value of
$6,844,978.00.
12.I Contract: Connecting Lynnwood Poplar Way Bridge – Puget Sound
Energy
Authorize the Mayor to enter into and execute on behalf of the City, a
contract with Puget Sound Energy for utility relocation services related to
the Connecting Lynnwood: Poplar Way Bridge project, in an amount not to
exceed a total contract value of $125,000.00.

12.C Reappoint Lodging Tax Advisory Committee Member
Reappoint Leilani Wainui Kamala (position 3) to the Lodging Tax Advisory
Committee (LTAC) for a one-year term expiring December 31, 2026.
Motion Passed.
12.D Council Ratification of Successor AFSCME Collective Bargaining
Agreement
Approve ratification of AFSCME Collective Bargaining Agreement (CBA),
and authorize the Mayor to sign the CBA.

Leutwyler Joshua Binda, Patrick Decker
Voting Against: Derica Escamilla

13 BUSINESS ITMES AND OTHER MATTERS
Councilmember Coelho moved to add item 13.F Animal Code Ordinance to the
agenda.
Motion Passed.
Council President Coelho moved to extend the meeting to the end of the agenda.

13.A Ordinance: Permit Services Fee Update
Councilmember Coelho moved to adopt ordinance 3502, an ordinance of
the City Council of the City of Lynnwood, Washington, relating to fees
charged by the City, amending LMC 3.104.080, LMC 3.104.090, LMC
3.104.120, LMC 3.104.130, LMC 3.104.140, LMC 3.104.150, LMC
3.104.160, and LMC 3.104.170, and providing for an effective date,
severability and summary publication.
Voting For: Robert Leutwyler, David Parshall, Nick Coelho, Joshua
Binda
Voting Against: Derica Escamilla, George Hurst, Patrick Decker
Motion Passed 4-3
13.B Ordinance: Business License Fee Update
Councilmember Coelho moved to adopt ordinance 3503, an ordinance of
the City Council of the City of Lynnwood, Washington, relating to fees
charged by the City, amending LMC 3.104.050 and providing for an
effective date, severability and summary publication.
Voting For: Nick Coelho, Robert Leutwyler, Derica Escamilla
Joshua Binda
Voting Against: Patrick Decker, George Hurst, David Parshall

13.C Ordinance: 2026 Salary Schedule
Councilmember Decker moved to adopt ordinance 3504, an ordinance of
the City Council of the City of Lynnwood, Washington, relating to
classification and compensation of city employee positions, providing for
severability; establishing an effective date; and providing for summary
publication.
Voting For: Robert Leutwyler, George Hurst, David Parshall, Nick
Coelho, Joshua Binda, Derica Escamilla, Patrick Decker
Voting Against: None

13.D Resolution: Public Safety Sales Tax Measure
Councilmember Coelho moved to adopt resolution 2025-09, a resolution
of the City of Lynnwood, Washington, authorizing the Mayor to take all
steps necessary to prepare an ordinance or resolution for Council
consideration that imposes a sales tax of one-tenth of one percent as
authorized by engrossed substitute House Bill 2015, adopted by the State
Legislature on April 22, 2025, and effective July 27, 2025.
Voting For: Nick Coelho, David Parshall, Patrick Decker, George
Hurst, Robert Leutwyler
Voting Against: Joshua Binda, Derica Escamilla

13.E Council Vacancy Procss
Councilmember Decker moved to direct the City Clerk to distribute and
publish a notice of the vacancy and the deadline for applying for the
vacant City Council position number six.
Motion Passed.
13.F Animal Code Ordinance
Councilmember Coelho moved to adopt ordinance 3505, an ordinance of
the City Council of the City of Lynnwood, Washington, amending sections
of Lynnwood Municipal Code title 6 “Animals”, providing for severability;
establishing an effective date; and providing for summary publication
Councilmember Escamilla moved to amend 6.02.015 section 2 to
remove “on property not belonging to the owner” to

Councilmember Escamilla moved to amend section 6.02.023
definition of 2.E to remove, “The top of such fence shall be at least
six feet in height as measured from the ground level, unless there is
a secured top – full enclosure – to the fenced-in area, and that such
fence or enclosure area shall comply with all applicable city codes.
For purposes of this section, a dog solely under voice and/or signal
control shall be considered to be “physically unrestrained.” Violation
of this subsection shall constitute a misdemeanor, and may be
punished by a fine not to exceed $1,000 or imprisonment in jail not
to exceed 90 days, or both such fine and imprisonment.”

After discussion and failed amendments, the following motion was
adopted:
Councilmember Coelho moved to adopt ordinance 3505, an ordinance of
