REASON FOR REQUEST / BACKGROUND Total debt service for the 2019 tax levy year amounts to $1,301,309 and the proposed abatements total $376,309 leaving $925,000 to be levied. The proposed debt service amount is returning the levy amounts to the 2017 levels. The Village Board may recall the County made an error in 2017 by over extending debt service. The correction was made in 2018. The Finance Committee reviewed three different scenarios to determine what a resident owning a $300,000 home would be. The Finance Committee approved a total levy including debt service in the amount of $6,605,276. The estimated amount the owner of a $300,000 home will pay in 2020 is $461.14. ORG# Total Amount for Approval ACCT# Budget Amount Variance ORDINANCE 2020- ABATING A PORTION OF THE 2019 TAX LEVY OF THE VILLAGE OF NILES FOR THE FISCAL YEARS BEGINNING MAY 1, 2019 AND ENDING APRIL 30, 2020 IN THE AMOUNT OF $376,309 WHEREAS, on March 25, 2014, the President and Board of Trustees of the Village of Niles adopted Village Ordinance #2014-18, a bond ordinance providing for the levying and assessment of taxes for the purpose of paying the principal and interest on the Bonds authorized by Ordinance #2014-18 that provided financing for portions of the Village of Niles Storm Water Relief Program, and; WHEREAS, the corporate authorities have caused to be filed with the Cook County Clerk, a certified copy of Ordinance #2014-18 directing said Clerk to levy and collect an annual tax for the purpose of paying the principal and interest on the bonds authorized by Ordinance #2014-18; and a certified certificate of tax reduction directing said Clerk to reduce and abate a portion of the tax levy authorized by Ordinances 2014-18, and; WHEREAS, on October 17, 2018, the President and Board of Trustees of the Village of Niles adopted Village Ordinance #2018-58, a bond ordinance providing for the levying and assessment of taxes for the purpose of paying the principal and interest on the Bonds authorized by Ordinance #2018- that provided financing for portions of the Village of Niles Infrastructure (Street Lights and Police Garage Facility), and; WHEREAS, the corporate authorities have caused to be filed with the Cook County Clerk, a certified copy of Ordinance #2018-58 directing said Clerk to levy and collect an annual tax for the purpose of paying the principal and interest on the bonds authorized by Ordinance #2018-58; and a certified certificate of tax reduction directing said Clerk to reduce and abate a portion of the tax levy authorized by Ordinances 2018-58, and; WHEREAS, on October 29, 2019, the President and Board of Trustees of the Village of Niles adopted Village Ordinance #2019-36, an ordinance providing for the levying and assessment of taxes for the fiscal year beginning May 1, 2019 and ending April 30, 2020; WHEREAS, the corporate authorities have caused to be filed with the Cook County Clerk a certified copy of Ordinance #2019-36 directing said Clerk to levy and collect an annual tax for the purpose of paying the levy and assessment authorized by Ordinance #2019-36, and; Ordinance 2020- WHEREAS, the corporate authorities of the Village of Niles have knowledge that an additional sum of $376,309 will be available for the above titled fiscal year to meet the debt service obligations of the Village of Niles for said fiscal year; and WHEREAS, it is in the best interest of the Village of Niles that the bond and interest tax levy and the Corporate Fund tax levy for said fiscal year be abated to the extent of $376,309. NOW, THEREFORE BE IT ORDAINED by the President and Board of Trustees of the Village of Niles, Cook County, Illinois: SECTION 1: That Village Ordinances 2014-18 and 2018-58 are hereby amended to abate a portion of the 2014A Bonds ($281,875) and the 2018 Bonds ($94,434) and levy only $6,605,276 for the 2019 tax levy. SECTION 2: That all amended provisions of the aforementioned Village Ordinances shall hereby remain in full force and effect. SECTION 3: That a certified copy of this Ordinance shall be filed with the County Clerk of Cook County, Illinois, on or before April 1, 2020 . SECTION 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication as required by law. PASSED: This 10th day of March, 2020. REASON FOR REQUEST / BACKGROUND This resolution authorizes an IDNR grant application for a new bike trail connection between the growing Touhy Triangle and the popular North Branch of the Chicago River Trail. The resolution obligates the Village to provide up to $250,000 in local match funding if the project is selected. The project would be constructed in FY22. Project Title: _____________________________________ The Village of Niles hereby certifies and acknowledges that it has 100% of the funds (local project sponsor) necessary to complete the pending Bike Path project within the timeframes specified herein for project execution, and that failure to adhere to the specified project timeframe or failure to proceed with the project because of insufficient funds or change in local recreation priorities is sufficient cause for project grant termination which will also result in the ineligibility of the local project sponsor for subsequent Illinois DNR indoor or outdoor recreation grant assistance consideration in the next two (2) consecutive grant cycles following project termination. ALL Projects It is understood that the project should be completed within the timeframe established in the project agreement and the Final Billing reimbursement request must be submitted within one year of the expiration date. Failure to do so will result in the Project Sponsor forfeiting all project reimbursements, and relieves DNR from further payment obligations on the grant. The Village of Niles further acknowledges and certifies that it will comply with (local project sponsor) all terms, conditions and regulations of 1) the PPL 91-646 Grant Program (BP) (17 IL Adm. Code 3070) 2) the federal Uniform Relocation Assistance & Real Property Acquisition Policies Act of 1970 (P.L. 91-646) and/or the Illinois Displaced Persons Relocation Act (310 ILCS 40 et. seq.), as applicable, 3) the Illinois Human Rights Act (775 ILCS 5/1-101 et.seq.), 4) Title VI of the Civil Rights Act of 1964, (P.L. 83-352), 5) the Age Discrimination Act of 1975 (P.L. 94-135), 6) the Civil Rights Restoration Act of 1988, (P.L. 100-259) and 7) the Americans with Disabilities Act of 1990 (PL 101-336); and will maintain the project area in an attractive and safe condition, keep the facilities open to the general public during reasonable hours consistent with the type of facility, cease any farming operations, and obtain from the Illinois DNR written approval for any change or conversion of approved outdoor recreation use of the project site prior to initiating such change or conversion; and for property acquired with Bike Path assistance, agree to place a covenant restriction on the project property deed at the time of recording that stipulates the property must be used, in perpetuity, for public indoor or outdoor recreation purposes in accordance with the Bike Path programs and cannot be sold or exchanged, in whole or part, to another party without approval from the Illinois DNR. BE IT FURTHER PROVIDED that the Village of Niles certifies to the best of its knowledge that the information provided within the attached application is true and correct.
