The Niles Plan Commission and Zoning Board of Appeals were called to order
at 7:00 P.M.
Chairman Kanelos asked everyone to stand for the Pledge of Allegiance.
Present with Chairman Thomas Kanelos and Village Attorney Joseph
Annunzio were Commissioners Thomas Surace, Angelo Troiani, Barbara
Nakanishi, Robert Schulter and Morgan Dubiel. Also present was Bruce
Sylvester, Senior Planner. Vice-Chairman Karen Dimond was excused.
Chairman Kanelos asked if there were any additions, clarifications or
corrections to the minutes of September 8, 2014. There were none.
Commissioner Dubiel moved to approve the minutes of September 8, 2014.
Seconded by Commissioner Surace, on roll call the vote was:
AYES: 6 Dubiel, Surace, Troiani, Nakanishi, Schulter, Kanelos
NAYS: 0
ABSENT: 1 Dimond
There being six (6) affirmative votes the motion carried.
OLD BUSINESS
14-ZP-27 Requesting a Special Use Permit per Appendix B, Section
VII (B)(2)(o) to allow a chimney-mounted wind turbine at
8449 North Chester Avenue.
NEW BUSINESS
14-ZP-31 Requesting a variation to rear-yard set-back
requirements in the R-2 zoning district as provided in
Appendix B, Section VII (C)(10) to allow a second floor
addition onto an existing single-family house at 8162
Greendale Avenue.
14-ZP-32 Requesting a Special Use Permit per Appendix B,
Section VIII (B)(3)(nn) to allow a 6-seat dental office at
8830 Dempster Street.
14-ZP-33 Requesting a variation to front-yard set-back
requirements in the R-2 zoning district as provided in

DISCUSSIONS
Update on Zoning an Subdivision Ordinance Rewrite Process
Chairman Kanelos stated he will be starting tonight's meeting with New
Business. He called for the first case to be presented.
14-ZP-31 Requesting a variation to rear-yard set-back
requirements in the R-2 zoning district as provided in
Appendix B, Section VII (C)(10) to allow a second floor
addition onto an existing single-family house at 8162
Greendale Avenue.
Bruce Sylvester, Senior Planner, stepped to the podium to present this case.
It is a small single family home in a residential neighborhood and the
petitioner would like to add a second floor for additional bedrooms and baths.
The petitioner is a young man with a growing family. Staff believes the
variation should be granted. The aerial view of the property was shown on
the overhead. The findings of fact have been met in that the addition is
designed, located and proposed so the public health, safety and welfare are
protected. It will also not cause substantial injury to the value of other
property in the neighborhood in which it is located.
Chairman Kanelos asked if there were any questions from the
Commissioners for Mr. Sylvester. There were none. There were no questions
from the public either. He then called the petitioner to the podium.
The petitioner and his architect approached and were sworn in.
Nick Larson, 8162 Greendale Avenue, Niles, IL 60714 (petitioner) and
Tom Lindsay, Lindsay Associates Architects, 950 River Drive, Glenview, IL
60025 (architect).
Mr. Lindsay explained the reason for the set-back.
Mr. Larson did not have anything to add to his architect's comments.

Chairman Kanelos asked if there were any other questions from the
Commissioners. There were none. There were no questions from the public.
He entertained a motion.
Commissioner Dubiel moved to approve 14-ZP-31 requesting a variation to
rear-yard set-back requirements in the R-2 zoning district as provided in
Appendix B, Section VII (C)(10) to allow a second floor addition onto an
existing single-family house at 8162 Greendale Avenue. It does meet all
findings of fact.
Seconded by Commissioner Surace, on roll call the vote was:
AYES: 6 Dubiel, Surace, Troiani, Nakanishi, Schulter, Kanelos
NAYS: 0
ABSENT: 1 Dimond
There being six (6) affirmative votes the motion carried.
The Board has the final say on this matter.
Chairman Kanelos called for the second item on the agenda.
14-ZP-32 Requesting a Special Use Permit per Appendix B,
Section VIII (B)(3)(nn) to allow a 6-seat dental office at
8830 Dempster Street.
Mr. Sylvester presented this case. The proposed location is in the same strip
center as Home Depot along Dempster Street near Greenwood Avenue. This
dental office will be located at the far west end of the strip center. There is
sufficient parking. The office is directly behind Portillo's, which has a brick
dividing wall along the rear of their drive-thru area. This makes the parking
for the dental office almost private. Staff recommends approval and stated
this request meets the Special Use findings of fact in that it is deemed
necessary for the public convenience at this location; it is designed, located
and proposed to be operated so the public health, safety and welfare will be
protected; and it will not cause substantial injury to the value of other
property in the neighborhood in which it is located.
Chairman Kanelos asked if there were questions from the Commissioners or
the public. There were none. He then called the petitioner to the podium.

