Call to Order Village President Abu-Taleb called the meeting to order at 5:30 P.M. He authorized a statement be read providing that the meeting is being held remotely due to COVID-19 restrictions and guidelines and that it is not prudent to have people present at the Village Board's regular meeting location due to public health concerns related to that pandemic. II. Roll Call Present: 7- Village President Abu-Taleb, Village Trustee Andrews, Village Trustee Boutet, Village Trustee Buchanan, Village Trustee Moroney, Village Trustee Taglia, and Village Trustee Walker-Peddakotla Absent: 0 III. Consideration of Motion to Adjourn to Executive Session to Discuss Personnel It was moved by Village Trustee Andrews, seconded by Village Trustee Walker-Peddakotla, to enter into Executive Session pursuant to 5 ILCS 120/2/(c) (21) Approval of Meeting Minutes from September 21, 2020 and 5 ILCS 120/2/(c)(1) - The Compensation and Performance of Specific Employees of the Village. The motion was approved. The motion was approved. Minutes A. MOT 21-27 Motion to Approve Minutes from Regular Remote Meeting of February 1, 2021 and Special Remote Meeting of February 8, 2021 of the Village Board. It was moved by Village Trustee Moroney, seconded by Village Trustee Andrews to approve the Minutes. The motion was approved. Non-Agenda Public Comment There was no Non-agenda Public Comment. X. Village Manager Reports On a quarterly basis, the Finance Department prepares and provides a quarterly financial report to Village Management and the Village Board which assesses year-to-date revenues and expenditures. Village Manger Cara Pavlicek introduced Chief Financial Officer Steven Drazner to present a review of the Village's un-audited financial reports through December 31, 2020. The Board of Trustees discussed the quarterly financial report. Village Manager Pavlicek, Chief Financial Officer Drazner and Public Works Director John Wielebnicki provided responses to the Village Trustee questions. Public Works Director John Wielebnicki provided an update on snow removal throughout the Village. Village Trustee Arti Walker-Peddakotla asked Village Manage Pavlicek for an update on the Farmer's Market vendor communications and the hiring of Village of Oak Park Page 2 Printed on 3/3/2021 President and Board of Trustees Meeting Minutes February 16, 2021 the Farmer's Market Manager. Village Manager Pavlicek provided a progress update in the hiring plan, the logistical coordination with the Public Health Director, as well as the required safety adjustments due to COVID. B. MOT 21-5 A Motion to Approve the Unaudited Year-to-Date Quarterly Financial Report as of December 31, 2020 XI. Village Board Committees XII. ID 21-80 Motion to Consent to the Village President’s Appointment of: Historic Preservation Commission- Noel Weidner, Appoint as Chair Building Codes Advisory Commission - John Michelotti, Appoint as Member Farmers Market Commission- Jessica Green, Appoint as Member It was moved by Village Trustee Andrews, seconded by Village Trustee Walker-Peddakotla, that this Motion be approved. The motion was approved. The roll call on the vote was as follows: AYES: 7- Village President Abu-Taleb, Village Trustee Andrews, Village Trustee Boutet, Village Trustee Buchanan, Village Trustee Moroney, Village Trustee Taglia, and Village Trustee Walker-Peddakotla NAYS: 0 ABSENT: 0 XIII. First Reading D. ORD 21-18 First Reading of An Ordinance Amending Section 15-3-19 (“On Street Overnight Parking Passes”) of the Oak Park Village Code to Expand the Issuance of Overnight Parking Passes as Reviewed at the November 23, 2020 Village Board Meeting Village Manager Cara Pavlicek provided an overview. An Ordinance to increase the number of overnight passes from 10 to 15 passes per month between the months of April 1st to October31st as recommended by the Transportation Commission. The first three (3) passes will remain free and the remaining twelve (12) passes will remain at $7.00 each. Village Trustee Simone Boutet asked how this affects current overnight permit holders. Village of Oak Park Page 3 Printed on 3/3/2021 President and Board of Trustees Meeting Minutes February 16, 2021 Village Manager Pavlicek responded that individuals who are requesting overnight passes can not park in spaces which have been designated for overnight parking permit holders. E. ORD 21-15 First Reading of An Ordinance Amending Chapter 22 (“Streets and Sidewalks”), Article 3 (“Excavations”) of the Oak Park Village Code to Add a New Section 22-3-8 (“Pavement Openings Moratorium and Restrictions”) Village Manager Cara