Oklahoma City Water Utilities Trust Page 1 of 5 December 20, 2022 OKLAHOMA CITY WATER UTILITIES TRUST MEETING INFORMATION The Oklahoma City Water Utilities Trust usually meets twice per month on Tuesdays at 2:00 p.m. in Council Chambers at City Hall, unless different or prior notice of a change is posted. Call 297­2422 to confirm meeting dates. It is the policy of the Trust to ensure that communications with participants and members of the public with disabilities are as effective as communications with others. Anyone with a disability who requires an accommodation, a modification of policies or procedures, or an auxiliary aid or service in order to participate in this meeting should call (405) 297­2422 or TDD (405) 297­2020 at least 48 hours in advance (not including weekends or holidays). The staff will give primary consideration to the choice of auxiliary aid or service requested by the individual with disability. Safety Guidelines The following safety guidelines are in place during the COVID­19 pandemic for meetings in the Council Chamber at City Hall: face coverings are strongly recommended throughout the building (disposable face masks will be available); only the south entrance to City Hall will be open; air purifying machines will be in the Chamber; hand sanitizer machines will be available; and the Chamber will be cleaned and sanitized daily. Addressing the Trust Citizens may address the Trust on certain items by signing up to speak and providing the agenda item number, their reason for appearing and their address, but all comments must be relevant to the item. If you wish to address the Trust, you may call 297­2422 or you may sign up to speak at the meeting. The Chairman or presiding officer may in his or her discretion prohibit a person from addressing the Trust, or have any person removed from the Council Chamber, if that person commits any disorderly or disruptive behavior, which includes without limitation any of the following: speaking without being recognized by the Chairman or presiding officer; continuing to speak after notice that the speaker’s allotted time has expired; presenting comments or material not relevant to the item under discussion; failing to comply with the lawful instructions of the Chairman or presiding officer; engaging in other conduct, activity, or speech that delays, disturbs, interferes, or disrupts the effective or timely conduct of the meeting, or is otherwise violent, threatening, abusive, obscene, or jeopardizing the safety of self or others. A person may also be subject to arrest and removal from the Municipal Building for violation of Oklahoma City Municipal Code 2020, § 30­81 – Disorderly conduct and/or violation of Okla. Stat. tit. 21, §280­ Willfully Disturbing, Interfering With or Disrupting State Business, Agency Operations or Employees. Citizens will be limited to three minutes to speak to the Trust. Trust Actions The Trust may take any of several actions including but not limited to adopt, approve, ratify, deny, defer, recommend, amend, strike, or continue any item. The Trust is not limited by staff recommendations as to the actions it may take. If more information is needed, the Trust may refer matters to the General Manager or to Legal Counsel, or submit them to committees, boards, commissions, or independent consultants for additional study. The Trust may authorize the General Manager or Legal Counsel to take certain actions. Items may be stricken from the agenda, or no action may be taken. Consent Docket Consent Docket items are usually approved as a group with the proper motion from a Trustee. Consent Docket items usually involve routine actions or standard contracts. Trustees, staff, or citizens may request discussion or separate consideration of any Consent Docket item. A separate vote may be taken upon the motion of a Trustee. Receive the Preliminary Engineering Report from Halff Associates, Inc., Projects PC­0648, street enhancements/arterial resurfacing and utility rehabilitation, NW 23rd Street from Western Avenue to I­235; WC­0978, waterline replacement, NW 23rd Street from Western Avenue to Lee Avenue; SC­1052, sanitary sewer rehabilitation, NW 23rd Street from Western Avenue to Francis Avenue, and State Project J3­4980(004) AG, State Job No. 34980(04)(05)(06)(07); and authorization to prepare final plans and specifications. B. Receive the Engineering Report from Burns & McDonnell Engineering Company, Inc., Project WC­0863, Atoka Pipeline pump stations five­million­gallon balancing tank replacements, Coalgate, Stonewall, Ada, Konawa, and Macomb, Oklahoma. C. 1. Receive the Engineering Report from Ardurra Group, Inc., Project ST­0163, blower and aeration study, North Canadian, Deer Creek, and Chisholm Creek Wastewater Treatment Plants; and 2. Amendment No. 1 to the contract for engineering