Subdivision Final Plat Approval for Bodle Farms Subdivision in a RS6 (Single-Family Residential) zoning district; a 5.12 parcel #R3078401000 at 17362 Madison Ave (located in the NE 1/4 of Section 3, T3N, R2W, BM) for Landmark Pacific Development Inc. (SPF-00252-2024). Original concept: 20 single-family detached lots b. Subdivision Final Plat Approval for La Paloma Blanca Subdivision in a RS7 (Single-Family Residential) zoning district; a 2.21 acre parcel #R24709012A0 at 87 S Happy Valley Rd (located in the SE 1/4 of the NE 1/4 Section 25, T3N, R2W, BM) for Oscar Diaz. (SPF-00238-2023). Original concept: 8 single-family detached lots and 4 common lots. 1-4. Authorize Public Hearings a. Action Item: Authorize public hearing for Annexation and Zoning and potential development agreement for 37.74 acres to RP (Residential Professional) zoning district for a future mixed-use development for Valente Subdivision at 0 Ustick Rd (Parcel #R3083300000 located in the SW 1/4 of the NW1/4 of Sec. 3, T3N, R2W, BM) for Kelli Black/Bailey Engineering representing Endurance Holdings LLC (ANN-00298-2023). Original concept: 63 single-family detached residential lots, 98 single-family attached lots, 4 commercial lots, and 19 common lots. To be considered by City Council on April 15, 2024. b. Action Item: Authorize public hearing for vacation of existing utility easements for a multi-family residential development in the BC (Community Business) zoning district, 3.19 acres located in the NW 1/4 of Section 34, T3N, R2W, BM, including four parcels, Parcel#s R116540000, R116550000, R116560000, and R117680000, addressed as 203 & 211 E Florida Ave, 1224 S Nectarine St, and 200 E Hawaii Ave, for Hutchison Smith Architects/Keith Tasker representing The Housing Company (VAC-00063- 2023). Action Item: Authorize Engineering Division to proceed with the formal bid process for the Franklin Boulevard Waterline Upgrade project. (Standard Bid Documents and Contracts approved by Legal) (Approved in FY24 Budget, partial funding from ARPA, #24-8060-003) b. Action Item: Authorize Engineering Division to proceed with the formal bid process for the Sherman Elementary Fire Flow Upgrade project. (Standard Bid Forms and Contracts approved by Legal) (Approved in FY24 Budget, partial funding from ARPA, #24-8060-007) 1-6. Authorization for Execution of Contracts and Agreements a. Action Item: Authorize Mayor and Public Works Director to sign task order for attached scope of work with J-U-B Engineers, Inc. for the Pump Maintenance FY25 project in the amount of $70,900.00 (T&M NTE). (Standard task order documents approved by Legal) (Approved in FY25 Operational Budget) b. Action Item: Authorize Mayor to sign Cooperative Agreement and associated resolution with the Idaho Transportation Department (ITD) to install City of Nampa domestic water infrastructure improvements in the SH55 (Karcher Rd) and Middleton Rd intersection in the amount of $76,000.00. (Standard agreements with ITD approved by Legal) (Approved in FY24 Budget, #24- 8060-004) 1-7. Formal Findings a. Action Item: Adopt Formal Findings for the DENIAL of Annexation and Zoning to RS8.5 (Single-Family Residential) zoning district for 57.1 acres, potential development agreement, and Subdivision Preliminary Plat for Lakeview Subdivision at 12529 Midway Rd & 0 Iowa Ave (two parcels #R3310800000 & R3311500000, located in the S 1/2 of the NE 1/4 of Section 36, T3N, R3W, BM), for Flexspace, LLC representing Karen Lea and Bob Lee Anderson (ANN-00293-2023 & SPP-00135-2023). Original Concept: 1 existing SF home, 155 single-family detached residential, and 11 common lots. (Approved by City Attorney Bryan Norton) 1-8. Miscellaneous a. Action Item: Approve the installation of stop signs for side streets along South Tallapoosa River Way for a cost of $450.00. Update from the City Forester regarding the Forestry Division of Parks and Recreation Department (7) New Business 7-1. Action Item: Discussion and possible action regarding the letter from the City of Nampa related to Vallivue School District Elementary School #9 – Traffic Impact Study Acceptance and Conditions. 