1. Call to Order
Chairman Schwall called the meeting to order in the Terrace Room of Village Hall, 1225 Cedar Lane, at
5:35 PM.
2. Public Comments
There were no comments from the public.
3. Review of Minutes
Commissioner Rubenstein moved, seconded by Commissioner Katz, to approve the minutes of the July
12, 2012 meeting of the Architectural Control Commission (ACC) without corrections. On a voice vote,
the motion carried.
4. Request for Permit Extension
a. 2110 Mallard Drive – Ruzy Cless: Permit extension request for a new single family home
(Permit #10-G-170)
Assistant Director Desario presented the request. Ruzy Cless is the property owner of 2110 Mallard
Drive. A building permit was approved for the construction of a new single family home on the property.
That initial permit expired on February 24, 2012 and, thus far, the residence has not been completed.
While a 90-day administrative extension was given, additional time is needed to complete the home.
The current construction status is as follows:
The interior has been completed to the point of insulation, which was inspected and approved
by the Village

Initial final inspection is pending
Water, storm, and sanitary utilities have been completed and approved by the Village
Rough/final grading have yet to be completed
Mr. Cless requests that the Commission grant him a permit extension through November 2012 in order
to complete the remaining work.
In a letter dated August 1, 2012 to the ACC and Building Department, Mr. Aberson noted that the
project has taken longer than originally anticipated due to the client’s request that two firms detail out
the exterior masonry conditions prior to commencement. According to Mr. Aberson, this added 10
months to the overall schedule, which is now planned for completion by the end of November 2012.
During ACC discussion of the permit extension request, Mr. Aberson commented that the client is very
detailed-oriented, which has delayed construction. The Commission discussed whether or not the end of
November was a realistic target for completion. Mr. Poupard referred Commissioners to the proposed
exterior and interior completion schedule included as part of the meeting materials. Messrs. Aberson
and Poupard also shared relevant architectural plans. Mr. Poupard noted the larger scope of the
project—a total of 15,000 square feet and intricate design plans. He reported that, thus far, the Village
has not received any complaints from neighbors regarding the site.
To address the request of Mr. Cless and facilitate completion of the residence by the targeted date,
Commissioner Heidbrink moved, seconded by Commissioner Rubenstein, to grant a permit extension
through December 1, 2012 for the property at 2110 Mallard Drive, contingent upon: 1) receiving a
progress report of the construction work to-date on the property at the October 2012 ACC meeting and
2) the property owner explaining in person at said meeting why construction has not progressed on or
ahead of schedule, if that continues to be the case. On a voice vote, the motion carried.
5. New Single Family Elevations
Commissioners considered three new single family home elevations. Commissioner Town moved,
seconded by Commissioner Heidbrink, to allow staff to review and process the appropriate paperwork
for each of the following elevations:
a. 664 Laburnum Drive
b. 560 Helen Drive
c. 950 Butternut Lane
On a voice vote, the motion carried.
6. Proposed Schedule for ACC Review of 2012 Codes
Director Poupard reported that, beginning at its September 2012 meeting, the ACC will work with staff
to review the latest building and development regulations from the International Code Council. In
preparation, staff are comparing relevant codes, as well as local amendments and flagging those that
warrant Commission discussion.
Director Poupard commented that continuously improved international codes have reduced the need
for local amendments. He requested that Commissioners focus on issues that have occurred in the field,
related to, for example, window wells, sequencing of construction, and water coolers. Staff created a
specific format with the intent of streamlining the ACC code review process. Nonetheless, these
meetings are likely to run longer.

7. New Business
There was no new business.
8. Old Business
Director Poupard reported that the Midway Road property owner did not meet deadlines associated
with the relevant permit extension. Consequently, said property owner was issued a ticket and a court
date has been set for September 2012.
9. Adjournment
There being no further business, Commissioner Menn moved, seconded by Commissioner Heidbrink, to
adjourn the meeting. On a voice vote, the motion carried. Chairman Schwall adjourned the meeting at
6:10 PM.
