Call to Order Village President Abu-Taleb called the Emergency Meeting to order at 6:33 P.M. II. Roll Call Present: 7- Village President Abu-Taleb, Village Trustee Andrews, Village Trustee Boutet, Village Trustee Buchanan, Village Trustee Moroney, Village Trustee Taglia, and Village Trustee Walker-Peddakotla Absent: 0 III. Agenda Approval It was moved by Village Trustee Andrews, seconded by Village Trustee Moroney, to approve the Agenda. The motion was approved. A voice vote was taken and the motion was approved. IV. Non-Agenda Public Comment Cate Readling. Ms. Readling expressed concern regarding a Declaration of a State of Emergency. She asked that residents not be criminalized for being outside. V. Regular Agenda ORD 20-047 An Ordinance Authorizing the Village President to Declare a Local State of Emergency and Order a Temporary Curfew as Part of a Declaration Village Manager Pavlicek stated that yesterday at about 2:00 P.M., the police began receiving a high level of calls for service. Since that time, eleven businesses experienced criminal damage to property, with one business actually broken into and burglarized. In addition, 39 residential properties and six cars were tagged with graffiti overnight. As calls for services increased, Acting Chief Moran asked about the possibility of mirroring Chicago's overnight curfew that began at 9:00 P.M. and ended at 6:00 A.M. She worked with the Village Attorney regarding the legal process and yesterday were able to ask the Village President to do that under his emergency powers. The Police Chief found it very beneficial last night to see a reduction of non-essential activity outside, noting that there were exceptions for medical and essential work purposes. Acting Chief Moran asked that this be considered again. Staff is asking that the Board consider this as a policy request for just the next seven days. Village Attorney Stephanides stated that this ordinance does not formally declare a State of Emergency. It just allows the President to establish a state of emergency per the circumstances at the time.This action is required by State Statute and the Village President's authority would end with the first regular meeting after he has taken that Village of Oak Park Page 1 Printed on 6/16/2020 President and Board of Trustees Meeting Minutes June 1, 2020 action. Therefore, the Board would have to authorize the Village President to do this going forward on a seven day basis. Village Trustee Walker-Peddakotla asked what defines essential work. Chicago's curfew restricted the ability of lawyers to advocate for clients in jail. She wants to make sure protesters and activists are able to have access to whoever they need to get out of jail. Village Attorney Stephanides stated that essential workers include law enforcement, fire, public works and media personnel. Law enforcement personnel can include lawyers under that definition. He also clarified the intention of the ordinance; that it authorizes the Village President to set a curfew. This can be done on a day to day basis or as a combination of days. Village Trustee Buchanan understood that this gives the authority to set a curfew and asked Village President Abu-Taleb what his plans are regarding that. Village President Abu-Taleb stated that he will discuss this with the Village Manager and the police to decide if this is needed He wants to give the police the necessary tools to protect the community. Village Trustee Boutet asked if this is necessary tonight and if this is for a day or multiple days. Village Manager Pavlicek stated that Acting Chief Moran believes it would be beneficial if tonight at 9:00 there were a curfew put in place until 6:00 tomorrow morning. There is no expectation that this would need to continue the day after. The situation has been fluid and not associated with any activities in Oak Park; all protests, etc. have been peaceful. However, it is impossible to predict tomorrow. Village Trustee Taglia supports this and wants to give the Police Chief the maximum flexibility. Village Trustee Andrews also supports it with the understanding that it includes legal workers to support people in jail. Village Trustee Moroney supports this as well and noted it is an unpredictable environment right now. Other surrounding municipalities are establishing curfews as well. Village Trustee Walker-Peddakotla asked how the curfew will it be enforced without racial profiling. The Village needs to be aware about what this situation is about. She suggested that people be advised of the curfew well in advance to allow them to get home. It was moved by Village Trustee Taglia, seconded by Village Trustee Moroney, that this Ordinance be adopted. The motion was approved. The roll call on the vote was as follows: AYES: 6- Village President Abu-Taleb, Village Trustee Andrews, Village Trustee Boutet, Village Trustee Buchanan, Village Trustee Moroney, and Village Trustee Taglia NAYS: 1- Village Trustee Walker-Peddakotla ABSENT: 0 VI. Adjourn It was moved by Village Trustee Moroney, seconded by Village Trustee Buchanan, to adjourn. The motion was approved. A voice vote was taken and the motion was approved. Public statements of up to three minutes will be read into the record during Non-Agenda public comment or Agenda public comment, as an individual designates. If email is not an option, you can drop comments off in the Oak Park Payment Drop Box across from the entrance to Village Hall,123 Madison Street, to be received no later than 5 PM the day of the Village Board meeting. Non-agenda public comment will be limited to 30 minutes with a limit of three minutes per statement. If comment requests exceed 30 minutes, public comment will resume after the items listed under the agenda are complete.
