All rose for the Pledge of Allegiance. PRESENT: 7 Chairman Thomas Kanelos, Commissioners Ted Karabatsos, Susan DeBartolo, Robert Schulter, Barbara Nakanishi, Thomas Parala and Morgan Dubiel. Also present was Director of Community Development Charles Ostman, Assistant Director Richard Wlodarski, Village Attorney Danielle Grcic and Commissioner Emeritus Angelo Troiani. Commissioner Emeritus Angelo Troiani will be calling the roll. Chairman Kanelos took a moment to congratulate the Cubs fans on their World Series win. He also extended best wishes to Commissioner Schulter and his wife on their 35th wedding anniversary. APPROVAL OF MINUTES Chairman Kanelos asked if there were any additions, clarifications or corrections to the minutes of October 3, 2016. There were none. Commissioner Dubiel moved to approve the minutes of October 3, 2016. Seconded by Commissioner DeBartolo, on roll call the vote was: AYES: 6 Dubiel, Karabatsos, DeBartolo, Schulter, Parala, Kanelos NAYS: 0 PASS: 1 Nakanishi There being six (6) affirmative votes the motion carried. NEW BUSINESS Chairman Kanelos called for the first item on tonight's agenda. For some reason the beginning of the meeting did not record. The recording starts with the approval of this item at the end of its presentation and continues for the entire rest of the meeting. 16-ZP-36 - Requesting approval of a plat of subdivision for lands located at 5757-5959 Howard Street. Rich Wlodarski presented this case. It is regarding the FedEx property at Howard St. and Menard Ave. The distribution center is on the west side of Menard. The employee and truck parking is on the east side of Menard Ave. Commissioner Dubiel thought this request had already been put before this Board. Mr. Wlodarski said that the property at 5757 Howard did come before this Board during the year for a fence variation. Brett Duffy, SpaceCo, 9575 Higgins Rd., Suite 700, Rosemont, came to the podium and was sworn in. He added a few comments to what Mr. Wlodarski already presented. Chairman Kanelos entertained a motion. Commissioner Dubiel moved to approve 16-ZP-36 requesting approval of a plat of subdivision for lands located at 5757-5959 Howard Street. Seconded by Commissioner DeBartolo, on roll call the vote was: AYES: 7 Dubiel, Karabatsos, DeBartolo, Schulter, Nakanishi, Parala, Kanelos NAYS: 0 There being seven (7) affirmative votes the motion carried. Chairman Kanelos stated this Board is a recommending Board to the Board of Trustees who can either confirm or negate this decision. It will be necessary for the petitioner to contact Mr. Ostman and ask to be placed on the Board of Trustees agenda. The petitioner will then be notified of the date. Anyone in the audience who would like to be informed as to the date this will be heard by the Board of Trustees, leave your name and address with the recording secretary. 16-ZP-37 - Requesting approval of a special use permit per Village Ordinance Appendix B, Sections VIII(B)(3)(u) and VIII(C)(3)(a) to allow a commercial school at 7017 Milwaukee Avenue. Rich Wlodarski said this location is next to Sherwin Williams Paint on Milwaukee Ave. This special use was requested under the old zoning code. Chairman Kanelos asked how does this jibe with the 2030 building code and the new code that says anything within 250 ft. of an intersection has to be retail. Mr. Ostman said the petitioner is asking this to be considered since the lease was signed prior to the new zoning code. Commissioner Dubiel said there was some concern about a school where young children might be attending. Are we casting too tight of a net having a school of this nature - that they have to come before this Board for a special use. It is straight forward, self contained, not a high risk thing. Mr. Ostman stated it is a CPR school. Page 5 of 15 Planning and Zoning Board Approved Meeting Minutes November 7, 2016 _________________________________________________________________ _______ Mr. Wlodarski said they have to make sure there is enough parking, no matter what type of school it is. Commissioner Dubiel said you mean for the net number of students. OK. Chairman Kanelos said so the special use will allow the non-retail facility within 250 ft. or is it because they were entered into the lease prior to the new code. Mr. Ostman said it was prior to the new code. Commissioner Karabatsos said what happens if it is within the 250 ft. before the lease. Mr. Wlodarski said since the Board is reviewing