Pavlicek introduced Village Engineer Bill McKenna to provide an overview of this agenda item. Village Engineer McKenna shared that staff is recommending creating an ordinance to establish a moratorium on pavement openings for newly built roads for a period of five years, for resurfaced roads for a period of three years and a restriction for pavement openings in the greater downtown area from Thanksgiving to New Years. Village Trustee Susan Buchanan, Village Trustee Simone Boutet, Village Trustee Jim Taglia, and Village Trustee Dan Moroney asked questions and were each in support of this Ordinance. XIV. Consent Agenda Approval of the Consent Agenda It was moved by Village Trustee Andrewsand seconded by Village Trustee Moroney to approve the items under the Consent Agenda. The motion was approved. Stephanie introduced the Pete's Fresh Market Team: Eugene (Project Manager and General Contractor), Ken (Architect), Alenny P. (API Architects), Jim B. (WT Group Civil Engineering). Village Manager Cara Pavlicek introduced Director of Development Customer Services Tammie Grossman. Village Manager Pavlicek noted that this Agenda Item is the Plan Commission's recommendation for Pete's application for the grocery store at Oak Park Avenue and Madison Street. Director Grossman provided a timeline of the Pete's Fresh Market development project. Pete's Fresh Market presented the Building Renderings. Village Trustee Boutet asked about the plan regarding the Fire Department accessing the Oak Park Arms. Village Manager Pavlicek confirmed there will be changes made to Oak Park Ave. and Washington Blvd. Village Trustee Buchanan asked for an update on the plan for the corner of Oak Park Ave. and Madison St. Development Customer Services Director Grossman responded that Pete's Fresh Market will work within the Plan Development Ordinance which requires Pete's Fresh Market to work with the Oak Park Area Arts Council to develop a design for that area which is on the corner of Oak Park Ave. and Madison St. where the Pete's business sign will be placed. The meeting will be streamed live and archived online for on-demand viewing at www.oak-park.us/boardtv as well as cablecast on VOP-TV, which is available to Comcast subscribers on channel 6 and ATT Uverse subscribers on channel 99. Remote Meetings of the Oak Park Village Board of Trustees is authorized pursuant to Section 7 (e) of the Open Meetings Act. The Village President has determined that an in-person meeting is not practical or prudent due to the COVID-19 outbreak during the Governor’s disaster proclamation. It is also not feasible to have a person present at the Board’s regular meeting location due to public safety concerns related to the COVID-19 outbreak. The President and Board of Trustees welcome your statement into the public record of a meeting. Public statements of up to three minutes will be read into the record during Non-Agenda public comment or Agenda public comment, as an individual designates. ORD 21-15 First Reading of An Ordinance Amending Chapter 22 (“Streets and Sidewalks”), Article 3 (“Excavations”) of the Oak Park Village Code to Add a New Section 22-3-8 (“Pavement Openings Moratorium and Restrictions”) Overview: This Ordinance proposed to establish a moratorium on pavement openings in the public right of-way (ROW) on newly constructed or reconstructed roads for a period of 5-years, for newly resurfaced roads for a period of 3-years, and annually in the Downtown Zoning District between Thanksgiving and New Year’s. The Village receives numerous permit requests for pavement openings and small cell installations. In order to minimize impacts to adjacent residents and business districts and to protect the investments made in constructing and resurfacing the roads, staff is recommending establishing a moratorium on these pavement opening to encourage utility companies to better plan their the improvements to coincide with capital improvements. RES 21-44 A Resolution Approving the Cancellation of Uncollected Fines for Parking Citations Issues from 2004 through 2017 as a Continuation of the June 10, 2019 Village Board Discussion Overview: After discussion with the Village Board on June 10, 2019, the Village conducted a parking citation amnesty program to waive late fines associated with parking citations issued during 2017 and prior, which allowed citation holders to pay the initial fine amount only and waived any late fees that had been associated with the unpaid citation. In addition, following the amnesty, citations were submitted for collection through the Illinois Comptrollers’ tax refund