The City Council dispenses with the three (3) reading rule of Idaho Code 50-902 for all ordinances City Council Regular Meeting October 07, 2024 1-3. Plat Approvals a. Action Item: Subdivision Short Plat Approval for the Bella Lane North Subdivision in a RMH (Multiple Family Residential) zoning district, a 0.81 acre parcel #R3141010000 addressed as 1820, 1860, and 1880 W Bella Lane, located in NW 1/4 of Section 17, T3N, R2W, BM, for Tamee Crawford/Centurion Engineers representing Jones Family Trust Agreement - David Jones (SPS-00061-2024). Original Concept: Subdivide Lot 1, Block 1 of Bella Commons Subdivision Phase 1 into three parcels so that each of the three existing 4-plex buildings (to remain) will be on its own parcel. 1-4. Authorize Public Hearings a. Action Item: Authorize a public hearing on October 21, 2024, for the consideration to amend and restate portions of Ordinance No. 1946, modifying the application, collection, method of calculation and rate of special assessment within the Nampa Downtown Business Improvement District No. 2. b. Action Item: Authorize public hearing on FY25 Trash and Recycling rate increases, to be considered by City Council on October 21, 2024. c. Action Item: Authorize advertisement of the October 21, 2024, public hearing to present recommended FY25 increases to wastewater rates and fees of 8.28%, effective November 1, 2024, as recommended by the Board of Appraisers. d. Action Item: Authorize public hearing for Zoning Code Text Amendment of Title 10, Chapter 6 (AG), Chapter 7 (RA) regarding the requirements for cluster developments, Chapter 16 (BC), Chapter 18 (IP), Chapter 19 (IL), Chapter 20 (IH), in regards to setbacks adjacent to a property with the very low density residential designation in the Comprehensive Plan and the specific requirements per zoning district and Chapter 26 (PUDs and MPCs) in regards to the Cottage/Cluster Developments in the very low density residential designation in the Comprehensive Plan and adding language to the future land use map that allows for multiple zones that may not match the future land use designation when included in a Planned Unit Development or Master Planned Community request, for the City of Nampa. (ZTA-00041-2024). To be considered by City Council October 21, 2024. e. Action Item: Authorize public hearing for Zoning Code Text Amendment of Title 10, Chapter 1: General Provisions; regarding definitions for Accessory Dwelling Units, Detached and 10-1-12.A.6-Subdivision Home Sales Offices as Temporary Uses to redefine locations allowed and time limits of use and remove 10-1-12.A.6.c.i; Chapter 2: Enforcement; to add a new section 10- 2-2.C defining Public Hearing Notices, Advertising & Property Postings for all applicable applications, adding hearing procedures for each application as applicable, remove notification wording from other reference sections and refer back to new section 10-2-2.C, add verbiage to 10-2-5.D.5 for development agreements to match attorney approved language, change allowable timeframes for Comprehensive Plan applications and add an exception for projects with a master planned community or planned unit Page 2 of 8 City Council Regular Meeting October 07, 2024 development attached to the request; Chapter 3: Residential Land Uses - Add footnote #4 regarding allowance of an accessory dwelling unit, detached on a single-family, detached lot or parcel only, add grocery stores as an allowed use in all zones except IH with footnote #5 to clarify types of food sales allowed, and remove "walk-up" from both restaurant categories; Chapters 8 and 10: Correct grammatical errors and chapter references; Chapter 25: Conditional Use Permit Revocation-to clarify the revocation process; Chapter 28: Mobile Homes and Mobile Home Parks - remove 10- 28-3.C for Caretakers Residence in Industrial Zones; Chapter 33: Landscaping- Add trees to discouraged or prohibit tree list; Chapter 35: Public and Privat Art - to establish a new chapter for private and public art with sections regarding purpose, definitions, processes and procedures and to set up a city art registry; all for the City of Nampa. (ZTA-00042-2024) To be considered by City Council October 21, 2024. f. Action Item: Authorize public hearing for Zoning Code Text Amendment of Title 10, Chapter 15 to add a new section regarding the city owned trash enclosure installed on Wall Street in the DH (Downtown Historic) Zoning District, for the City of Nampa. (ZTA-00043-2024) To be considered by City Council October 21, 2024. g. Action Item: Authorize public hearing on Fiscal Year 2025 First Budget Amendment, to be considered by City Council on October 21, 2024. h. Action Item: Authorize Public Hearing on November 4, 2024, for Council to consider approval of policies and increase user and service fees for the Nampa Parks, Recreation Division, Harward Recreation Center, Kohlerlawn Cemetery and the Nampa Municipal Golf Courses. 