Minutes Town of Mooresville Planning Board October 22, 2024 6:00 PM - Mooresville Town Hall Present: Chair Steve McGlothlin, Rosalind Campbell, Laura Temple, Gregory Peretz, Shaun Hooper, Michael Cole, Mark Brady, Jeremy Katz, and Michelle Marckwardt. Also Present: Planning & Community Development Director Erika Martin, Planners Sandy Howell and Rayvon Walker, Assistant Town Attorney, Carey Austin, and Planning Board Clerk Danielle Upright. 1. Call to Order Chair Steve McGlothlin called the meeting to order at 6:00 p.m. 2. Pledge of Allegiance 3. Chairperson's Welcome and Opening Chair McGlothlin welcomed the Planning Board and guest then opened the meeting. 4. Public Comment None 5. Adjustments to the Agenda Erika Martin presented the changes to the agenda. The schedule was adjusted for the agenda items listed below: 1. CZ-2024-13 will now be item 9a 2. CZ-2023-03 will now be item 9b 3. RZ-2024-09 will now be item 9c 4. TA-2024-08 will now be item 9d ACTION: A motion was made by Mark Brady seconded by Rosalind Campbell to approve the adjustment to the agenda as presented by Ms. Martin. The motion carried unanimously. 6. Adoption of the Agenda ACTION: A motion was made by Jeremy Katz seconded by Shaun Hooper to adopt the agenda. The motion was carried unanimously. 7. Consideration of Approval of Minutes 7. a Consider Minutes of August 27, 2024, and September 24, 2024, ACTION: A motion was made by Jeremy Katz seconded by Shaun Hooper to approve the minutes as presented. The motion was carried unanimously. 8. Old Business None 9. New Business 9.a. Consider Conditional Rezoning Request CZ-2024-13 for a 15.35-acre site located on Langtree Road (Cascadia). The property owners are seeking Conditional Traditional Neighborhood (C-TN) for a 15.35-acre site located on Langtree Road (PIN 4645337074). The property is currently zoned Residential Limited Services (RLS). Town Planner Sandy Howell presented the staff report. Mrs. Howell stated there was a neighborhood meeting held on August 14th with 15 neighbors in attendance. Those in attendance expressed opposition to the proposed development because of the pedestrian connection to Pin Oak Lane and potential concerns over lake access. The proposed concept plan shows a density of 5.08 DUA which is less than the maximum of 10 DUA in Traditional Neighborhood. The concept plan also shows two access points and at minimum one pedestrian connection. A Traffic Impact Analysis was completed on October 7, 2024, which identified no requirements from the developer. Mrs. Howell noted some highlighted conditions for the proposed development, those conditions include: A restriction to single-family attached residential units and accessory use, siding materials will be brick, stone, block, or wood (vinyl siding will be prohibited), and the open space will include a required public waterfront access overlook. Mrs. Howell stated that the staff does recommend approval of CZ-2024-13. Representatives for Mattamy Homes presented the proposed development. The motion carried with an 8-1 vote. 9. b Consider Conditional Rezoning Request CZ-2023-03 for a 54.478-acre site located at 1304 Oakridge Farm Highway. The applicant is requesting Conditional Residential Low Intensity (C-RLI) zoning. The property owner is seeking the Town of Mooresville Residential Low Intensity with Conditions (C-RLI) for a 54.478-acre site located at 1304 Oakridge Farm Highway (Courtyards at Brumley Farm) (PIN 4677457688). The property is currently zoned Iredell County Residential Agricultural (RA) and Neighborhood Business (NB). Town Planner Rayvon Walker presented the staff report to the board. Mr. Walker stated that the original rezoning request was denied by the Board of Commissioners on August 7, 2023. The original has since been amended, and the Town Board approved a waiting period waiver sought by the applicant on July 1, 2024. Mr. Walker did a brief overview of the property stating that it is currently zoned in Iredell County as Residential Agricultural (RA) and Neighborhood Business (NB). The total number of units allowed by right at 95 and an annexation/utility extension is being sought concurrently with this request. The request from the applicant is to rezone conditionally to Residential Low Intensity (C-RLI) zoning and the total number of units being proposed is 108. A neighborhood meeting was held on July 2, 2024, with 4 neighbors being in attendance. None of the 4 neighbors were opposed to the proposed development. The proposed concept plan includes 108 single-family dwellings at a density of 1.98 dwelling units per acre. This development will house the following amenity features: A pool, pickleball courts, community gathering spaces with paved walkways, benches, and picnic tables. The concept plan shows two access points to the development, one full movement access on Oakridge Farm Hwy, and the secondary will be emergency access on Landis Hwy. Mr. Walker stated that a Traffic Impact Analysis was conducted and completed with 3 mitigation measures required. 