PLEDGE TO THE FLAG: The pledge was given. F. AWARDS AND RECOGNITIONS: Chirico called for a moment of silence in remembrance of the lives lost in the Aurora shooting tragedy on Friday, February 15. 1. Proclaim February 19, 2019 as Naperville Heritage Society Day in honor of their 50th Anniversary Hinterlong presented the Proclamation. G. PUBLIC FORUM: 95th Street Expansion Doreen Swindall, discussed her request for a fence, the sound wall policy, and traffic in the area. Novack reviewed the cost-share offer from Will County stating that the proposal was for the City to assume the annual maintenance obligation of $100,000 and Will County would pay one-third of the installation price. He said that was rejected and that the speaker's request includes planting a solid line of trees in the median, instead the City will plant trees in 40-50' intervals consistent with the rest of the City. Council discussed the City's efforts which included landscaping and an offer to pay one-third of the installation on the condition that Will County pay the remaining two-thirds. Marshall discussed the report that was given to the Council on traffic enforcement in the area. Alternative Revenue Options Dick Furstenau, discussed the January agenda item recommending alternative revenue sources. CONSIDERATION OF MOTION TO USE OMNIBUS METHOD FOR THE CONSENT AGENDA: A motion was made by Councilwoman Brodhead, seconded by Councilman Hinterlong, to use the Omnibus method to approve the Consent Agenda. The motion carried by the following vote: Aye: 9- Chirico, Anderson, Brodhead, Coyne, Gustin, Hinterlong, Krummen, Obarski, and White I. CONSENT AGENDA: Approval of the Consent Agenda A motion was made by Councilwoman Brodhead, seconded by Councilman Hinterlong, to approve the Consent Agenda with the exception of item I9: pass the ordinance approving a major change to the Riverbrook Center Planned Unit Development in order to grant a conditional use for a daycare for the subject property located at 1567 North Aurora Road (Riverbrook Daycare) - PZC 18-1-127. The motion carried by the following vote: Aye: 9- Chirico, Anderson, Brodhead, Coyne, Gustin, Hinterlong, Krummen, Obarski, and White 1. Approve 01/03/2019 thru 02/01/2019 cash disbursement for $32,488,757.93 Council approved. 2. Approve the regular City Council meeting minutes of February 5, 2019 Council approved. 3. Approve the award of Bid 19-040, Centrifuge Dewatering Polymer, to Polydyne Inc. for an amount not to exceed $276,083.44 and for a two-year term Council approved. 4. Approve the award of Option Year One to Contract 18-078, Heavy Duty Truck Body Repair and Painting, to Rush Truck Center of IL for an amount not to exceed $105,000 Council approved. 5. Approve the award of Option Year Two to Contract 17-044, Brush Collection Program, to Steve Piper and Sons and Trees “R” Us, Inc. for an amount not to exceed $177,763 Council approved. 6. Approve the award of Option Year Two to Contract 16-011, Street Sweeping, to Waste Management of Illinois for an amount not to exceed $175,000 Council approved. Pass the ordinance amending Section 10-2-3-1:1.1 by adding a definition of hemp and excluding hemp from the definition of cannabis Enactment No.: ORD 19-025 Council passed. 9. Pass the ordinance approving a major change to the Riverbrook Center Planned Unit Development in order to grant a conditional use for a daycare for the subject property located at 1567 North Aurora Road (Riverbrook Daycare) - PZC 18-1-127 Novack expalined that in addition to the picket fence there will be highway guardrails installed. A motion was made by Councilman Hinterlong, seconded by Councilwoman Gustin, to pass the ordinance approving a major change to the Riverbrook Center Planned Unit Development in order to grant a conditional use for a daycare for the subject property located at 1567 North Aurora Road (Riverbrook Daycare) - PZC 18-1-127. The motion carried by the following vote: Aye: 9- Chirico, Anderson, Brodhead, Coyne, Gustin, Hinterlong, Krummen, Obarski, and White 10. Pass the ordinance granting a variance to reduce the amount of required off-street parking for the subject property located at 1331 W. 75th Street - PZC 18-1-132 Enactment No.: ORD 19-026 Council passed. 11. Pass the ordinance approving a variance to reduce the required interior side yard setbacks on Lots 71, 72, 73, 80, and 81 of the Ashwood Crossings Subdivision (Ashwood Crossing Duplex Lots) - PZC 19-1-001. Enactment No.: ORD 19-027 Council passed. J. PUBLIC HEARINGS: 1. Conduct the public hearing for the establishment of Special Service Area No. 30 for streetscape improvements on portions of blocks 429 and 430 of the downtown area in the City of Naperville (Item 1 of 2) Chirico opened the Public Hearing at 7:30 p.m. Steve Rubin, Petitioner, discussed the proposal for an SSA, the Downtown Advisory Commission recommendation, the 2030 Plan, rehabilitation needs in the downtown, and the implementation timeline. Novack explained that the new streetscape standards approval process, bids letting, the impact of changing to parallel parking, that the draft standards document is not online but can be provided upon request, the distance between curb and planters, items which will not be included in the cost share formula such as public infrastructure improvements, and that the SSA is based on EAV not property frontage area. Katie Wood, spoke in favor of streetscape improvements and the proposed cost-sharing plan. A motion was made by Councilman Hinterlong, seconded by Councilwoman Gustin, to continue the public hearing for the establishment of Special Service Area No. 30 for streetscape improvements on portions of blocks 429 and 430 of the downtown area in the City of Naperville to the March 5 City Council meeting. The motion carried by the following vote: Aye: 9- Chirico, Anderson, Brodhead, Coyne, Gustin, Hinterlong, Krummen, Obarski, and White 2. Identify the appropriate amount of City cost participation and direct staff to prepare an ordinance to establish Special Service Area No. 30 for streetscape improvements on portions of blocks 429 and 430 of the downtown area in the City of Naperville if fewer than fifty percent of the property owners object in the next sixty days (Item 2 of 2) A motion was made by Councilman Hinterlong, seconded by Councilwoman Gustin, to table the item to identify the appropriate amount of City cost participation and direct staff to prepare an ordinance to establish Special Service Area No. 30 for streetscape improvements on portions of blocks 429 and 430 of the downtown area in the City of Naperville if fewer than fifty percent of the property owners object in the next sixty days. The motion carried by the following vote: Aye: 9- Chirico, Anderson, Brodhead, Coyne, Gustin, Hinterlong, Krummen, Obarski, and White 3. Conduct the public hearing for the establishment of Special Service Area No. 31 for streetscape improvements near the southwest portion of Block 423 in the downtown area in the City of Naperville (Item 1 of 2) Chirico opened the Public Hearing at 7:55 p.m. Marilyn L. Schweitzer, Naperville, questioned the streetscape improvements, SSA coordination, and approval of development standards. Council asked about sustainability and landscaping efforts related to the improvements. Novack explained areas of staff emphasis and reliability on consultants in other areas, that planter boxes on Van Buren have performed better than street level plantings, and staff will ensure consistency in all landscaping.
