Development Impact Fee Advisory Committee – Special Meeting – December 7, 2023 1-2. The City Council dispenses with the three (3) reading rule of Idaho Code 50-902 for all ordinances 1-3. Authorize Public Hearings a. Annexation and Zoning to RS8.5 (Single-Family Residential) zoning district for 57.1 acres, potential development agreement, and Subdivision Preliminary Plat for Lakeview Subdivision at 12529 Midway Rd & 0 Iowa Ave (two parcels #R3310800000 & R3311500000, located in the S 1/2 of the NE 1/4 of Section 36, T3N, R3W, BM), for Flexspace, LLC representing Karen Lea and Bob Lee Anderson (ANN-00293-2023 & SPP-00135-2023). Original Concept: 1 existing SF home, 155 single-family detached residential, and 11 common lots. To be considered by City Council on March 18, 2024. b. Nampa City Comprehensive Plan Future Land Use Map Amendment to change the Residential Mixed Use, Community Mixed Use and Medium Density Residential designations to High Density Residential, Commercial and Industrial Designations in the area north of the Railroad tracks, south of I-84, east of Northside Blvd and west of the railroad tracks; and Nampa City Code Text Amendment to make changes to Title 10 Planning and Zoning, Chapter 1 to remove references to guesthouses, change bonding language, revise the definition for building/structure height and add Figure 9 to demonstrate building/structure height; Chapter 2 to clarify zoning map amendment criteria and add time limits on changes to the Comprehensive Plan; Chapter 3 to add a paragraph about dual zoned properties, change paragraph regarding ambiguous uses, clarify note regarding commercial daycares, remove Mobile/Manufactured Home/RV sales as an allowed use in the RP zone; Chapter 8 to remove an unnecessary reference to Chapter 1; Chapter 11 & 12 to add a 5 foot rear setback unless adjacent to existing residential; Chapter 13 to add an 8 foot rear setback unless adjacent to existing residential; Chapter 15 to add fencing language for commercial uses in the DB Zone; Chapter 16 to add the words Building and Parking to the setbacks section; Chapter 19 to clarify height limitations; Chapter 22 to add language regarding the width of an access to be able to require landscaping and a new parking formula for health clubs; Chapter 24 to clarify the granting of a variance permit and removal of the criteria in 10- 24-2.B.4.d as repetitive and remove 10-24-2.C for Parking Reductions; Chapter 25 Conditional Use Permits, adherence to approved plan to define the effective date of the permit; Chapter 26 to fix the numbering for the Density & Lot Size section; Chapter 27 add procedure language for cemeterys and collumbariums and change required landscape buffer width to twenty-five feet (25'); Chapter 31 to add the Midland Corridor Study section, Chapter 33 to define Zeroscape and to include the BC zone specific landscape buffer width in the table; and Chapter 34 to clarify the reference to wing wall fencing, for the City of Nampa. Action Item: Authorize Engineering Division to begin formal bidding process for LID 174. (Standard LID process and forms approved by Legal) 1-5. Authorization for Execution of Contracts and Agreements a. Action Item: Authorize Mayor and Public Works Director to sign Task Order with Jacobs Engineering Group Inc. to provide survey, design, and engineer of record services for the Zone D Sewer Rehab FY25 project in the amount of $99,984.00 (T&M NTE). (Standard consultant selection process and task order agreements approved by Legal) (Approved in FY24 Budget, #24- 8080-003) b. Action Item: Authorize the annual procurement for the immediate piggyback purchase of pavement marking thermoplastics from Ennis-Flint, at an estimated cost of $45,000.00 for the Street Division. (Approved in FY24 Budget) c. Action Item: Authorize the annual procurement for the piggyback purchase of chip and fog seal oils from Idaho Asphalt Supply at an estimated cost of $976,000.00 for the Street Division. (Approved in FY24 Budget) d. Action Item: Authorize Mayor to sign Memorandum of Understanding (MOU) between City of Nampa and Colter Bay Subdivision for Installation of Traffic Control Measures. Action Item: Adopt the Robinson Corridor Study and direct staff to plan future improvements to Robinson Road according to the recommendations in the Plan. 7-2. Action Item: Authorize Mayor to sign the