1. The construction of a designated right-turn lane on NC 150. 2. The construction of a designated left turn lane on NC 150. 3. The installation of a traffic signal at the intersection of NC 150 and Wiggins Road. Mr. Walker presented a traffic condition that the developer has agreed upon that states there will be a new U-turn bulb on Landis Highway between Brumley Road and Teeter Road. The U-turn bulb will be o.76 miles from the proposed emergency access on Landis Hwy. There is currently no timing commitment on the installation of the U-turn bulb, which is a concern with the town staff. Mr. Walker stated that staff recommends approval of CZ-2023-03 located at 1304 Oakridge Farm Hwy. Citizens signed up to speak on CZ-2024-13: • Scott Ross 146 Quiet View Drive • Bryan Burroughs-168 Alexander Acres Road. • Charles Minich-149 Quiet View Drive ACTION: A motion was made by Jeremy Katz seconded by Laura Temple to recommend approval to the town board for CZ-2023-03, with the added condition to require the U-turn bulb after completion of the 45th Certificate of Occupancy. The motion carried with a 7-2 vote. 9. c Consider Rezoning Request RZ-2024-09 for a 399.25-acre site located on Patterson Farm Road. The request is to rezone from Iredell County Residential Agricultural (RA) to the Town of Mooresville Industrial (IN) Earnhardt Farms, LLC. is seeking Town of Mooresville Industrial (IN) zoning for a 399.25-acre site located on Patterson Farm Road (PINs 4674663977, 4674783311, 4674965019, 4684250452). The site is currently zoned Iredell County Agricultural (RA). Mrs. Howell presented the staff report to the board and gave an overview of the project. The project is located on Patterson Farm Road and is owned by Earnhardt Farms, LLC. The rezoning request is for 399 acres, with a current district in Iredell County as Residential Agricultural. 693 single-family detached homes are allowed by right. The applicant requested a rezoning to Town Industrial. Mrs. Howell stated that the staff recommends approval of RZ-2024-09. The motion to deny was carried unanimously. 9.d TA-2024-08 Mrs. Howell presented the Flood Prevention Text Amendment Overview to the board. She stated that the purpose of the Text Amendment was to update the Flood Ordinance located within the UDO Chapter 5, to meet the National Flood Insurance Program (NFIP) regulation. The NFIP is managed by the Federal Emergency Management Agency (FEMA). The NFIP is a program that makes federally backed insurance available for communities that adopt and enforce floodplain management ordinances to reduce flood damage. Mrs. Howell noted that the Town of Mooresville provides access to flood insurance to all property owners within the Special Flood Hazard Areas (SFHA) by adopting and enforcing the required updates to the current ordinance. Mrs. Howell stated there are currently 16 properties in Mooresville with flood insurance, and according to current maps, there are approximately 60 structures that reside within Special Flood Hazard Areas. Mrs. Howell noted Flood Prevention Text Amendment Highlights being: 1. Ensures NC State Statute 160D compliance. 2. Updates reference to new Floodproofing and Elevation Certificates. 3. Updates definitions to provide a robust understanding of flood-related terms. Staff recommends approval of TA-2024-08. ACTION: A motion was made by Laura Temple, seconded by Rosalind Campbell to recommend approval of TA-2024-08 to the town board. The motion to approve was carried unanimously. 10. Administrative Items Erika Martin gave a brief update on projects that the Town Board approved. A motion was made by Mark Brady, seconded by Shaun Hooper, to change the next Planning Board meeting date to November 19, 2024, and the location to the Charles Mack Citizen Center. The motion carried unanimously. 11. Adjournment ACTION: A motion was made by Shaun Hooper, seconded by Rosalind Campbell to adjourn the meeting at 9:15 pm.