intercept program. Since it is unlikely that after these efforts described any significant revenues will be collected, the village is seeking to approve cancellation of the uncollected fines for this period. N. RES 21-45 A Resolution Approving the Purchase of Six 2021 Ford Utility Hybrid Police Interceptor Vehicles with Police Package from Currie Motors of Frankfort, Illinois through the Suburban Purchasing Cooperative Joint Purchasing Program in an Amount Not to Exceed $238,476.00 and Waiving the Village’s Bid Process for the Purchase Overview: The Fiscal Year 2021 Fleet Replacement Fund includes the replacement of six Police vehicles. These vehicles will be replaced with six 2021 Ford Utility Hybrid Police Interceptor vehicles with the Police Package. The Suburban Purchasing Cooperative Joint Purchasing Program awarded the bid to Currie Motors of Frankfort, Illinois. O. RES 21-48 A Resolution Approving the Purchase of Cellular Phone Services from Verizon Wireless through the State of Illinois Master Contract in an Amount Not to Exceed $113,000.00 Annually for Fiscal Years 2021 through 2023 and Waiving the Village’s Bid Process for Said Purchase Overview: Mobile communication is utilized by all operating departments for emergency communication and daily operations. During the Covid Pandemic, additional mobile technology was needed to support COVID emergency operations and village staff working from home to maintain the daily operation of village services and public safety. The Village participates in the State of Illinois Joint Purchasing Program for materials, equipment and services commonly used by municipalities such as cell phone, smartphone and mobile data. Participation in the Joint Purchasing Program results in volume discounts on equipment and services which the Village could not achieve on its own as a single purchaser. RES 21-49 A Resolution Authorizing the Purchase of One 2021 Elgin Pelican Street Sweeper from Standard Equipment Company in an Amount Not to Exceed $244,720.00 through the Sourcewell Joint Purchasing Program and Waiving the Village’s Bid Process for the Purchase Overview: The Fiscal Year 2021 Fleet Replacement Fund budget includes the replacement of a 2004 Elgin Pelican Street Sweeper to be replaced with a 2021 Elgin Pelican Street Sweeper. This purchase will be made through the Sourcewell Joint Purchasing Program, an opportunity for governments to leverage and pool resources for better pricing. Q. RES 21-50 A Resolution Approving the Purchase of a 2021 Ford Hybrid Escape from Currie Motors of Frankfort, Illinois through the Suburban Purchasing Cooperative Joint Purchasing Program in an Amount not to Exceed $27,213.00 and Waiving the Village’s Bid Process for the Purchase Overview: The Fiscal Year 2021 Fleet Replacement Fund includes the replacement of a Parking Enforcement vehicle, a 2012 Ford Escape, with a 2021 Ford Hybrid Escape. The Suburban Purchasing Cooperative awarded the bid to Currie Motors of Frankfort, Illinois. R. RES 21-54 A Resolution Approving the Renewal of the Independent Contractor Agreement with McAdam Landscaping, Incorporated for Village Wide Business District Landscape Maintenance Services in 2021 in an Amount Not to exceed $50,000.00 and Authorizing its Execution Overview: This agenda item is for the Business District Landscape Maintenance program for 2021. It is proposed to renew the existing agreement with McAdam Landscaping, Incorporated, of Forest Park, IL. This is the first of two annual renewals included in the original agreement. The Village maintains the landscaping in multiple business districts across the Village. S. RES 21-56 A Resolution Approving an Independent Contractor Agreement with CityEscape Garden & Design LLC for Village Wide Container Seasonal Display and Maintenance Services in 2021 in an Amount Not to Exceed $65,000.00 and Two Additional One Year Option Periods and Authorizing its Execution Overview: In November of 2020 the Village requested bids for scaled down Village Wide Container Season Display and Maintenance Services for 2021. CityEscape Garden & Design LLC of Chicago IL was the low responsive bidder. It is proposed to award a contract with CityEscape Garden & Design for 2021. The Village maintains the landscaping on approximately 180 sites across the Village. It is proposed to renew the existing agreement with CityEscape Garden & Design LLC, of Chicago, IL. RES 21-58 A Resolution Approving a Water Meter and Water Meter Parts Purchase Agreement with Ferguson Enterprises, LLC, d/b/a Ferguson Waterworks in an Amount not to Exceed $150,000.00, Authorizing