grant award agreement with the Urban Sustainability Directors Network in the amount of $1,000,000.00 to preserve, protect, and enhance Nampa’s Urban Forest. (Approved by City Attorney Joe Borton) (FY24 Budget Amendment Needed) 7-3. Action Item: Authorize 1) Mayor to sign State/Local Agreement (SLA) for the design and construction of Canyon Street Bicycle & Ped Pathway, PH 1 Key No. 23915; and 2) Approve the associated Resolution. (Standard State/Local Agreement approved by Legal) (Approved in FY24 Budget, #24-8040-018) 7-4. Action Item: Authorization to advertise and proceed with the Request for Qualifications for Orr Pathway Design Proposals. (Approved by City Attorney Todd Lakey) (Approved in FY24 Budget) 7-5. Action Item: Authorize Mayor to sign and execute the Utility Reimbursement Agreement with Adler Industrial for Adler Midland Industrial Park. (Approved by City Attorney Joe Borton) 7-6. Action Item: Authorize Mayor to sign Change Order No. 2 for the Pump Maintenance FY22 project with Layne of Idaho in the amount of $100,942.73 (T&M NTE). (Standard change order forms approved by Legal) (Approved in FY24 Budget) 7-7. Action Item: Council award bid and authorize Mayor to sign contract for the Annual Waterline Replacement FY23 project with Das-Co of Idaho, Inc in the amount of $1,028,380.00 (T&M NTE). (Standard bid forms and contracts approved by Legal) (FY24 Budget Amendment Needed) 7-8. Action Item: Authorize allocation of $4,849,970.00 for the purchase of 11.72 acres of Light Industrial zoned property on Broadmore Way adjacent to the north property line of the City Streets Division for the future expansion of Public Works and other City Department uses. (FY24 Budget Amendment Needed) 7-9. Action Item: City Clerk providing status update of proposed licenses, Massage Establishments and Mobile Food Vendors, and requesting direction on next steps. Action Item: Annexation and Zoning to RS4 (Single-Family Residential) zoning district and potential development agreement; Conditional Use Permit to allow for 2-unit townhouses in the RS4 zoning district; and Subdivision Preliminary Plat for Baylor Subdivision for a 1.21 acre property at 11236 Lone Star Rd (parcel #R3146100000 located in the SE 1/4 of the SE 1/4 Section 19, T3N, R2W, BM) for The Land Architect LLC representing Jesse Vanderlinden (ANN-00292-2023, CUP-00323-2023, SPP-00133-2023). Original Concept: 6 single-family attached dwelling units in 3 buildings (2-unit townhouses), 1 new single-family detached dwelling unit, one existing single-family detached dwelling unit, and 2 common lots, for a total of 8 dwelling units. A portion of the existing single-family dwelling unit will be removed to accommodate access to the remaining units and maintain a 5' side yard setback. 8-2. Action Item: Zoning Map Amendment to IL (Light Industrial) zoning district at 76, 100, 240, 250, and 290 6th St. N (parcel #3123700000, 43.85 acres at located in the S 1/2 of Section 15, T3N, R2W, BM) for City of Nampa (ZMA-00186-2023). Original Concept: To apply an IL zoning description to a currently unzoned city property for the Kohlerlawn Cemetery, railroad, and ITD right of way. 8-3. Action Item: Annexation and Zoning for 11.27 acres to RS4 (Single-Family Residential), and 6.56 acres to RS6 (Single-Family Residential) zoning district for a future single-family development for Wagon Trail Subdivision at 3321 E Victory Rd. (a 17.84 acre area - parcel #R2467900000; located in the NW 1/4 of the NW 1/4 of Section 25, T3N, R2W, BM), for Wendy Shrief-J-U-B Engineers, Inc. (ANN-00296-2023). Original Concept: 76 single-family dwelling units and 10 common lots. (9) Unfinished Business 9-1. Action Item: 1st reading of Ordinance for Zoning Map Amendment from IL (Light Industrial) to BC (Community Business) for 7.92 acres of an 11.89 acre parcel (R3118700000) at 2200 E Chisholm Dr (located in the NW 1/4 of Section 14, T3N, R2W, BM) for Jeff Hatch - Hatch Design Architecture representing Brivan Idaho LLC (ZMA-00177-2023). (Approved by City Attorney Bryan Norton) 9-2. Action Item: 1st Reading of Ordinance to create LID 174. (Approved by City Attorney Joe Borton) 9-3. Action Item: 1st reading of ordinance and approval of publication of ordinance summary amending Nampa City Code to add Title 5, Chapter 7, Sections 5-7-1 through 5-7-15 relating to the licensing of Massage Establishments.
