1. Call to Order
Chair McGlothlin called the meeting to order at 6:00 pm.

Chair McGlothlin welcomed the Planning Board and guests and opened the meeting.

Chair McGlothlin opened the Public Comment. No members of the public spoke.
5. Adjustments to Agenda
James Coley informed the Board an adjustment was made regarding CZ 2025-20:
Brillian Grove. Entirety of Mitigation Measures Agreement added, as well as three
additional conditions to the proposed ordinance.
6. Adoption of the Agenda
ACTION: A motion was made by Mr. Mack, seconded by Mr. Katz, to accept the
adjustments and approve the agenda. Motion approved: 9-0

9.a Consider Conditional Rezoning Request CZ-2025-20 for a 35.606-acre site located on
McCrary Road, 187 McCrary Road, 163 McCrary Road, and 179 McCrary Road (PINs
4637375275, 4637382243, 4637284378, 4637288863, 4637288651). The applicant is
requesting Town of Mooresville Conditional Traditional Neighborhood (C-TN). The
property owners are seeking Town of Mooresville Conditional Traditional Neighborhood
(C-TN) zoning for a 35.606-acre site located on McCrary Road, 187 McCrary Road, 163
McCrary Road, and 179 McCrary Road (PINs 4637375275, 4637382243, 4637284378,
4637288863, 4637288651). The property is currently zoned Iredell County Residential
Agricultural (RA).
There were no conflicts of interest from Board members.
Patrick Werner presented the rezoning request.
The following representatives for the project spoke:

Public comment was opened. The following individuals spoke:

Engineer Matt Mandle, ESP Associates, spoke on behalf of the developer in response to
environmental concerns.
A discussion was held regarding restricting lake access.
A condition was proposed to not allow lake access by residents for recreational purposes
from the development.
A discussion was held regarding traffic and timing of completion of work on Highway
150. Civil engineer Michael Wickline, Design Resource Group, spoke on behalf of the
developer concerning road construction.
A condition was proposed limiting certificate of occupancy issuance prior to completion
of the right-only access road improvement at the intersection of McCrary Road and NC
150.
Jerry Whelan, Vice President of Land Acquisition with Mattamy Homes, accepted the
following 18 conditions:
1. Site development shall conform to the approved Concept Plan.
2. The project density shall not exceed 2.20 units per acre (77 maximum lots).
3. The project will provide a minimum of 8.76 acres of open space. The developer or
HOA shall maintain the open space in compliance with the Unified Development
Ordinance.
4. The project is restricted to single-family residential and its associated accessory
uses.
5. Developer shall complete all mitigation measures recommended by the TIA in
accordance with the Mitigation Measures Agreement between the developer and
the Town. Mitigation Measures below shall be in place prior to the approval of the
first certificate of occupancy (CO).
a. SR 1168 (McCrary Rd) from NC 150 (River Hwy) to Site Access A: Widen
McCrary Road (approximately 1,500 feet) to provide 11-foot lanes.
b. McCrary Road and Site Access A: Westbound: Construct Site Access A with two-
lane cross section with one ingress and one egress (shared left/right turn lane).
Provide 100 feet of internal protected stem.
6. Developer shall provide the 10’ type D perimeter buffer along the northern and
eastern property lines as shown on the Concept Plan. This buffer area shall be
platted as common open space and maintained by the community homeowner’s
association.
7. The building materials used on the single-family detached dwellings constructed in
the project shall include one or more of the following: brick, stone, stucco, Hardi
plank or equivalent, wide trim wrapped windows, shake siding at gables, board and
batten siding at gables, roof overhangs on sides and rear elevations, and decorative
items such as corbels or other pediments in gables.
8. Building materials utilized in front elevations for each single-family detached
dwelling shall include a minimum of two (2) color variations.
9. No side-by-side single-family detached dwellings or dwellings located directly
across the street from each other shall share the same front elevation.
10. Enhanced side elevation treatments, such as a mixture of materials, windows, and
enhanced trim, shall be provided for certain corner lots along public roads as
indicated on the “Enhanced Side Elevation Lots” exhibit, and designed as generally
depicted on the example elevation labeled as “Enhanced Side Elevation.”
11. Every single-family detached dwelling shall have a minimum of a two-car garage.
12. Garage doors for single-family detached dwellings shall include windows.
13. The elevations included with the Developer’s submittal are representative and
illustrative in nature to show potential design based upon the architectural and
design conditions herein. Such elevations may be modified and adjusted with final
“for construction” drawings so long as they meet the conditions herein.
14. Building height shall not exceed 2 stories. Building height shall be defined by UDO
Section 9.2.1.C.3.
15. At least one (1) residential unit shall be priced to be attainable for households
earning at or below 120 percent area median income with an affordability period of
seven (7) years, subject to the Additional Requirements listed in UDO Section
5.12.4. An attainable housing agreement shall be jointly agreed upon by the
property owner/developer and Planning Director prior to Site Plan approval.
16. Site development shall conform to all applicable zoning development standards and
use specific requirements, as found in UDO Chapter 5 “Development Standards.”
17. There shall be no direct lake access by residents for recreational purposes from the
development.
18. There shall be no more than 25 certificates of occupancy issued prior to the
completion of the right-only access road improvement at the intersection of
McCrary Road and NC 150.
ACTION: A motion was made by Michael Cole, seconded by Wendy Smith, to
approve CZ-2025-20 with the proposed conditions. Motion approved: 8-1, opposed by
Miko Red Arrow
10. Administrative Items
Mr. Coley informed the Planning Board about recent Town Board actions.
Planning Board will have some cases in October.
Mr. Coley asked Board to keep him updated on availability for Planning Board meetings
near the holidays.
Mr. Coley introduced new Planner, Ashley Lattin.
11. Adjournment
ACTION: A motion was made by Laura Temple, seconded by Gregory Peretz,
to adjourn the meeting at 7:29 p.m. Motion approved: 9-0