1-5. Authorization for Execution of Contracts and Agreements a. Action Item: Authorize Nampa Police Department to apply for the 2024 Byrne JAG Grant in the amount of $109,598 (no match required), which will be jointly filed with the Canyon County Sheriff’s Office and the Caldwell Police Department. b. Action Item: Authorize Public Works Director to sign the City’s Professional Services Term Agreement with Avalon Ventures Consulting, LLC in an amount of $69,000.00, Time and Materials Not to Exceed. (Standard Template) (Approved in FY25 Operations Budget) c. Action Item: Authorize Senior Director of Public Works to sign funding agreement with the Federal Highway Administration for the Safe Streets 4 All Grant Project: Safety Assessment of Northside Boulevard and 2nd Street South for a total project cost of $290,400.00, with a city match of $58,080.00. Action Item: Authorize Mayor to sign, (1) Access Easement Agreement with Black Butte Phase 3 for $98,406.78 and (2) Road Maintenance Agreement of Black Butte Business Park No. 3 Subdivision with Black Butte Phase 3 LLC and Black Butte Phase 2 Association, Inc for the Karcher Constructed Wetland Project. (Approved by City Attorney Todd Lakey) (Approved in FY25 Budget; #25-8080-015) e. Action Item: Authorize Nampa Family Justice Center to submit for 'STOP Violence Against Women' Collaborative Victim Services grant continuation (year 3 of a 4-year grant cycle) to fund the Victim Liaison position, crisis counseling, domestic violence exams and advocacy, and cell forensics software maintenance. The amount of the grant is $104,244 over a 12- month award period beginning January 1, 2025. Match will be covered by in-kind sources. (Approved in FY25 Budget) f. Action Item: Authorize Nampa Family Justice Center to submit for STOP Violence Against Women SAFE Services in Southwest Idaho grant continuation (year 3 of a 4-year grant cycle) to fund contracted sexual assault forensic examiners to provide medical care and evidence collection/documentation following a sexual assault. The amount of the grant is up to $140,965 over a 12-month period beginning January 1, 2025. Match will be covered by local hospitals and in-kind sources. (Approved in FY25 Budget) g. Action item: Authorize Nampa Family Justice Center (NFJC) to accept $500,000 in grant funds from Office on Violence Against Women (OVW) for Fiscal Year 2024 Grants to Improve the Criminal Justice Responses (ICJR) Program. Funds will be used to support the current NFJC Client Service Coordinator and NFJC Court Case Manager/Advocate position. In addition, grant funds will support direct victim assistance that includes crisis counseling, legal assistance, emergency shelter and transportation. (Approved by City Attorney Todd Lakey) (Pending approval in FY25 Budget Amendment) h. Action Item: Authorize Nampa Family Justice Center (NFJC) to accept Idaho Council on Domestic Violence and Victim Assistance State Fiscal Year 2025 grant funds. The grant will be used to support eleven current NFJC positions. The amount of the grant award is $260,125 and the award period is from October 1, 2024 -September 30, 2025. Match includes in-kind donations and volunteer time. There is no City match. (Approved by City Attorney Todd Lakey) (Approved in FY25 Budget) i. Action Item: Authorize Waterworks Division to issue a purchase order for an Envirosight Inspection Camera System from Metroquip in the amount of $129,808.27. Action Item: Authorize Mayor to sign the lease with the Southwest District Health for the establishment and operation pf the Nampa Women, Infant, and Children Supplemental Nutrition Program (WIC) office at the Idaho Hispanic Community Center. Action Item: Authorize the reallocation of FY25 Opioid funds in the amount of $50,000 from the Mental Health Coordinator position to the Nampa Narcan Initiative.