this under the old zoning code, that will not apply. If the petitioner came to the Village today, it definitely would apply. Chairman Kanelos asked why is the Board hearing this in November if this was submitted prior July 1, 2016. Mr. Wlodarski said the applicant will explain. Chairman Kanelos asked if there were other questions from the Commissioners for Staff. There were none. He called the petitioner to the podium. Kyle Nowack, 7017 N. Milwaukee Ave., Niles came forward and was sworn in. He would like to discuss parking. They will not have classes larger than twelve students. Most classes will be between six and twelve. He signed the lease June 13, 2016. After signing, there was a delay in getting the building ready. There was water in the space which had to be taken care of. The landlord also needed to store his construction equipment for the buildings being built next door. The lease was effective that same date. They have been credited for time lost in not being able to occupy the space. Chairman Kanelos asked if there were other questions for the petitioner or Staff. There were none. No public questions either. He entertained a motion. Commissioner Nakanishi moved to approve 16-ZP-37 requesting approval of a special use permit to allow a CPR training school at 7017 Milwaukee Avenue. The special use is necessary for the public convenience at the proposed location. It is designed, located and proposed to be operated so that the public health, safety and welfare will be protected. It will not cause substantial injury to the value of other property in the neighborhood in which it is located. Chairman Kanelos asked if there was an issue with parking. Chairman Kanelos said that is not the case. He can actually decide if there can be more discussion after a motion is made. Mr. Ostman said there are no parking issues. Rich Wlodarski said the petitioner had already stored things at this property not knowing he needed a business license or that this required a special use. They have been working on the place and cleaning it up in order to obtain a special use permit through Staff. Part of what is required for outside storage in this particular location is an engineering submittal to show how much they can get on the property because it is in a flood plain. The information requested was submitted this past Friday. Engineering has not had a chance to review it. He wants the Board to be aware this could take a week or more. This may affect the Board's decision about moving forward this evening or waiting for the report. Chairman Kanelos asked if there was a pressing issue to vote on this before getting the engineering report. Mr. Wlodarski said no. Chairman Kanelos said he understands the petitioner is already in the building and storing things. He would like to entertain motion to table this until next meeting. Commissioner Nakanishi moved to table 16-ZP-38 requesting approval of a special use permit to allow outdoor storage at 6801 Howard Street, Niles, per Village Ordinance Appendix B, Section 8.2(A) and 8.3 (P). Seconded by Commissioner DeBartolo, on roll call the vote was: AYES: 5 Nakanishi, Parala, DeBartolo, Schulter, Kanelos NAYS: 2 Dubiel, Karabatsos There being five (5) affirmative votes the motion carried. 16-ZP-39 - Requesting approval of a special use permit to allow additional cellular phone equipment on an existing monopole located at 7500 Caldwell Avenue, Niles, per Village of Niles Zoning Ordinance Appendix B, Section 8.3(Y). Mr. Wlodarski said Staff recommends approval. The rest of his presentation was inaudible. Chairman Kanelos said Stu Chapman is the consultant to the Village of Niles on all cell tower issues. Because of federal law, if this Board doesn't approve it tonight, it will be approved automatically. It goes with a positive recommendation to the Trustees. Commissioner Dubiel said the report mentioned an ice bridge. What is that? Commissioner Karabatsos said it is a tray underneath to catch/break the ice before it falls. There were no more questions from the Commissioners or the public. Chairman Kanelos entertained a motion. Mr. Wlodarski said this is unique. It is almost like an interior lot but it's not because there is a street that runs through it that serves property in Morton Grove. It just happens to be a Niles street because there is a big easement that runs through there. It is considered a corner lot by zoning. Chairman Kanelos asked to see the site plan on the