123 Madison Street Village of Oak Park Oak Park, Illinois 60302 www.oak-park.us Meeting Minutes President and Board of Trustees Monday, March 23, 2015 7:00 PM Village Hall Special Meeting at 7:00 p.m., in Council Chambers II. Roll Call Present: 6- Village Trustee Barber, Village Trustee Brewer, Village Trustee Ott, Village Trustee Salzman, Village Trustee Tucker, and Village President Abu-Taleb Absent: 1- Village Trustee Lueck III. Non-Agenda Public Comment Timothy Silver. Mr. Silver expressed concern that patrons of businesses located in his condo building are parking illegally in the alley behind the building. IV. Regular Agenda A. ORD 15-085 An Ordinance Authorizing the Purchase and Lease of Certain Real Property Located at 932-946 Madison Street in the Village of Oak Park. Village Manager Pavlicek noted that the District 97 Administrative Building will become the Village's property later this year per an intergovernmental agreement approved in 2014. The Village feels that since the adjacent Robinson's Ribs property is actively on the market, it should be acquired and combined with the D-97 property as part of the redevelopment of Madison Street. The purchase price is within the range of the appraised value of the property. Robinson's will lease the premises through November of 2015; then the Village will begin to actively market the property. There was a brief discussion. It was moved by Village Trustee Brewer, seconded by Village Trustee Tucker, that this Ordinance be adopted. The motion was approved. The roll call on the vote was as follows: AYES: 6- Village Trustee Barber, Village Trustee Brewer, Village Trustee Ott, Village Trustee Salzman, Village Trustee Tucker, and Village President Abu-Taleb NAYS: 0 ABSENT: 1- Village Trustee Lueck B. RES 15-249 A Resolution to Approve a Temporary License Agreement between the Village of Oak Park and RRV Motorcars II, LLC and Authorizing Its Execution. Village Manager Pavlicek stated that staff had a request from Autobarn, the Village of Oak Park Page 1 Printed on 4/21/2015 President and Board of Trustees Meeting Minutes March 23, 2015 new owner of Volvo Oak Park, seeking a temporary parking location for their used car inventory that they are bringing to the new facility. After performing an analysis of various locations, staff felt comfortable with utilizing the upper portion of the Holley Court Garage. There is mutual agreement with Autobarn that this arrangement will be for 60 days. Any subsequent request will be negotiated at a higher rate and would be brought back to the Board. Village Trustee Barber asked about liability for damage to any of the vehicles. Village Attorney Paul Stephanides stated that the agreement requires that they have auto and commercial general liability and also to indemnify the Village. Village Trustee Barber also asked if Autobarn would effectively be selling cars and arranging test drives out of the garage. Village Manager Pavlicek replied that the cars will be viewable online but they are not promoting that location. Anyone expressing interest in a vehicle would conduct business out of the Garfield and Harlem location; an Autobarn representative would be the only person driving a vehicle out of and back into the garage. Village Trustee Tucker commented that movement of these 100 cars should be minimal, since it will be only those specifically called for when someone is interested in a car. Village President Abu-Taleb expressed disappointment that a representative from Autobarn was not present to answer these questions. He wanted to know with certainty that 100 cars would not be coming in and out of the garage every day and suggested tabling this Item until a representative could be present. Village Manager Pavlicek noted that the Board has that option; however, their next business meeting won't be until April 20, which may put Autobarn at a disadvantage. Village President Abu-Taleb stated that this will be adding a lot of stress to the operation of that lot for the benefit of one business; if they are serious about their request, they should be present. Village Trustee Salzman stated that this storage issue could have been anticipated, as several people pointed out that there may be trouble with space for their inventory when the loan for Autobarn was approved. He asked if a process could be created that would vet those types of contingencies prior to the initial execution of future agreements. He agreed with Village President Abu-Taleb's comment regarding having someone present to answer questions. Village President Abu-Taleb added that he is not sure if this arrangement will work out, regardless of Autobarn being here or not. He referred to the provision requiring 30 days notice to terminate the agreement and said he would be more comfortable with a provision for half that time. Village of Oak Park Page 2 Printed on 4/21/2015 President and Board of Trustees Meeting Minutes March 23, 2015 Village Trustee Tucker suggested a 14-day notice to allow the Village to cancel the agreement if things are not going well. Village Trustee Barber suggested restricting them from moving cars in and out during hours of heavy traffic. The motion and second were amended to include those suggestions. It was moved by Village Trustee Ott, seconded by Village Trustee Barber, that this Resolution be adopted as amended. The motion was approved. The roll call on the vote was as follows: AYES: 5- Village Trustee Barber, Village Trustee Brewer, Village Trustee Ott, Village Trustee Salzman, and Village Trustee Tucker NAYS: 1- Village President Abu-Taleb ABSENT: 1- Village Trustee Lueck V. Adjourn It was moved by Village Trustee Ott, seconded by Village Trustee Tucker, to adjourn. A voice vote was taken and the motion was approved. Overview: The Ordinance authorizes the purchase of the property located at 932-946 Madison Street from its current owners and the lease back of the property to the owners through November 30, 2015. B. RES 15-249 A Resolution to Approve a Temporary License Agreement between the Village of Oak Park and RRV Motorcars II, LLC and Authorizing Its Execution. Overview: The Village has recently entered into a redevelopment agreement with RRV Motorcars II, LLC (AutoBarn of Oak Park). AutoBarn is in need of temporary parking for approximately 100 vehicles in order to open their business and is requesting use of the rooftop level of the Holley Court Garage for the next 60 days.
