Oklahoma City Water Utilities Trust Page 1 of 5 July 18, 2023 OKLAHOMA CITY WATER UTILITIES TRUST MEETING INFORMATION The Oklahoma City Water Utilities Trust usually meets twice per month on Tuesdays at 2:00 p.m. in Council Chambers at City Hall, unless different or prior notice of a change is posted. Call 297-2422 to confirm meeting dates. It is the policy of the Trust to ensure that communications with participants and members of the public with disabilities are as effective as communications with others. Anyone with a disability who requires an accommodation, a modification of policies or procedures, or an auxiliary aid or service in order to participate in this meeting should call (405) 297-2422 or TDD (405) 297-2020 at least 48 hours in advance (not including weekends or holidays). The staff will give primary consideration to the choice of auxiliary aid or service requested by the individual with disability. Addressing the Trust Citizens may address the Trust on certain items by signing up to speak and providing the agenda item number, their reason for appearing and their address, but all comments must be relevant to the item. If you wish to address the Trust, you may call 297-2422 or you may sign up to speak at the meeting. The Chairman or presiding officer may in his or her discretion prohibit a person from addressing the Trust, or have any person removed from the Council Chamber, if that person commits any disorderly or disruptive behavior, which includes without limitation any of the following: speaking without being recognized by the Chairman or presiding officer; continuing to speak after notice that the speaker’s allotted time has expired; presenting comments or material not relevant to the item under discussion; failing to comply with the lawful instructions of the Chairman or presiding officer; engaging in other conduct, activity, or speech that delays, disturbs, interferes, or disrupts the effective or timely conduct of the meeting, or is otherwise violent, threatening, abusive, obscene, or jeopardizing the safety of self or others. A person may also be subject to arrest and removal from the Municipal Building for violation of Oklahoma City Municipal Code 2020, § 30-81 – Disorderly conduct and/or violation of Okla. Stat. tit. 21, §280- Willfully Disturbing, Interfering With or Disrupting State Business, Agency Operations or Employees. Citizens will be limited to three minutes to speak to the Trust. Trust Actions The Trust may take any of several actions including but not limited to adopt, approve, ratify, deny, defer, recommend, amend, strike, or continue any item. The Trust is not limited by staff recommendations as to the actions it may take. If more information is needed, the Trust may refer matters to the General Manager or to Legal Counsel, or submit them to committees, boards, commissions, or independent consultants for additional study. The Trust may authorize the General Manager or Legal Counsel to take certain actions. Items may be stricken from the agenda, or no action may be taken. Consent Docket Consent Docket items are usually approved as a group with the proper motion from a Trustee. Consent Docket items usually involve routine actions or standard contracts. Trustees, staff, or citizens may request discussion or separate consideration of any Consent Docket item. A separate vote may be taken upon the motion of a Trustee. Approve the minutes of the July 5, 2023, meeting. III. Consent Docket A. Ratifying and approving Addendum No. 1; awarding a contract to Southwest Water Works, LLC, Project WC-0950-2, waterline replacement, West Hefner Road to Morton Avenue from North Florida Avenue to North Brauer Avenue, NW 115th Street to NW 109th Street from Pennsylvania Avenue to Villa Avenue, $2,969,691; and approving the contract and bonds. B. Renewal of a Professional Services Agreement with the Oklahoma State University, through its Cooperative Extension, (R24-C199032), water conservation education outreach programs, estimated annual cost of $125,400, August 27, 2023, through August 26, 2024. C. Amendment No. 2 to the joint contract for engineering services with The City of Oklahoma City and Carollo Engineers, Inc., MC-0699-C, water and wastewater civil engineering services, citywide. D. Amendment No. 2 to the contract for engineering services with Arcadis, U.S. Inc., Project WY-0037, Utilities Facilities Risk Management Plan Review and Update for Hefner and Draper Water Treatment Plants, fee increase of $83,840. E. Ratifying and approving Addendum No. 1, adopting a Resolution extending time to award contract as mutually agreed; awarding a contract to Downey Contracting, LLC, Project WC-1050, Booster Pump Station Nos. 7 and 22 system improvements, Booster Pump Station No. 7, 5925 South Portland Avenue, and Pump Station No. 22, 7440 SW 29th Street, $1,133,738.60; and approving the contract and bonds. F. Agreement with The City of Oklahoma City for the relocation and replacement of waterlines, Projects TC-0506 and WC-1020, replacement water transmission mains, North Pennsylvania Avenue at the intersection of NW 10th Street. IV. Concurrence Docket A. Concurrence with The City of Oklahoma City in approving Amendment No. 3 revising the construction contract with Allen Contracting, Inc., Projects PC-0559 and WC-0998, roadway widening improvements, Sara Road between SW 15th Street and SW 29th Street, increase of $36,622.21. Concurrence with The City of Oklahoma City in approving Amendment No. 2 to the contract for engineering services with CEC Corporation, Projects PC-0926, Widening of Post Road from SE 44th Street to SE 74th Street and WC-1023, 60-inch water transmission main replacement along SE 74th Street from Douglas Boulevard to Post Road; along Post Road from SE 74th Street to SE 44th Street; and along SE 44th Street from Post Road to Douglas Boulevard, fee increase of $1,632,800. (No OCWUT funds.) V. Emergency Construction Contracts by Resolution (Four affirmative votes required for approval.) VI. Items for Individual Consideration A. Receive the Engineering Report from CP&Y, Inc., and authorize negotiation of an amendment to the engineering contract to provide a phasing plan, final design, bidding, and construction administration, Project ST-0161, Deer Creek Wastewater Treatment Plant electrical improvements. B. Receive the Preliminary Engineering Report from Carollo Engineers, Inc. and authorize the negotiation of an engineering amendment for final plans, specifications, and bidding phase services, Project WT-0224, Draper Water Treatment Plant clearwell improvements. C. Amendment No. 2 to the contract for engineering services with Carollo Engineers, Inc., Project WT-0253, Draper Water Treatment Plant, existing high service pump station electrical improvements, fee increase of $671,284. D. Change Order No. 1 revising the construction contract with McKee Utility Contractors, Inc., Project WC-0873, Atoka Pipeline raw water transmission line, Stonewall Pump Station to Ada Pump Station, decrease of $300,000. E. Resolution of the Oklahoma City Water Utilities Trust authorizing the filing of application(s) with the Oklahoma Water Resources Board for financial assistance through the Clean Water State Revolving Fund Loan Program for the purpose of financing the projects; authorizing the Chairman or Vice Chairman and Secretary or Assistant Secretary to execute the application(s); authorizing the General Manager to advance the necessary application fees; authorizing Trust staff, financial advisor, and bond counsels to assist in preparing the application(s) and to take such other actions necessary to accomplish the financing of the projects; and authorizing and directing all other lawful things necessary to carry out the terms and conditions of this Resolution. F. 1. Resolution recommending The City of Oklahoma City adopt an ordinance relating to Utilities, amending Chapter 55 of the Oklahoma City municipal Code, 2020, by amending Section 55-46, water meter and water service installation; and providing for an effective date; and 2.