overhead. It shows the addition. The garage is already 18 ft. off the property line. So the extension in the back is not going to come out any further, correct? Mr. Wlodarski said correct. Commissioner Dubiel had a question for Mr. Ostman. This home was probably built in the late 60s. The original set back allowed this 18 ft. in the original code. Since then, the Village has tightened it to 25 ft., correct? So that is the reason for this variation. Mr. Ostman said correct. Chairman Kanelos said there were no other questions from the Commissioners and called for the petitioner. Vijay Patel, 8353 N. Newland Ave., Niles, came forward and was sworn in. He had nothing to add. Mr. Wlodarski explained everything in his presentation. Chairman Kanelos asked if there were any questions for the petitioner from the Commissioners or any questions from the public. There were none. He then entertained a motion. Anyone in the audience who would like to be informed as to the date this will be heard by the Board of Trustees, leave your name and address with the recording secretary. 16-ZP-41 - Requesting approval of parking credits per Zoning Ordinance Section 15.10 for a proposed new restaurant business in a multi-tenant building located at 9347-9371 Milwaukee Avenue. Mr. Wlodarski said the biggest issue is that it requires more parking. But the Fresenius place mostly has people being dropped off. So they don't use nearly the number of spaces required. For that reason, no parking credits are required. Chairman Kanelos said 9371 is the dialysis place. They require 70 stalls. How many stations are in the dialysis place? Commissioner Dubiel said if this parking credit is granted and Fresenius then vacates, how would we function with this credit. Are there limitations or would it be restricted? Mr. Wlodarski said the reason they are in front of this Board now is because the proposed restaurant claims a certain amount which obviously they don't need. If they go out and another retail space moves in, with the same amount of square footage, [inaudible]. Chairman Kanelos asked if, in a case like this, does the credit only pertain to the existing business. Mr. Ostman said exactly. Chairman Kanelos said so if any one of these spaces in the strip mall would be vacated and a new company comes in, they would have to come before this Board. Commissioner Dubiel said let's say 9351 is vacant. He comes in there; he only has 8 spaces and he is required to have 8 spaces. He wouldn't have to come before the board, right? Or are they going to look at the entire space? Chairman Kanelos said they always look at the entire space for parking. Mr. Ostman said they are looking at the entire shopping center. Commissioner Dubiel said so in granting this, are we making it harder to rent vacant space in this center? There are two vacancies. Mr. Ostman said he'd have to figure out how the new code reads. He'll have to get back to him with that information. Chairman Kanelos asked if there were any more questions for Staff. There were none. Commissioner Dubiel said the new café is required to have 19 spaces. But this new vacancy only has 15? If the area square footage is the same, and the formula is the same, why do they come up with different numbers. There was much discussion among the Commissioners about this issue. Obviously it was incorrect in the report. Chairman Kanelos said there is an issue here. He called the petitioner forward. Ronald Grace, Attorney, 30 N. LaSalle St., Chicago. He built this center in 1968. The dialysis center has been there 9 years. They just extended their lease another 5 years. If they required more spaces, then the issue would arise again. Because the code requires a different number of required parking spaces for each type of use, that's the regulation that applies. If there were not sufficient spaces for the uses in the future, then the Board would have the opportunity to look at it again. The numbers that came from Fresenius are pretty exact. They have 32 patients per shift. Just under 70% of them arrive by van or taxi. There are two shifts per day. They need 10 spaces for patients and 18 for the staff. So they do not require 70 spaces just because that is the way the ordinance is written. Where is the credit to reduce the requirement for Fresenius rather than the other users? Commissioner Dubiel asked Staff about the chart. Mr. Wlodarski clarified Bruce [Sylvester] did take in the non-square footages of the