30 Commissioner Cliff Town was appointed as Chairman Pro Tem and called the meeting to order in the
31 Terrace Room of Village Hall, 1225 Cedar Lane, at 5:32 p.m.

34 Chairman Pro Tem Town called the roll. A quorum was present.

36 Review of Minutes
37 Commissioner Katz moved, seconded by Commissioner Menn, to approve the November 2014
38 Architectural Control Commission (ACC) meeting minutes as submitted. On a voice vote, the motion
39 was unanimously carried.

41 Public Comments Regarding Items Not on the Agenda

44 Continued Review of Building Permit Extension Request – 1722 Chapel Court
45 Assistant Director for Building and Development Nick Desario said he would be presenting a summary of
46 events occurring at 1722 Chapel Court. He also asked for an introduction of all in attendance concerned

1 with this address. Members of the Risinger Family were recognized in attendance on behalf of their
2 mother, the owner of the property at 1720 Chapel Court.
3 Assistant Director Desario said that no construction has taken place at 1722 Chapel Court since the last
4 meeting of the ACC. Assistant Director Desario gave a summary timeline of events dating back to
5 October. The summary included that Oct. 1 was the date at which the stop work order was issued by
6 the Village and noting of the excavation issues also occurred then. This was also the time that the issue
7 of what type of backfill would be used to save the six trees that were adversely affected by the
8 excavation. Assistant Director Desario also said that on November 4 the Village received a permit
9 revision and that permit revision was approved on that date. This gave permission for backfill process to
10 begin.

12 At this time, Ryan Risinger also participated in the discussion as a representative of the owner of the
13 property at 1720 Chapel Court. There was discussion and review of the issues concerning the
14 structural soil and the cost of it for backfill. The cost for the structural soil backfill was estimated at over
15 $20,000 initially and then it was confirmed by other sources including the Village Public Works that it
16 would only be $3000 for the soil. There was discussion of the area that needs to be backfilled using the
17 structural soil.

19 On November 25, the permit revision was ready for approval with the changes that all parties had
20 agreed on including the areas to use the structural soil. On this date, the homeowner at 1722 then
21 brought up issues regarding two of the trees on the property at 1720 Chapel Court and said he did not
22 want to put forth the escrow money until he is indemnified for the two trees on neighbor’s property.

24 At this time, Director Poupard joined the discussion and said that the Village does not have ability to
25 indemnify nor give permission to cut down trees on a neighbor’s property. The neighbors joined the
26 discussion.

28 Discussion of a construction schedule was addressed and residents were concerned that since August
29 there has not been any construction schedule presented. Residents also raised concerns that the delays
30 are now intentional. There was further discussion about what the Village can do now to protect the
31 trees. Residents would like the trees to have structural soil put in immediately.

33 The ACC recommended that Director Poupard contact the Village Attorney to see what can be done.

35 Continued Review of Expired Permit – 560 Pfingsten Road
36 Director Poupard gave an update on this expired permit and confirmed that the case will go to Court on
37 December 12th. He said that violation tickets have been issued. Director Poupard said that the trial will
38 be set for January and that the Village’s desire is that the order will be approved to tear it down. The
39 costs for a demolition were also discussed and also that the plans would be for the Village to keep the
40 foundation and do the backfill and then place a lien on the property. This would come after approval by
41 a Judge to do the tear down.

46 The ACC reviewed the information on the new single family home elevations.

1 Motion by Katz, seconded by Urbanczyk, to approve these single family home elevations as presented.
2 On a voice vote, there were all ayes and the motion passed.

10 There being no further business, Commissioner Katz moved, seconded by Commissioner Menn, to
11 adjourn the meeting. On a voice vote, the motion unanimously carried and the meeting adjourned at