its Execution and Waiving the Village’s Bid Process for the Agreement Overview: This item is for the purchase of water meters and water meter parts as part of the Public Works Departments continuation of maintaining the the water meter system. This is primarily a purchase for maintenance work and not part of the overall meter replacement program which is expected to be brought forward to the Village Board mid-2021. V. RES 21-60 A Resolution Accepting the Donation of Two (2) Electric Vehicle Charging Stations from the Center for Neighborhood Technology Overview: The Center for Neighborhood Technology seeks to donate and transfer ownership of two (2) electric vehicle charging stations to the Village of Oak Park. RES 21-64 A Resolution Approving a Contract with Swallow Construction Corporation for Project 21-19, Oak Park Avenue Water and Sewer Main Improvements-South Contract, in an Amount not to Exceed $2,415,524 and Authorizing its Execution Overview: Competitive bids were opened on February 1, 2021, for the 21-19 Oak Park Avenue Water and Sewer Main Improvements-South Contract. Twelve contractors picked up bid documents and three bids were received. The low responsible bid was submitted by Swallow Construction Corporation in an amount of $2,415,523.75. The project includes sewer lining from Roosevelt to Garfield, Water main replacement from Harrison to Jackson, and sewer main replacement from Harrison to Van Buren and is scheduled to start in March. AA. RES 21-65 A Resolution Approving a Contract with Cerniglia Co. for Project 21-20, Oak Park Avenue Water and Sewer Main Improvements-North Contract, in an Amount Not to Exceed $1,907,617 and Authorizing its Execution Overview: Competitive bids were opened on February 4, 2021, for the 21-20 Oak Park Avenue Water and Sewer Main Improvements-North Contract. Seven contractors picked up bid documents and three bids were received. The low responsible bid was submitted by Cerniglia Co. in an amount of $1,907,616.50. The project includes sewer installation on Oak Park Avenue at Madison and water main replacement from Madison to Randolph and Chicago Avenue to Augusta Boulevard and is scheduled to start in March. RES 21-66 A Resolution Approving a Point of Use Water Filter Pitcher Program for Partial Lead Water Service Line Replacements and Authorizing the Purchase of Water Filter Pitchers and Replacement Filters Overview: In 2019 the Village Board approved a pilot program for providing water filter pitchers as part of the 19-17 Water & Sewer Main Improvement project to properties that had partial lead water service lines to mitigate the potential for increased lead levels in the drinking water when lead service lines are disturbed or partially replaced. Staff distributed pitchers as part of this project and recommends adopting a program to provide these water filter pitchers for properties with partial lead service lines on water main projects going forward and when doing repairs which create partial lead service lines. Staff has developed a Standard Operating Procedure (SOP) for this program. Staff would purchase filter pitchers for future water main projects and budget for filter pitchers as part of annual water main projects. AC. MOT 21-9 A Motion to Concur with the Transportation Commission’s Recommendation to Remove the Daytime Parking Restriction on the 600 Block of Clarence Avenue Overview: On December 14, 2020, the Parking and Mobility Services Division received a signed parking petition requesting to remove the current parking restriction from the 600 block of Clarence, which is “No Parking 8 AM - 10 AM Monday - Friday.” AD. MOT 21-16 A Motion to Approve the January 2021 Monthly Treasurer’s Report for All Funds Overview: The unaudited January 31, 2021 report is hereby presented pursuant to 65 ILCS 5/3.1-35-45 summarizing the Village’s cash and investment balances. This development is subject to a Redevelopment Agreement adopted by the Village Board on December 10,2018 and is a companion to Ordinance 21-17 regarding street vacations. AG. ORD 21-17 Concur with the Plan Commission’s Recommendation and Adopt an Ordinance Authorizing the Vacation of a Certain Portion of Euclid Avenue located between Madison Street and East-West Alley North of Madison Street and a Certain Portion of Madison Street Between Oak Park Avenue and Wesley Avenue in the Village of Oak Park, Cook County, Illinois (*) Overview: Pete’s Market submitted a request to vacate a portion of Euclid Avenue and a portion of Madison Street associated with their retail grocery store development located at 640-728 Madison Street.