kitchen. He should have indicated how much space was non-kitchen. If the dialysis space did go out, it's is figured right now at 5 per 1,000. But it is a retail Page 11 of 15 Planning and Zoning Board Approved Meeting Minutes November 7, 2016 _________________________________________________________________ _______ center, so anyone else would be figured at 3 per 1,000, not 5 per 1,000. That would lessen the overall effect on …….. Chairman Kanelos asked - but the 5 per 1,000 is because it's medical? And if a restaurant would go in there, it would be 10 per 1,000? In essence, because they've been given credits, anything that would take the total above 123 stalls would have to come before this Board. Mr. Wlodarski said correct. Commissioner Dubiel was questioning non-kitchen areas. Again, much discussion back and forth about the arrival at number of parking credits issued. Commissioner Schulter asked once the parking is eliminated and the patio is in place, what will be done to insure safety of patrons dining on the patio. Mr. Grace said there will be a guard rail. Commissioner Dubiel summarized to Mr. Grace there are currently 123 parking spaces. He is over that amount now. Once this restaurant is built, it will lower it so there will be a net of 113. Mr. Grace said right now there are 133, net out to 123. Commissioner Dubiel said that is 22 stalls below the requirement per code [inaudible]. Is there a restriction in Fresenius' lease to just 28 stalls? Mr. Grace said there is not. Chairman Kanelos asked the capacity and square footage of the patio. Marilyn Grace, 680 N. Lake Shore Drive, Chicago, came forward and was sworn in. She is the manager and handles leasing at the center for the past 20 years. The outdoor usage depends on the size of the tables used. Round or rectangular? It is up to the architect to come up with the number. They don't anticipate more than 20 because of the circulation needed to get around the tables. Proposed size is 16 x 20. Chairman Kanelos asked how many months the patio will be open. Mrs. Grace said the tenant is not planning on putting heating lights in so probably 4 to 5 months tops. There is no language in the zoning code that accounts for outdoor dining. Chairman Kanelos called for the final item on tonight's agenda. 16-ZP-42 - Requesting approval of parking credits per Zoning Ordinance Section 15.10 for a proposed new restaurant business in a multi-tenant building located at 8808 Milwaukee Avenue. Rich Wlodarski stated this location is the old Rossini's at Milwaukee and Dempster. The petitioner had to come in front of this Board because the former restaurant has been closed for more than six months. [some of the content is inaudible]. There were no questions from Staff. Chairman Kanelos called for the petitioner to come to the podium and be sworn in. David Lidstrom, 731 Garfield, Libertyville, said he did not realize he needed parking credits. He found out from the landlord there is a lease restriction with the furniture store on the parking stalls. Mr. Lidstrom gets 28 stalls. If they didn't have a restriction [inaudible]. He feels they are not getting to the right formula. Chairman Kanelos asked if this number of 2,700 sq. ft. is inclusive of the kitchen or is this a larger restaurant and is the 2,700 sq. ft. net of the kitchen. Mr. Wlodarski guessed that would be the table area, not the kitchen. The applicant would have to confirm that number. Mr. Lidstrom said including the bar area [he subtracted the back bar]. He did the calculations and did not include the kitchen. Chairman Kanelos asked if these numbers are always provided by the petitioner and then verified by Staff? Mr. Wlodarski can't answer that. He thinks more often than not Staff would have information from an architect or from a drawing. In this case it is an existing space. Commissioner Dubiel feels there is an inconsistent method for collecting data. He is comparing this request with the previous one that the formula seems to be different. Chairman Kanelos asked if, in the future, there can be a policy where the Board can verify for themselves the square footage of the property. They would to see a layout. There were no more questions from the Commissioners or from the public for the petitioner. He entertained a motion. Commissioner Dubiel moved to approve 16-ZP-42 request for parking credits per Zoning Ordinance Section 15.10 for a proposed new restaurant business located at 8808 Milwaukee Avenue.