7-2. Action Item: Authorize the allocation of $130,000.00 in Community Development Block Grant (CDBG) funds to NeighborWorks Boise to operate a program that will provide home- ownership assistance to qualifying Nampa households. (Approved in FY24 Budget) 7-3. Action Item: Authorize Nampa Family Justice Center (NJC) to submit for “Improve the Criminal Justice Response Program” grant to be used to help fund two current NJC positions and provide direct services to victims. The amount of the grant is $500,000 over a 36-month award period beginning October 1, 2024 and there is no City match. 7-4. Action Item: Authorize Nampa Family Justice Center (NJC) to submit for “Prevent and Respond to Domestic Violence, Dating Violence, Sexual Assault, Stalking, and Sex Trafficking Against Children and Youth Program”. The grant will be used to help fund two current NJC positions and provide direct services to victims and provide community abuse prevention training. The amount of the grant is $500,000 over a 36-month award period beginning October 1, 2024 and there is no City match. Page 4 of 7 City Council Regular Meeting April 01, 2024 7-5. Action Item: Authorize to proceed with design of the Lake Lowell Avenue Rebuild between Midland Blvd and 12th Avenue Road with the recommended roadway configuration. 7-6. Action Item: Authorize Mayor and Public Works Director to sign Phase I Task Order with Keller Associates for the Wastewater Treatment Plant Headworks Replacement Project (Group G) for 3.5% of estimated construction costs in the amount of $1,258,408.00. (Approved by Attorney Mark Hilty) (Approved in FY24 Budget, #24-8080-012) 7-7. Action Item: Authorize Police to submit for annual Idaho Transportation District (ITD) Highway Safety Grant with all activity grant-funded. Funds will be used to reduce motor vehicle related deaths and serious injury crashes in the City of Nampa by increasing law enforcement presence, public awareness, education, and traffic safety on the city roadways. 7-8. Action Item: Authorize Mayor to sign Federal Aviation Administration Grant Application for Airport Improvement Program (AIP-39) – Relocation of the Automated Weather Observation System (AWOS), with a 5% City Match that totals $10,000.00. (Approved by City Attorney Joe Borton) (Approved in FY24 Budget, #24-8050-004) 7-9. Action Item: Authorize Mayor and Public Works Director to sign task order with Burgess & Niple, Inc. for the North Yale Street and 7th Avenue Corridor Study in the amount of $99,796.00. (Standard agreement approved by Legal) (Approved in FY24 Budget, #24-8040- 011) 7-10. Action Item: Authorize Mayor to sign Construction Contract for the attached Scope of Work with BriCon, Inc. for construction of a downtown trash enclosure. (Standard construction contract documents approved by Legal) (Project will use allocated funds from the Nampa Development Corporation (NDC), approved in the NDC FY24 Budget) 7-11. Action Item: Authorize the purchase of a John Deere Model 6110M, 110 h.p. tractor for the Ford Idaho Center Horse Park from Campbell Tractor Company in the amount of $88,500.00 (Approved by City Attorney Todd Lakey) (Budget Amendment Needed-Approved in FY24 Budget, #24-7520-001) 7-12. Action Item: Consider amending Nampa City Code 2-2-2 to add a President Pro Tem position. (8) Public Hearings 8-1. Action Item: Annexation and Zoning to RS4 (Single-Family Residential) zoning district and potential development agreement; Conditional Use Permit to allow for 2-unit townhouses in the RS4 zoning district; and Subdivision Preliminary Plat for Baylor Subdivision for a 1.21 acre property at 11236 Lone Star Rd (parcel #R3146100000 located in the SE 1/4 of the SE 1/4 Section 19, T3N, R2W, BM) for The Land Architect LLC representing Jesse Vanderlinden (ANN-00292-2023, CUP-00323-2023, SPP-00133-2023). Original Concept: 6 single-family attached dwelling units in 3 buildings (2-unit townhouses), 1 new single-family detached dwelling unit, one existing single-family detached dwelling unit, and 2 common