Call to Order Chair McGlothlin called the meeting to order at 6:00 p.m. 2. Pledge of Allegiance 3. Chairperson's Welcome and Opening Chair McGlothlin welcomed the Planning Board and Guests. 4. Public Comment None 5. Adjustments to the Agenda None 6. Adoption of the Agenda ACTION: A motion was made by Laura Temple, seconded by Jeremy Katz, to adopt the agenda as presented. The motion carried unanimously. 7. Consideration of Approval of Minutes 7.a Consider approval of April 28,2026 Minutes ACTION: A motion was made by Michael Cole, seconded by Laura Temple, to approve the April minutes as presented. The motion carried unanimously. 8. Old Business 8.a Consider Continuance of Conditional Rezoning Request CZ-2026-09 for 11.002- acres located at Unaddressed River Highway (PIN 4638200535). The applicant is requesting Town of Mooresville Conditional Community Commercial (C-CC). Cory Sloan is seeking Town of Mooresville Conditional Community Commercial (C-CC) zoning for 11.002-acres located at Unaddressed River Highway (PIN 4638200535). The subject property is currently zoned Town of Mooresville Corridor Mixed Use (CM). The proposal is to permit the development of a Boat and RV Storage facility. James Coley presented CZ-2026-09. Presented on behalf of the project: Brian Cone, Structural Engineer, Providence Partners Public Comment None Brian Cone agreed to the following four (4) conditions: 1. Site development shall conform to the approved concept plan. Any modifications post-approval shall be consistent with UDO 2.5.4.C.8.b, “Minor Modifications.” 2. Allowed uses on the site shall be restricted to Parking Facility, Retail Sales and Services (Small, Medium, and Large), Boat or RV Storage Yard, Vehicle Storage, Contractor Office, Warehouse and Wholesale Supply. 3. Site Development shall conform to all applicable zoning development standards and use specific requirements, as found in the UDO, Chapter 5 “Development Standards.” 4. Parking Facility, Boat or RV Storage Yard, and Vehicle Storage uses shall only be used within the fenced area as shown on the Concept Plan. ACTION: A motion was made by Michael Cole, seconded by Jeremy Katz, to approve Conditional Rezoning Request CZ-2026-09. The motion carried 8-1. Laura Temple opposed 9. New Business 9.a Consider Conditional Rezoning Request CZ-2025-13 for an 85.951-acre site located at 141 Black Angus Lane (PIN 4655769373). The applicant is requesting Town of Mooresville Conditional Residential General (C-RG). James Martin with AMH is seeking Town of Mooresville Conditional Residential General (C-RG) for 85.951-acres located at 141 Black Angus Lane, PIN: 4655769373. The subject property is currently zoned Town of Mooresville Residential Limited Services (RLS). The purpose of the request is to allow up to 99 single-family dwelling units to be built. Annexation is being sought concurrently. James Coley presented CZ-2025-13. Presented on behalf of the project: Dan Brewer, Bowman Consulting Public Comment Mitchel Oates, Mooresville, NC James Martin, AMH Vice President of Land Development, agreed to 10 Conditions: 1. Site development shall conform to the approved Concept Plan. Any modifications post-approval shall be consistent with UDO 2.5.4.C.8.b, “Minor Modifications.” 2. Residential development to have a maximum density of 1.15 dwelling units per acre or 99 units total. 3. Allowed uses on the site shall be restricted to single family residential development, and any accessory and/or temporary uses otherwise permitted in the Residential General district, respectively. 4. The Developer shall be responsible for the ongoing maintenance of all roads, sidewalks, utilities, stormwater facilities, and any other infrastructure located within the proposed public right-of-way of the development until such time as the Town formally accepts the dedication of said right-of-way and associated improvements. Prior to acceptance, the Developer shall ensure that all improvements are maintained in good working order and safe condition, free of hazards to the public. 5. The Developer shall be responsible for the installation and maintenance of all required street trees within the proposed public right-of-way until such time as the Town formally accepts the dedication of the streets. Following Town acceptance, the long-term maintenance, care, and replacement of all street trees shall be the responsibility of the Homeowners’ Association (HOA), in accordance with the approved landscape plan. 6. If any use or uses require a Traffic Impact Analysis, such analysis shall occur and all mitigations as identified in the Mitigations Measures shall be completed. 7. All required right-of-way dedications and easements, including but not limited to utility, drainage, access, and greenway/shared use path easements, roadway, shall be recorded and in place prior to the issuance of the first Certificate of Occupancy within the development, unless otherwise approved in writing by the Town. 8. A 6 FT screening fence shall be installed along parcels 4655774913 and 4655777910, as requested by the adjacent landowner during the August 26, 2025 Planning Board meeting. The fence shall be constructed in accordance with Town UDO standards and the approved landscape plan to provide effective visual screening between adjacent properties, and maintained by the developer and HOA. 9. A Traffic Signal at the intersection of Faith Road and Shearers Road shall be permitted and constructed per NCDOT standards prior to the first building permit being issued. 10. A parcel encompassing existing community well and associated water supply infrastructure for the Hampshires subdivision shall be dedicated to the Hampshires HOA, Inc. ACTION: A motion was made by Jeffrey Mack, seconded by Laura Temple, to approve Conditional Rezoning Request CZ-2025-13. The motion carried 8-1. Mikko Red Arrow opposed 9.b Consider Conditional Rezoning Request CZ-2026-05 for a 15.08-acre site located at Unaddressed Rocky River Road (PIN 4665981143). The applicant is requesting Town of Mooreville Conditional Residential General (C-RG). RBM Skyline Investors, LLC is seeking Town of Mooresville Conditional Residential General (C-RG) for a 15.08-acre site located at Unaddressed Rocky River Road, PIN 4665981143. The subject property is currently zoned Town of Mooresville Residential Limited Services (RLS). The purpose of the request is to allow up to 38 single-family dwelling units to be built. Annexation is being sought concurrently. Ashley Lattin presented CZ-2026-05. Presented on behalf of the project: Micheal Barnes, RBM Skyline Development Public Comment Scarlett Inman, Mooresville, NC Alex Morgan, Mooresville, NC Richard Beck, Mooresville, NC Micheal Barnes asked for CZ-2026-05 to be continued. ACTION: A motion was made by Michael Cole, seconded by Jeremy Katz, to continue Conditional Rezoning Request CZ-2026-05. The motion carried unanimously. 9.c Consider a request from the Planning and Community Development Department to adopt an Ordinance approving Text Amendment TA-2026-02: Amendment to the Unified Development Ordinance (UDO) to add a use and use standards for Supportive Housing Development.
