APPROVED MINUTES OF A MEETING OF THE PLANNING & ZONING COMMITTEE VILLAGE OF NORTHBROOK COOK COUNTY, ILLINOIS APRIL 24, 2012 Trustee Karagianis called the meeting to order in the Terrace Room of the Village Hall at 6: 09 p.m. On roll call, present were: Trustees Buehler and Heller; a quorum was present. Absent: none (0); Also present: President Frum, Trustees Scolaro and Israel, Village Manager R. Nahrstadt, Director of Development and Planning Services T. Poupard, Economic Development Coordinator D. Schoon, Fire Chief M. Nolan, Planner M. Kohlstedt, Harold Francke, Jim Moyer and Jerry Frumm. Discussion of 1000 Sunset Ridge – Senior Lifestyles Planner Kohlstedt provided an exhibit outlining the concerns which were raised by the Board at the April 10th regular board meeting. The Committee reviewed these concerns and were discussed as follows: The bulk and height of the proposed development appear to be too great for the site; Planner Kohlstedt provided an aerial image and renderings of the proposed site plan with both phases constructed. After reviewing, the Committee felt there were no immediate concerns. The adequacy of the provided stormwater management on the site; Planner Kohlstedt presented both the preliminary and current proposals. After review, it was determined that there is still enough storage capacity to meet Village Code. Planner Kohlstedt stated that during preliminary review there was some interest in adding more green space; the applicant addressed this request with the elimination of the fountain in the front of the property. The sufficiency in the number of provided parking spaces; Planner Kohlstedt indicated that the Zoning Code requires 91 parking spaces; the applicant would be providing 93 spaces. It was noted that when the Plan Commission recommended the approval of the application, there was a condition included in their recommendation which stated that prior to the construction of phase 2, the developer and the Village would review the site to determine if there was a need for additional parking spaces to be installed. Committee members indicated that parking had been adequately addressed. Whether or not an impact fee for emergency services should be established; the Fire Department provided a report indicating that there is adequate staffing and response time to the subject property and therefore did not feel an impact fee was necessary. President Frum stated she initially raised concern of an impact fee, however after reviewing the report, did not see a need for it. Trustee Karagianis agreed, however was concerned of being “boxed” out of being able to charge an impact fee in the future and asked the Village Attorney if the Village could impose a minimal emergency services impact fee at this time to at least have it on the books. Village Attorney Elrod explained that imposition of an impact fee was not an easy task and there were many elements involved with Illinois and federal laws for local government. He stated it would be an intense amount of work to justify a minimal fee. Trustee Heller was in agreement with President Frum, as he too was initially in favor of an impact fee; however after reviewing the Fire Department report does not see a need for the fee. 1 Trustee Buehler stated that some of the elderly cannot afford the current healthcare system, and was concerned that an impact fee may cause them to avoid calling 911 in fear of receiving an ambulance or hospital bill. President Frum requested that some general verbiage be included in the development agreement that if the Village adopts an emergency services impact fee in the future, that future construction would be subject to the fee. Petitioner Hal Franke responded that he appreciates the Village requesting an “open door” clause, and he is aware of the type of clause the Village Attorney will include in the development agreement and that the petitioner would be okay with it. Senior Lifestyle representative Jerry Frumm voiced his concern of how hard he has worked to receive equity for this project, and was concerned that by leaving the door open he would receive many questions/concerns from their lenders. Trustee Karagianis stated he did not believe this would happen. Trustee Karagianis made a motion referring the matter back to the Board of Trustees with a recommendation of approval and that the Village Attorney be directed to begin drafting the approval documents at the expense of the petitioner. Trustee Heller seconded the motioned. On voice vote, the motion was approved. Discussion: Proposed ICS District, Whether or Not to Send Directly to Plan Commission Trustee Karagianis made a motion, seconded by Trustee Heller, to send the proposed ICS District matter directly to the Plan Commission. On voice vote, motion was approved. Adjourn Trustee Buehler made a motion, seconded by Trustee Karagianis, to adjourn the meeting. On voice vote, the motion was approved.
