Call to Order Mayor Smith called the meeting to order at 6:04 p.m. The invocation was led by Pastor David Anderson from Be Community Church, which was followed by the Pledge of Allegiance led by Vice Mayor Wade. 2. Roll Call Present: 6 - Mayor Nancy Smith, Vice Mayor Henry Wade, Councilmember Eric Goettl, Councilmember AnnaMarie Knorr, Councilmember Vincent Manfredi and Councilmember Bob Marsh Excused: 1 - Councilmember Amber Liermann 3. Proclamations, Acknowledgements, Awards and Presentations No proclamations, acknowledgements, awards, or presentations were given. 4. Report from the Mayor 5. Report from the City Manager 6. Call to the Public Terry Yoshii, a resident of the Lakes subdivision, expressed concerns about E. coli bacteria found in the drinking water the previous week. He requested a full investigation into what happened, why notifications weren't sent out promptly, and what actions were being taken by Global Water and the City Council. Mr. Yoshii was referred to Andrew Miller, Global Water Manager, for any further discussion. Dr. John and May announced the 18th annual Kids Day Maricopa event scheduled for September 20 from 10:00 a.m. to 4:00 p.m at Maricopa Wells Middle School. The free event focuses on health, safety, and environmental awareness for children, featuring 100 activities, free food and drinks, and giveaways including bicycles. They highlighted participation from various community organizations including 4-H club, Electrical District 3, Global Water, the CERT program, fire department, police department, and Phoenix Children's Hospital. They also announced the third annual Maricopa Police City of Maricopa Page 1 City Council Regular Meeting Meeting Minutes - Final September 2, 2025 Foundation golf tournament on September 27 at the Duke. Ocean Kent from Ocean Industries announced the upcoming event called Boots on the Ground, 10 Toes Down Cancer Walk scheduled for November 15 at Copper Sky. The event will include free breast exams by Simon Med and prostate cancer testing by Cancer Care. Ms. Kent thanked Council Member Amber Liermann for sponsoring the event and Councilmember Eric Goettl for connecting them with committees. Ms. Kent mentioned several sponsors including the UPS Store, Nekter Juice Bar, Fry's Grocery Store, and Silk Press Express, and encouraged community participation to support cancer survivors, caregivers, and those who have lost loved ones to cancer. Rich Vitiello, Pinal County Supervisor, warned about state representatives' efforts to remove local planning and zoning authority from cities throughout Arizona. He expressed opposition to this initiative and urged cities to work together to prevent it, like the advocacy efforts for State Route 347. He mentioned that some state representatives were unfamiliar with Maricopa's population and transportation challenges yet wanted authority over local planning and zoning decisions. He pledged to work with all 15 counties to oppose this state intrusion into local governance. 7. Consent Agenda Approval of the Consent Agenda A motion was made by Councilmember Manfredi, seconded by Councilmember Marsh to Adopt the Consent Agenda. 7.1 RES 25-36 The Mayor and City Council shall discuss and take action to approve the 2025 Public Transit Agency Safety Plan, which is related to Section 5307 transit funding. Discussion and Action. This Resolution was Approved. 7.2 SUB25-12 The Mayor and City Council shall discuss and take action to approve Subdivision Case # SUB25-12, Anderson Farms Phase 2, a Re-Plat of Anderson Farms Phase 2, Fee No. 2024-093279. Discussion and Action. This Subdivision was Approved. 7.3 RES 25-33 A Resolution of the Mayor and City Council of the City of Maricopa, Arizona, designating the City's authorized representative for purposes of the grant received from the Arizona Department of Emergency and Military Affairs (AzDEMA) for the Desert Sunrise High School Box Culvert project. Discussion and Action. This Resolution was Approved. 7.4 RES 25-34 A Resolution of the Mayor and City Council of the City of Maricopa, Arizona, accepting public improvements and maintenance responsibility for the collector roads within the Moonlight subdivision Phase 1B, into the City Street/Road Maintenance System. Discussion and Action. This Resolution was Approved. 7.5 RES 25-35 A Resolution from the Mayor and City Council of Maricopa, Arizona, adopting a revised fee schedule for the Development Services Department. Discussion and Action. City of Maricopa Page 2 City Council Regular Meeting Meeting Minutes - Final September 2, 2025 This Resolution was Approved. 7.6 MIN 25-51 Approval of Minutes from the August 5, 2025 City Council Regular meeting. Discussion and Action. These Minutes were Approved. 7.7 RES 25-39 A Resolution of the Mayor and City Council of the City of Maricopa, Pinal County, Arizona, confirming the application for certificate of necessity subsequent to changes necesitated by substantive review by the Arizona Department of Health Services. Discussion and Action. This Resolution was Approved. 