PENDLETON TOWN COUNCIL OCTOBER 14, 2024, 5:30 PM CALLED MEETING MINUTES: After due notice to the press, Town Council met at Town Hall. Frank Crenshaw, Lyn Merchant, Barbara Hamberg, Vince Gaulin, Jeff Van Drie were present. 1) EXECUTIVE SESSION PURSUANT TO SC CODE OF LAW SECTION 30-4-70(2) TO RECEIVE LEGAL ADVICE AND DISCUSS CONTRACTUAL, LAND USE AND PROPERTY DEVELOPMENT MATTERS, INCLUDING RELATED POTENTIAL OR THREATENED CLAIMS, REGARDING ISSUES RELATED TO THE REALIGNMENT OF WESTINGHOUSE ROAD AND SWANEY LANE AND TO DISCUSS THE PURCHASE OF PROPERTY FOR SAID REALIGNMENT Barbara Hamberg made a motion to enter into Executive Session. Jeff Van Drie seconded. Unanimous. Barbara Hamberg made a motion to go out of Executive Session and back into the Called Meeting. Vince Gaulin seconded. Unanimous. No decisions were made during the Executive Session. 2) MOTION(S)/VOTE(S) FROM EXECUTIVE SESSION IF NEEDED N/A 3) ACTION ITEMS 3.a CONSIDERATION OF SECOND AND FINAL READING OF AN ORDINANCE AUTHORIZING THE CONVEYANCE AND RECEIPT OF CERTAIN REAL PROPERTY BY THE TOWN OF PENDLETON (“TOWN”), AS MADE NECESSARY BY THE PLANNED REALIGNMENT OF SWANEY CIRCLE AND EXTENSION OF WESTINGHOUSE ROAD, AS FOLLOWS: (1) TO CONVEY CERTAIN REAL PROPERTY CONSISTING OF APPROXIMATELY .059 ACRES TO PENDLETON SOUTH, LLC; (2) TO QUITCLAIM TOWN’S INTEREST, IF ANY, IN CERTAIN REAL PROPERTY CONSISTING OF APPROXIMATELY .660 ACRES TO 7601 HWY 76, LLC; (3) TO RECEIVE CERTAIN REAL PROPERTY CONSISTING OF APPROXIMATELY .081 ACRES FROM 7601 HWY 76, LLC; (4) TO RECEIVE CERTAIN REAL PROPERTY CONSISTING OF APPROXIMATELY .003 ACRES FROM PENDLETON SOUTH, LLC; (5) TO RECEIVE CERTAIN REAL PROPERTY CONSISTING OF APPROXIMATELY .047 ACRES FROM PENDLETON SOUTH, LLC; AND OTHER MATTERS RELATED THERETO Lyn Merchant made a motion to approve the above Ordinance for second and final reading. Barbara Hamberg seconded. Unanimous. 3.b CONSIDERATION OF AUTHORIZING THE MAYOR & TOWN ADMINISTRATOR TO PURCHASE PROPERTY LOCATED ON SWANEY CIRCLE AND WESTINGHOUSE HOUSE ROAD EXTENSION Lyn Merchant made a motion to authorize the Mayor and Town Administrator to negotiate the purchase of property per discussion, subject to due diligence and final examination. Vince Gaulin seconded. Unanimous. PENDLETON TOWN COUNCIL CALLED MEETING 10/14/24 1 4) ADJOURNMENT With no further business to discuss, Barbara Hamberg made a motion to adjourn at 5:40 pm.
