Adoption of the Agenda ACTION: A motion was made by Michael Cole, seconded by Jeremy Katz, to adopt the agenda as presented. The motion carried unanimously. 7. Consideration of Approval of Minutes 7.a Consider approval of November 18, 2025, Minutes ACTION: A motion was made by Michael Cole, seconded by Richard Poore, to approve the November minutes as presented. New Business 9.a Consider Conditional Rezoning Request CZ-2025-10 for a 50.28-acre site located along Mecklenburg Highway (PINs 4655042739 and 4655032773). The applicant is requesting Town of Mooresville Conditional Corridor Mixed Use (C-CM). The property owners are seeking Town of Mooresville Conditional Corridor Mixed-Use (C-CM) zoning for a 50.28-acre site located along Mecklenburg Highway (PINs 4655042739 and 4655032773). The property is currently zoned Town of Mooresville Corridor Mixed-Use (CM) and Residential Low Intensity (RLI). James Coley presented conditional rezoning CZ-2025-10. RECESS: 7:03 p.m. RESUMED: 7:14 p.m. Robert (Bob) Bennett Senior VP of Land for Prestige accepted the following 11 conditions: 1. Site development shall conform to the approved Concept Plan. Any modifications post- approval shall be consistent with UDO 2.5.4.C.8.b, “Minor Modifications.” 2. Allowed uses on the site shall be restricted to single family attached residential development, and any accessory and/or temporary uses otherwise permitted in the Corridor Mixed Use district, respectively. 3. If any use or uses require a Traffic Impact Analysis, such analysis shall occur and all mitigations as identified in the Mitigations Measures shall be completed. 4. Residential development to have a maximum density per acre of 4.34 units, or 218 units. 5. A 12 foot wide multi-use path of approximately 2,100 feet in length, known as the Seam Trail, is to be constructed and dedicated to the Town along the property frontage on NC Highway 115. Prior to the Town’s acceptance of streets and multi-use paths, the developer or HOA shall be responsible for maintenance of the same. 6. Prior to Town acceptance of streets, developer shall be responsible for maintenance of street trees. Following Town acceptance of streets, the Homeowner’s Association (HOA) shall maintain all street trees located in the public right of way to Town of Mooresville standards. 7. Developer shall complete all mitigation measures recommended by the TIA in accordance with the Mitigation Measures Agreement between the developer and the Town. Mitigation Measures below shall be in place prior to the approval of the first certificate of occupancy (CO). a. Improve Cove Church Driveway (approximately 1,730 feet) to meet Town standards for Collector Street b. Construct Site Access 1 with two-lane cross section with one ingress and one egress (shared left/right turn lane). Provide 100 feet of internal protected stem. c. Construct Site Access 2 with two-lane cross section with one ingress and one egress (shared left/right turn lane). Provide 100 feet of internal protected stem. d. Construct Site Access 3 with two-lane cross section with one ingress and one egress to connect to Mooresville Town Center (Cadia) public street stub to connect to East-West Connector. e. Any and all additional conditions outlined in the Mitigation Measures Agreement that need to be completed if NCDOT does not complete project NCDOT STIP U- 6239 before a Certificate of Occupancy is requested by the Developer. f. Developer shall seek NCDOT approval to install a traffic signal at the intersection of Langtree Road and the current Cove Church driveway and shall install the same by 50% development. Should approval be denied, Developer shall not be required to install said traffic signal. 8. Prior to beginning vertical construction, Developer shall dedicate to Town the two acre parcel designated for conveyance on the concept plan. Upon acceptance by the Town, Developer shall subdivide and convey in fee simple said two acre parcel to Town. All institutional and governmental uses shall be permitted on this two acre property. 9. Developer shall improve the Cove Church Driveway (approximately 1,730 feet) to meet Town standards for Collector Street as agreed in the MMA and will enter an agreement with the owner of said property to require dedication to the Town of the driveway as a public street. 10. Developer shall include within the amenity area a pool and clubhouse for community use. 11. Developer shall set aside five percent (5%) of its units as attainable for renters or purchasers with incomes at or below 120% Area Median Income (“AMI”) and priced at or below the 120% AMI, to be restricted for a period of 10 years. Said units will be constructed in each phase, not concentrated in one area, and be indistinguishable from market rate units. Developer shall enter into an attainable housing agreement and record restrictions for the attainable units as approved by the Planning Director and in accordance with the UDO. ACTION: A motion was made by Michael Cole, seconded by Richard Poore, to adopt the Conditional Rezoning Request CZ-2025-10 with 11 conditions. Motion carried unanimously. 9.b Consider a request from the Planning and Community Development Department to adopt an Ordinance approving Text Amendment TA-2025-08: Amendment to the Unified Development Ordinance (UDO), to remove references to erosion and sediment control from the UDO as the town has adopted a separate erosion and sediment control ordinance, and revise section 2.5.26 “Performance Guarantee” to match best practices. Discussion by Board to request the following changes: Amending D. 4. from “Town” to Planning Director and Public Services Director. Change the word determines to determine for alignment. ACTION: A motion was made by Jeffrey Mack, seconded by Gregory Peretz, to adopt an Ordinance approving Text Amendment TA-2025-08. Motion carried unanimously. 10. Administrative Items 11. Adjournment ACTION: A motion was made by Laura Temple, seconded by Jeffrey Mack, to adjourn the meeting at 7:30 p.m. Motion carried unanimously.