lots, for a total of 8 dwelling units. A portion of the existing single-family dwelling unit will be removed to accommodate access to the remaining units and maintain a 5' side yard setback. Action Item: Nampa City Comprehensive Plan Future Land Use Map Amendment to change the Residential Mixed Use, Community Mixed Use and Medium Density Residential designations to High Density Residential, Commercial and Industrial Designations in the area north of the Railroad tracks, south of I-84, east of Northside Blvd and west of the railroad tracks; and Nampa City Code Text Amendment to make changes to Title 10 Planning and Zoning, Chapter 1 to remove references to guesthouses, change bonding language, revise the definition for building/structure height and add Figure 9 to demonstrate building/structure height; Chapter 2 to clarify zoning map amendment criteria and add time limits on changes to the Comprehensive Plan; Chapter 3 to add a paragraph about dual zoned properties, change paragraph regarding ambiguous uses, clarify note regarding commercial daycares, remove Mobile/Manufactured Home/RV sales as an allowed use in the RP zone; Chapter 8 to remove an unnecessary reference to Chapter 1; Chapter 11 & 12 to add a 5 foot rear setback unless adjacent to existing residential; Chapter 13 to add an 8 foot rear setback unless adjacent to existing residential; Chapter 15 to add fencing language for commercial uses in the DB Zone; Chapter 16 to add the words Building and Parking to the setbacks section; Chapter 19 to clarify height limitations; Chapter 22 to add language regarding the width of an access to be able to require landscaping and a new parking formula for health clubs; Chapter 24 to clarify the granting of a variance permit and removal of the criteria in 10-24-2.B.4.d as repetitive and remove 10-24-2.C for Parking Reductions; Chapter 25 Conditional Use Permits, adherence to approved plan to define the effective date of the permit; Chapter 26 to fix the numbering for the Density & Lot Size section; Chapter 27 add procedure language for cemeterys and collumbariums and change required landscape buffer width to twenty-five feet (25'); Chapter 31 to add the Midland Corridor Study section, Chapter 33 to define Zeroscape and to include the BC zone specific landscape buffer width in the table; and Chapter 34 to clarify the reference to wing wall fencing, for the City of Nampa. Action Item: Authorize Mayor to sign Resolution establishing fees for the licensing of Massage Establishments within the Nampa city limits. (Approved by City Attorney Joe Borton) 9-2. Action Item: 1st reading of Ordinance for Vacation of a 7ft wide portion of the 12ft wide rear easement (leaving a 5 ft wide easement) on a 0.18 acre parcel in the RS6 (Single-Family Residential) zoning district located at 14919 N Fitzwilliam St. (R#3145629600, in the NW 1/4 NE 1/4 of Section 19, T3N, R2W, BM) for Jose Padilla (VAC-00065-2023). (Approved by City Attorney Bryan Norton) 9-3. Action Item: 1st reading of Ordinance for Zoning Map Amendment from IP (Industrial Park) to BC (Community Business) zoning district, for a 2.94 acre parcel R0754051100 at 823 Parkcentre Way (located in the NW 1/4 of Section 16, T3N, R2W, BM) for Benjamin Polyakov, representing Bielec Properties, Inc/ Paul Bielec (ZMA-00185-2023). Action Item: 1st reading of Ordinance for Zoning Map Amendment to IL (Light Industrial) zoning district at 76, 100, 240, 250, and 290 6th St. N (parcel #3123700000, 43.85 acres at located in the S 1/2 of Section 15, T3N, R2W, BM) for City of Nampa (ZMA-00186-2023). (Approved by City Attorney Bryan Norton) Page 6 of 7 City Council Regular Meeting April 01, 2024 (10) Executive Session Action Item: Motion to Adjourn into Executive Session Pursuant to Idaho Code 74-206 (1): (c) To acquire an interest in real property not owned by a public agency; (f) To communicate with legal counsel for the public agency to discuss the legal ramifications of and legal options for pending litigation, or controversies not yet being litigated but imminently likely to be litigated.