services with Ardurra Group, Inc., Project ST­0163, blower and aeration study, North Canadian, Deer Creek, and Chisholm Creek Wastewater Treatment Plants, fee increase of $1,812,870. D. Plans and Specifications to be advertised for bids, Project SC­1098, Twin Creek siphon replacement, Twin Creek at Wiley Post Park, south of the North Canadian River and west of South Walker Avenue. E. Amendment No. 1 revising the construction contract with United Trenching, Inc., Project WE­0099, emergency 72­inch waterline repair, north of SE 164th Street and Douglas Boulevard, increase of $3,643.16. F. Amendment No. 1 and Change Order No. 1 revising the construction contract with Matthews Trenching Company, Inc., Project SE­0048, emergency sanitary sewer repairs, SW 12th Street and Lee Avenue, increase of $51,116. G. Change Order No. 1 revising the construction contract with Wynn Construction Company, Inc., Project ST­0149, North Canadian Wastewater Treatment Plant improvements and upgrades, decrease of $2,957,025. H. J. Resolution ratifying the actions of the General Manager in approving Consent Order No. 22­220 with the Oklahoma Department of Environmental Quality for assessment of a penalty for a fish kill, and authorizing payment in the amount of $2,500. K. Resolution authorizing the sole source purchase of grease removal products for wastewater pipelines and additional repair/replacement parts from Duke’s Root Control, Inc. (SS23­C239018), January 19, 2023, through January 18, 2025, estimated annual cost $60,000. L. Joint Agreement with The City of Oklahoma City and Okana MDE, LLC, Project WC­1046, 16­inch water main extension, Eastern Avenue and SE 15th Street near the Oklahoma River. M. 1. Recommend The City of Oklahoma City approve termination letters and perpetual Pipeline Licenses with BNSF Railway Company, Projects SC­1028, sanitary sewer relocation and WC­0953 water main relocation for the I­35 and I­ 240 interchange improvements, northwest, northeast, and southeast of the I­35 and I­240 intersection; and 2. Authorize payment of claim, $17,650. N. Ratification of payments from November 16, 2022, through December 13, 2022. IV. Concurrence Docket A. Concurrence with The City of Oklahoma City in adopting resolution approving Change Order No. 13 revising the construction contract with Wynn Construction Co., Inc., Projects M3­P016, MAPS 3 Scissortail (Lower) Park, WC­1000, waterline relocation, and SC­1073, sanitary sewer relocation, Robinson Avenue to Harvey Avenue from Interstate 40 to SW 15th Street, increase of $44,843.12; and authorizing the use of excess collections and/or interest in the amount of $28,320.12 to fund Change Order No. 13. (No OCWUT funds.) B. Concurrence with The City of Oklahoma City in accepting Projects PC­0441­II, reconstruction and roadway widening, BC­0200, bridge replacement, and WC­ 0973, waterline relocation, Western Avenue from NW 192nd Street to City Limits; and placing the maintenance bond into effect. (No OCWUT funds.) V. Emergency Construction Contracts by Resolution (Four affirmative votes required for approval.) VI. Items for Individual Consideration A. Amendment No. 9 to the Award/Contract associated with the United States of America for the municipalization of the water and wastewater systems at Tinker Air Force Base, retroactive to November 1, 2021, through October 31, 2071. B. Receive the Annual Financial Report and Letter to Management on Internal Controls, and Auditors Required Communications to the Trust documents for the Oklahoma City Water Utilities Trust for the fiscal year ended June 30, 2022. Joint Resolution with The City of Oklahoma City declaring a tract of real property of the proposed West Elm Creek Reservoir, outside of the 660­foot reserved pursuant to Oklahoma Statutes Title 11, Section 37­104 for water quality protection, as surplus to and abandoned for the water utility purpose; approving the sale of such tract to the Oklahoma Industries Authority as described in the Purchase Agreement for fair market value; conveying the tract by Warranty Deed; authorizing the City Manager and the General Manager, or their designees, to represent The City of Oklahoma City and the Oklahoma City Water Utilities Trust, respectively, at closing and to execute any and all documents necessary for the sale of the tract; approving the Real Estate Purchase Agreement; approving the Memorandum of Understanding between the Oklahoma Industries Authority, The City of Oklahoma City, and the Oklahoma City Water Utilities Trust; authorizing the City Engineer and the General Manager, or their respective designees, authorizing the filing of an application for the platting of the subject property, and amendments and revisions thereto; and City Council waiving the public hearing in the three­meeting process for the sale of City owned property.