60630 (broker) came forward and were sworn in.
Dr. Carlson explained he is moving his practice directly across the street from
where it is now located. He is currently in the Parkside building at Lutheran
General Hospital in Park Ridge. He will be moving to the center across the
street in Niles. He feels it is a more convenient location for his patient base.
He is a graduate of Northwestern University Dental School and has been in
practice over twenty years.
Mr. Brodson added comments as well.
Chairman Kanelos asked if there were any questions from the
Commissioners for the petitioner. There were none. There were no questions
from the public. He then entertained a motion.
Commissioner Dubiel moved to approve 14-ZP-32 requesting a Special Use
Permit per Appendix B, Section VIII (B)(3)(nn) to allow a 6-seat dental office
at 8830 Dempster Street
Seconded by Commissioner Nakanishi, on roll call the vote was:
AYES: 6 Dubiel, Surace, Troiani, Nakanishi, Schulter, Kanelos
NAYS: 0

Chairman Kanelos stated this Board is a recommending Board to the Board
of Trustees who can either confirm or negate this decision. It will be
necessary for the petitioner to contact Mr. Ostman and ask to be placed on
the Board of Trustees agenda. The petitioner will then be notified of the
date. Anyone in the audience who would like to be informed as to the date
this will be heard by the Board of Trustees, leave your name and address
with the recording secretary.
Chairman Kanelos called for the final item of new business on the agenda.

Mr. Sylvester presented the case. Pictures of the home are shown on the
overhead projector. This home is down the street from the home second floor
addition requested in case 14-ZP-31 earlier this evening.
This home already had permitted work completed. Along with that work, the
front-entry had a canopy type cover constructed over the front porch area.
This work had been completed when the inspection took place. The Village
inspector determined the canopy was 7" over the limit of the allowable front-
yard set-back requirement. Since the work was already finished, the
petitioner had to come before this Board to have it approved. If not approved
it would have to be re-done and have 7" removed. Staff does recommend
approval of this item.
Chairman Nakanishi asked if there should be railings on the front step area
under the canopy.
Chairman Kanelos said that would be a Code issue, not a Zoning issue. He
then asked if there were any other questions from the Commissioners. There
were none. There weren't any questions from the public. At that time he
called the petitioner to the podium to be sworn in.
Nicole Kantzavelos, 8146 Greendale Ave., Niles, IL 60714 came forward. She
explained the reason for the request. She had permitted work done on her
home. The front-entry had an aluminum awning/canopy over it. The
contractor replaced that with a new structure over the front door area. It is
similar to her next door neighbor's. She did not know it was 7" too large until
it was complete and the Village inspector advised her it needed approval.
This is why she is before the Board tonight.
Chairman Kanelos asked if there were any more questions for the petitioner.
There were none from the Commissioners or the public. He entertained a
motion.
Commissioner Nakanishi moved to approve 14-ZP-33 requesting a
variation to front-yard set-back requirements in the R-2 zoning district as
provided in Appendix B, Section IV (K)(3) to allow a roof-extension to cover a

Chairman Kanelos called for item that was tabled at the September 8, 2014
meeting.

The petitioner had requested to be on the agenda again this month. However
he was not present at tonight's meeting. Chairman Kanelos made a motion
to table the item for another month to give the petitioner a chance to state his
case with more information.
Commissioner Dubiel moved to table this item once again.

NAYS: 1 Troiani

Chairman Kanelos then entertained a motion to adjourn.
