MINUTES Town of Mooresville Planning Board February 24, 2026 6:00 PM - Mooresville Town Hall Present: Michael Cole, Steve McGlothlin, Laura Temple, Gregory Peretz, Jeffrey Mack, Wendy Smith, Mikko Red Arrow Absent: Richard Poore, Jeremy Katz Also Present: Planning & Community Development Director James Coley, Planner III Ashley Lattin, Planner I Patrick Werner, Administrative Assistant Lisa Smith, Assistant Town Attorney Carey Austin 1. Call to Order Chair McGlothlin called the meeting to order at 6:00 p.m. 2. Pledge of Allegiance 3. Chairperson's Welcome and Opening Chair McGlothlin welcomed the Planning Board and Guests. 4. Public Comment There were no public comments 5. Adjustments to the Agenda There were no adjustments to the agenda. 6. Adoption of the Agenda ACTION: A motion was made by Laura Temple, seconded by Mikko Red Arrow to adopt the agenda as presented. The motion carried unanimously 7. Consideration of Approval of Minutes 7.a Consider approval of January 13, 2026, Minutes ACTION: A motion was made by Michael Cole, seconded by Laura Temple to approve the January minutes as presented. The motion carried unanimously. 8. Old Business There was no old business. 9. New Business 9.a Consider a request from Planning & Community Development to adopt an Ordinance for Rezoning Request RZ-2026-02 for a 0.19-acre site located on Williams Street (PIN: 4667376361). Mel Ressler with Habitat for Humanity of the Charlotte Region, Inc is seeking to rezone a parcel from Traditional neighborhood (TN) to Residential General (RG) for a 0.19-acre site located on Williams Street, PIN 4667376361. The purpose of the request is to allow for a single zoning classification across a proposed development of six duplex dwelling units across three structures. Ashley Lattin presented rezoning RZ-2026-02. Presented on behalf of Habitat for Humanity: Attorney John Floyd Moore & Van Allen 100 N Tryon St., Ste 4700 Charlotte, NC Public Comments There were no public comments ACTION: A motion was made by Mikko Red Arrow, seconded by Jeffrey Mack to approve the Rezoning RZ-2026-02. The motion carried unanimously. 9.b Consider Conditional Rezoning Request CZ-2026-06 for a 0.837-acre site located at 123 Doolie Road (PIN 4637680625). The applicant is requesting Town of Mooresville Conditional Community Commercial (C-CC). Annexation is being sought concurrently. Jacob Einwechter, Vice President of AMBCAR, LLC, is seeking Town of Mooresville Conditional Community Commercial (C-CC) zoning for a 0.837-acre site located at 123 Doolie Road (PIN 4637680625). The subject property is currently zoned Iredell County General Business Conditional Use District (GB CUD). Annexation is being sought concurrently. Patrick Werner presented Conditional rezoning CZ-2026-06 Public Comments There were no public comments Owner/Applicant Mr. Jacob Einwechter 425 Wilcox St Charlotte, NC agreed to 10 Conditions: 1. Permitted Uses: Allowed uses on the site shall be restricted to Personal Vehicle Repair and Maintenance, and any accessory and/or temporary uses otherwise permitted in the district. Any change to a different principal use shall require a new rezoning approval. 2. Traffic Impact: If any future use requires a Traffic Impact Analysis (TIA), such analysis shall occur and all mitigation measures identified shall be completed prior to occupancy. 3. Building Use Restriction: The existing building shall remain in use as a Personal Vehicle Repair and Maintenance facility. Any conversion to a different use shall require rezoning approval by the Town of Mooresville. a. Repair of all vehicles shall occur within an enclosed building. b. Vehicles shall not be parked or stored as a source for parts or for the purpose of sale or lease/rent. c. Vehicles that are repaired and are awaiting removal shall not be stored or parked for more than 30 consecutive days. 4. Building Expansion or Reduction: Any addition to or reduction of the existing building footprint shall require rezoning approval unless classified as a Minor Modification under the UDO. 5. Exterior Modifications: Exterior building modifications that change the structure's footprint, height, or primary facade design shall require Town approval in accordance with the UDO. 6. Noise and Operational Impacts: All operations shall comply with applicable Town noise, lighting, and nuisance regulations to minimize impacts on adjacent properties. 7. Outdoor Storage: Any outdoor storage of vehicles, equipment, or materials shall be limited to areas of impervious coverage as shown on the Annexation Plat. 8. Environmental Compliance: All operations shall comply with state and local environmental regulations related to hazardous materials, oil disposal, and stormwater management. 9. Utilities: Connection to Town water and sewer (if applicable) shall comply with all Town requirements and approved permits. 10. Buffering: The Town will require the installation and maintenance of a Type C 20’ landscape buffer to the southern property boundary to buffer against the residential property, in accordance with the UDO. ACTION: A motion was made by Michael Cole, seconded by Wendy Smith to approve the Conditional Rezoning RZ-2026-02. Motion carried unanimously. 9.c Consider a request from the Planning and Community Development Department to adopt an Ordinance approving Text Amendment TA-2026-01: Amendment to the Unified Development Ordinance (UDO) revising language related to CBD, Vape, and/or Tobacco Shop definitions and use standards. Adjournment ACTION: A motion was made by Mikko Red Arrow, seconded by Gregory Peretz to adjourn the meeting at 6:33 p.m. Motion carried unanimously.
