The City Council dispenses with the three (3) reading rule of Idaho Code 50-902 for all ordinances City Council Regular Meeting February 20, 2024 1-3. Authorize Public Hearings a. Action Item: Annexation and Zoning to RS4 (Single-Family Residential) zoning district and potential development agreement; Conditional Use Permit to allow for 2-unit townhouses in the RS4 zoning district; and Subdivision Preliminary Plat for Baylor Subdivision for a 1.21 acre property at 11236 Lone Star Rd (parcel #R3146100000 located in the SE 1/4 of the SE 1/4 Section 19, T3N, R2W, BM) for The Land Architect LLC representing Jesse Vanderlinden (ANN-00292-2023, CUP-00323-2023, SPP-00133-2023). Original Concept: 6 single-family attached dwelling units in 3 buildings (2- unit townhouses), 1 new single-family detached dwelling unit, one existing single-family detached dwelling unit, and 2 common lots, for a total of 8 dwelling units. A portion of the existing single-family dwelling unit will be removed to accommodate access to the remaining units and maintain a 5' side yard setback. To be considered by City Council on March 4, 2024. b. Action Item: Zoning Map Amendment to IL (Light Industrial) zoning district at 76, 100, 240, 250, and 290 6th St. N (parcel #3123700000, 43.85 acres at located in the S 1/2 of Section 15, T3N, R2W, BM) for City of Nampa (ZMA-00186-2023). Original Concept: To apply an IL zoning description to a currently unzoned city property for the Kohlerlawn Cemetery, railroad, and ITD right of way. To be considered by City Council on March 4, 2024. c. Action Item: Annexation and Zoning for 11.27 acres to RS4 (Single-Family Residential), and 6.56 acres to RS6 (Single-Family Residential) zoning district for a future single-family development for Wagon Trail Subdivision at 3321 E Victory Rd. (a 17.84 acre area - parcel #R2467900000; located in the NW 1/4 of the NW 1/4 of Section 25, T3N, R2W, BM), for Wendy Shrief- J-U-B Engineers, Inc. (ANN-00296-2023). Original Concept: 76 single-family dwelling units and 10 common lots. To be considered by City Council on March 4, 2024. 1-4. Authorization for Execution of Contracts and Agreements a. Action Item: Authorize Mayor to sign, (1) Agreement to Waive First Right of Refusal and Terminate Lease with Robert and Marla Wolf dated August 21, 2018, and (2) Nampa Municipal Airport Land Lease Agreement and Memorandum of Lease with Juliette Lima Aviation, LLC, effective March 1, 2024, for Lot 2267. (Standard Agreement Approved by City Attorney Joe Borton) b. Action Item: Authorize the immediate piggyback purchase of 6,000 gallons of traffic paint from Ennis Flint at an estimated cost of $81,960.00 for the Street Division. (Approved in FY24 Budget) c. Action Item: Authorize Mayor to sign Memorandum of Understanding (MOU) between City of Nampa and Astoria Park Subdivision for Installation of Traffic Control Measures. Formal Findings for the DENIAL of Zoning Map Amendment from RA (Suburban Residential) to RD (Two-Family Duplex Residential) zoning district and Preliminary Plat for Chicago Street Townhomes with an exception to allow 2 lots to exceed 10,000 sf, at 1426 Chicago St, a 6.36 acre parcel #R3231600000 (located in the NW 1/4 of the SE 1/4 of Section 35, T3N, R2W, BM) for Becky Yzaguirre, representing Parekh Pratik (ZMA- 00183-2023 & SPP-00131-2023). Original Concept: 49 single-family attached (townhouse) dwelling units and 2 common lots. (Approved by City Attorney Bryan Norton) b. Formal Findings for the DENIAL of Variance of NCC 10-8-5.A requiring a 5' sideyard setback for buildings to allow an attached garage built without permits to remain in its current location - approximately 2' from the south property line at 2123 S Elder St, a .31 acre parcel #R2520700000 (located in the SE 1/4 of Section 34, T3N, R2W, BM) for Victor Jimenez and Dulce O. Samaguey (VAR-00150-2023). (Approved by City Attorney Bryan Norton) 1-8. Miscellaneous Items a. Action Item: Authorize Mayor to sign a letter of support for the COMPASS FY2025 Unified Planning Work Program to coordinate regional lane closures, detours, and traffic impacts due to construction. Action Item: Authorize $50,000 for educational outreach expenses related to the General Obligation Transportation Bond ahead of the May 21, 2024 election. 7-2. Action Item: Authorize Mayor to sign Lynx Library Consortium Joint Powers Agreement. (Approved by City Attorney Joe Borton) 7-3. Action Item: Authorize adoption of the Nampa Municipal Airport Construction Policy. (Approved by City Attorney Joe Borton) 7-4. Action Item: Authorize Mayor to sign Resolution for the Appointment of Peter McPherson to the Valley Regional Transit Board as second alternate representative. 