CALL TO ORDER: Mayor Wehrli called the meeting to order at 1:00 p.m. B. ROLL CALL: Present 6- Steve Chirico, Kelly Douglas, Ray McGury, Anthony Signorella, Mitch Stauffer, and Mayor Scott Wehrli Absent 2- Jason Dy, and John Koranda Also Present: Shebnem Ozkaptan, Budget and Administrative Manager; Detective Marty Creighton, Liquor & Tobacco Liaison, Naperville Police Department; Mike DiSanto, City Attorney C. PUBLIC FORUM: D. OLD BUSINESS: 1. Approve the special Liquor Commission meeting minutes of April 8, 2025 Attachments: Draft Minutes 4-8-25 A motion was made by Commissioner Stauffer, seconded by Commissioner Chirico, approved. The motion carried by a unanimous vote. E. NEW BUSINESS: 1. Consider Clubhouse540’s request to increase the Class M-Recreational license cap by one (1). Attachments: Clubhouse540_Redacted Liquor Commission approved and referred to the City Council an increase to the Class M-Recreational license cap by one (1). Petitioner Tom Schaefer presented Clubhouse540's request to obtain a Class M - Recreational license at 1466 Chicago Avenue. This will be a five bay golf simulator establishment. The previous establishment at this location held a liquor license with a similar business model. A motion was made by Commissioner Chirico, seconded by Commissioner Douglas, approved and referred to City Council. The motion carried by the following vote: Aye: 5- Chirico, Douglas, McGury, Signorella, and Stauffer Absent: 2- Dy, and Koranda City of Naperville Page 1 Printed on 8/21/2025 Liquor Commission Meeting Minutes - Final May 8, 2025 Under new business, Commissioner Chirico discussed regulating Delta 9 (THC derived from Hemp). It can be purchased at gas stations and there is no age restriction. Is this something that the Liquor Commission can regulate? City Attorney DiSanto provided a summary of the ordinance passed by City Council last year, outlining its current status. The ordinance restricts the sale of hemp-derived products to individuals aged 21 and older. More recently, Council requested that staff prepare a report on Delta-8 and Delta-9 THC, including potential regulatory options. This report is expected to return to Council for review next quarter, at which point Council will offer further direction. Although THC is distinct from alcohol and tobacco, the Liquor Commission remains a useful body for addressing substances that can cause impairment. Accordingly, City Council may ask the Commission to weigh in and offer recommendations for additional regulations. Commissioner Chirico inquired if the City's Home Rule authority can limit the sale of these products to only establishments that have a liquor license. City Attorney DiSanto will do research but he believes the answer is yes. Commissioner Signorella asked if the Liquor Commission could be involved in these types of discussions, for example the DUI reports could include data regarding alcohol v. cannabis. Commissioner Stauffer added a footnote about the Liquor Commission previously weighing in on topics like Kratom. Historically the Commission has been involved. Mayor Wehrli mentioned that most of the establishments selling these products have tobacco licenses which would fall under the purview of the Liquor Commission. F. REPORTS: 1. Receive BASSET statistics for April 2025 Detective Creighton presented the BASSET statistics for April 2025: 71 in person BASSET 17 online renewals 2. Receive the Liquor Concept Committee Report for April 2025 Attachments: Liquor Concept April 2025 Budget and Administrative Manager Ozkaptan presented the liquor concepts for the month of April. City of Naperville Page 2 Printed on 8/21/2025 Liquor Commission Meeting Minutes - Final May 8, 2025 Mayor Wehrli provided an update on the recent Liquor Seminar and the discontinuation of the State BASSET training program. Despite this change, the City will continue to require a Naperville-specific training course. This requirement was unanimously approved by City Council as recommended by the Liquor Commission and has been well received by local liquor establishments. Commissioner Chirico asked Detective Creighton about tobacco compliance checks. Detective Creighton mentioned the last check was completed in Mid-March, there were 3 violations; and the next compliance check will be in 2 weeks. Mayor Wehrli requested a tobacco license report to be prepared for the next Liquor Commission meeting to include historical data for the last 5 years, citations issued, and compliance check information. G. EXECUTIVE SESSION: H. ADJOURNMENT: A motion was made by Commissioner Chirico, seconded by Commissioner Stauffer, to adjourn the Liquor Commission Meeting of May 8, 2025.