8. Regular Agenda and/or Public Hearings 8.1 APP 25-05 The Mayor and City Council shall discuss and take action on making an appointment to fill the vacancy on the Cultural Affairs and Arts Advisory Committee. Discussion and Action. Councilmember Goettl thanked Peg Chapados for her service on the Cultural Affairs and Arts Advisory Committee and nominated Mark Ellsworth to fill the vacancy. He shared that Mr. Ellsworth is an award-winning theater director, production manager, and writer who has lived in Maricopa for seven years. Councilmember Goettl added that Mr. Ellsworth holds a bachelor's and master's in theater and is the founder of Actors Youth Theater serving the East Valley for over 23 years and currently teaches advanced drama at Heritage Academy in Maricopa. Lastly, Mr. Ellsworth was present and acknowledged by the Council. A motion was made by Councilmember Goettl, seconded by Councilmember Manfredi, that this Appointment be Approved. The motion carried by a unanimous vote. 8.2 RES 25-38 A resolution of the Mayor and City Council of the City of Maricopa, Arizona, adopting a Bed Tax Policy related to the allocation and expenditure of the hotel/motel additional tax revenue in compliance with A.R.S. §9-500.06 and pursuant to the strategic priorities of the city. Discussion and Action. Assistant City Manager Jennifer Brown presented the proposed Bed Tax Policy outlining how the city would meet strategic priorities and comply with state law regarding bed tax revenue. She explained that the policy addresses two strategic priorities: investing in public art projects and experiences and employing a sports and events tourism strategy. Discussion ensued regarding other cities’ usage of their bed tax and how this proposed policy designates all 5.5% of the bed tax to arts and tourism initiatives. Ms. Brown noted that the annual budget for these funds will be recommended to Council during the annual budget process, and any unused funds will carry forward to future fiscal years. Councilmember Knorr expressed interest in surveying the community about bed tax uses and having strategic conversations about long-term investment in these funds, especially as the amount increases with new hotels. She added that while the city is only required to use $171,000 for tourism purposes, there are many potentials uses for these funds. Lastly, Mayor Smith suggested including this in the January 2026 futures planning session. City of Maricopa Page 3 City Council Regular Meeting Meeting Minutes - Final September 2, 2025 Councilmember Marsh suggested potentially adding a section on tourism strategy to the general plan update, if not this year, then in the future. Lastly, Vice Mayor Wade agreed with Councilmember Knorr's request and emphasized the importance of engaging community organizations in conversations about bed tax allocation. A motion was made by Vice Mayor Wade, seconded by Councilmember Manfredi, that this Resolution be Approved. The motion carried by a unanimous vote. 9. Executive Session No executive session was held. 10. If you wish to speak on a matter concerning Maricopa city government that is on the agenda, please fill out a speaker card and give it to the City Clerk before the meeting starts. The Mayor will call your name when that portion of the agenda is reached. The Call to the Public portion on the agenda provides citizens an opportunity to identify for the City Council matters of interest or concern related to city government that are not on the printed agenda. Under the provisions of the Arizona Open Meeting Law, the City Council is prohibited from responding to issues that have not been properly noticed. Therefore, the City Council may only listen to citizens who wish to address them on non-agenda items. We regret that the City Council cannot respond beyond thanking you for your comments. City staff will follow-up on your questions via telephone or email, whichever is preferred. A speaker card is not required for this portion of the meeting but it is appreciated. Whenever any group of persons wishes to address the City Council on the same subject matter, it shall be proper for the Mayor to request that a spokesperson be chosen. The City asks that, when your name is called, you come forward to the podium, state your name and then begin speaking. All speakers are expected to observe common standards of decorum and courtesy. Personal attacks, political speeches, or threats of political action are inappropriate in this forum and will be grounds, at the discretion of the Mayor, for ending a speaker's time at the podium. In the event that the meeting is disrupted in any way that the City in its sole discretion deems inappropriate, the City reserves the right to immediately remove the individual(s) from the meeting. Reasons for removing an individual include but are not limited to making offensive remarks or statements, disrespectful statements or actions, and any other action deemed appropriate. All remarks shall be addressed to the City Council as a body and not to staff or the public. No person other than a member of the City Council, the City Manager or the City Attorney and the person having the floor, shall be permitted to enter into any discussion without the permission of the Mayor. Depending on the number of items on the Council agenda and the number of speaker cards submitted, the Mayor may establish shorter time limits for speakers. Call to the Public The procedures to follow if you address the Council are: Council requests that you express your ideas in three minutes or less and refrain from any personal attacks or derogatory statements about any City employee, a fellow citizen, or anyone else, whether in the audience or not. The Mayor will limit discussion whenever they deem such an action appropriate to the proper conduct of the meeting. At the conclusion of an open call to the public, individual members of the Council may respond to criticism made by those who have addressed the Council, may ask Staff to review a matter, or may ask that a matter be put on a future agenda. However, members of the Council shall not discuss or take legal action on any matters during an open call to the public unless the matters are properly noticed for discussion and legal action. Finally, a word on decorum at our meetings. Periodically, we may want to applaud a success or show our approval of a comment and occasionally, we may personally disagree with something that is said. However, when we’re hearing input from our City Council and our residents, whether we support their comments or disagree with their comments, please do not applaud or negatively respond to a speaker unless invited to do so by the presiding authority. It is important that every person who addresses the City Council has a right to speak and not be intimidated. 7.