7-5. Action Item: Authorize Mayor to (1) sign Resolution and State/Local Agreement for Project Development with the Idaho Transportation Department for Northside Blvd & Karcher Rd Roundabout Final Design and (2) Authorize payment to Idaho Transportation Department in the amount of $75,000.00. (Approved by City Attorney Joe Borton) (Approved in FY24 Budget) 7-6. Action Item: Staff requesting authorization to exceed FY24 budget for Road Salt procurement and direction to either purchase a 2-year supply in the amount of $175,450.00 or a 3-year supply in the amount of $255,200.00. (Funding will be from Streets Division and a Budget Amendment will be required) 7-7. Action Item: Authorize Mayor and Public Works Director to sign Task Order Amendment for attached Scope of Work (Exhibit A) with Keller Associates, Inc. to provide additional design services, permit acquisition, and construction engineering and inspection services for the Elevated Tank, Well 8, and Booster Station Replacement project in the amount of $315,520.00 (T&M NTE). (Standard consultant selection and task order agreements approved by Legal) (Approved in FY24 Budget, partial funding with ARPA funds) 7-8. Action Item: Consider amending Nampa City Code 2-2-2-1-D which defines the term of the Council President as a biennial term. Action Item: Public Hearing and request to authorize Mayor to sign Resolution to approve the adoption of the revised Streets Capital Improvement Plan (CIP). Revisions include changes to the streets projects and changes in the calculation for the impact fee contribution to projects with City and other revenue sources. The total 10-year Streets CIP dollar amount and associated Streets impact fees do not change. (Approved by City Attorney Victor Villegas) (continued from February 5, 2024 meeting) 8-2. Action Item: Conditional Use Permit to construct and operate a public storage facility in a BC (Community Business) zoning district and a Variance of NCC 10-1-16.A.1.c requiring a minimum distance of 100' from RS (Single Family Residential) zoning district in order to construct and operate a public storage facility, on 4.27 acres located at 0 E Railroad St (parcel #R3239201400, located in the NE 1/4 of Section 36, T3N, R2W, BM) for Andrew Newell with Blaine Womer Civil Engineering representing Landmark Pacific Development, Inc (CUP-00329-2023, VAR-00153-2023). Original Concept: Public storage facility with 382 storage units plus 1 unit designated as the facility's office and variance to allow a setback from the RS zone of 48' rather than the required 100'. 8-3. Action Item: Zoning Map Amendment from IP (Industrial Park) to BC (Community Business) zoning district, for a 2.94 acre parcel R0754051100 at 823 Parkcentre Way (located in the NW 1/4 of Section 16, T3N, R2W, BM) for Benjamin Polyakov, representing Bielec Properties, Inc/ Paul Bielec (ZMA-00185-2023). Original Concept: Rezone to allow a church to locate in the building. (9) Unfinished Business 9-1. Action Item: Authorize Mayor to sign the record of survey for 123152 ROS 300 Railroad (Fire Training Center) as presented. (continued from February 5, 2024 meeting) 9-2. Action Item: 1st reading of Ordinance for Annexation and Zoning to RS6 (Single-Family Residential) zoning district for .75 acres of right-of-way & 6.10 acres of developable land, and BC (Community Business) zoning district for 3.29 acres, and development agreement for Audrey Acres Subdivision at 941 Lake Lowell Ave (a 9.39 acre area - parcel #R321820000; located in the NW 1/4 of Section 33, T3N, R2W, BM), for Keyhole, LLC (ANN-00280-2023 & SPP-00123-2023). Action Item: 1st reading of Ordinance for Vacation of existing utility easements on a 0.899 acre undeveloped parcel in the BC (Business Community) zoning district located at 0 12th Avenue (R#1165301000, in the NW 1/4 of Section 34, T3N, R2W, BM) for Connor Candrian/Kimley-horn representing D.L. Action Item: 1st reading of ordinance of the City of Nampa, Idaho, confirming the assessment roll for Local Improvement District No. 170. 9-5. Action Item: 1st reading of Ordinance for Zoning Map Amendment from RA (Suburban Residential) zoning district to RML (Limited Multiple-Family Residential) zoning district at 1157 S Powerline Rd (a .92 acre parcel - R1174201000 located in the NE 1/4 of Section 34, T3N, R2W, BM) for Aislinn Mangan (ZMA-00180-2023).
