MINUTES of a regular meeting of the Mayor and the Board of Trustees of the Village of
Skokie, Cook County, Illinois held in the Council Chambers at 5127 Oakton Street at 8
p.m. on Monday, March 18, 2013
Pledge of Allegiance led Village Clerk Marlene Williams.
The Mayor called the meeting to order.
The Clerk called the Roll. Those present were Trustee Perille, Roberts, Sutker, Shah, Gray-
Keeler and Mayor Van Dusen. Trustee Bromberg was not present
Katherine Gudgel of 5155 Brown Street requested Item C of on the Manager’s Report be
removed from the Consent Agenda.

space. Ecomonic Development Director Tom Thompson answered questions from the Board.
The Board welcomed the owner of Alexander’s Mr. Angelopoulos to Skokie.

Motion to adopt a Resolution authorizing the Village Manager to execute an agreement with
Gewalt Hamilton Associates in the maximum amount of $185,200 for supervision and
administration of the Downtown construction and streetscape improvement plan.
Katherine Gudgel of 5155 Brown Street commented on contracts with Gewalt Hamilton
Associates.
Traffic Engineer Fred Schattner and Purchasing Agent Michael Aleksic answered questions
from the Board. Mr. Rigoni named several other companies that Skokie has hired for
construction supervision.

AN ORDINANCE GRANTING A SPECIAL USE PERMIT FOR THE
OUTDOOR SALE OF PROPANE AT 3626 TOUHY AVENUE,
SKOKIE, ILLINOIS IN A B2 COMMERCIAL DISTRICT
1 WHEREAS, CSD Touhy, LLC, the owner of the following described real property:
2 LOT 1 IN TOUHY MARKETPLACE SUBDIVISION, BEING A SUBDIVISION OF THAT
3 PART OF THE WEST HALF OF THE SOUTHEAST QUARTER AND EAST HALF OF
4 THE SOUTHWEST QUARTER OF SECTION 26, TOWNSHIP 41 NORTH, RANGE 13,
5 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS.

10 petitioned the Village of Skokie for a special use permit for the outdoor sale of propane in a B2
11 Commercial district; and
12 WHEREAS, the Subject Property is the future site of the proposed Walmart store. The
13 outdoor propane sale area will be located by the southern entrance to the store and south of the six
14 proposed soft drink vending machines previously approved in Village Ordinance Number 12-5-Z-
15 3904; and
16 WHEREAS, the display would consist of two cages containing three propane tanks each.
17 Both cages would be locked at all times and will be accessed only by Walmart employees at the
18 time of sale; and
19 WHEREAS, the Skokie Plan Commission, at a public hearing duly held on December 6,
20 2012, for which proper legal notice had been achieved and no interested parties appeared, heard
21 testimony from Village staff and the petitioner; and
22 WHEREAS, the propane would be available for sale during all hours of operation of the
23 Walmart store and, based upon questions from Commissioners, the petitioner and Village staff
24 stated the following:
25 (i) the sale of propane was common at other Walmart stores,
26 (ii) the tanks would not be refilled at the store as the customer would return the empty tank
27 to Walmart and it would be picked up and refilled off-site,
28 (iii) no permit from the Fire Department was required; and
29 WHEREAS, following all testimony and discussion, the Plan Commission (a) made the
30 appropriate findings of fact as required under Section 118-32 of the Skokie Village Code and (b)

1 voted to recommend to the Mayor and Board of Trustees that the requested special use permit be
2 granted subject to the conditions contained in the Plan Commission Report dated February 19,
3 2013; and
4 WHEREAS, the Mayor and Board of Trustees, at a public meeting duly held on February
5 19, 2013, concurred in the aforesaid recommendations and findings of fact of the Skokie Plan
6 Commission;
7 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the Village
8 of Skokie, Cook County, Illinois:
9 Section 1: That the special use permit requested by the petitioner for the outdoor sale
10 of propane at the Subject Property, described above and commonly known as 3626 Touhy
11 Avenue, Skokie, Illinois, in a B2 Commercial district be and the same is hereby granted and
12 approved subject to each of the conditions set forth below:
13 1. The petitioner shall operate and maintain the outdoor propane sales area in
14 substantial conformance with the Front Sidewalk Plan, dated October 31, 2012;
15 2. All propane sales shall be limited to the 2 storage cages, each of which shall
16 contain a total of 3 tanks, and both cages shall be locked at all times and only be
17 accessed by the employees of Walmart;
18 3. The petitioners shall comply with all Federal and State statutes, laws, rules and
19 regulations and all Village codes, ordinances, rules, and regulations;
20 4. Failure to abide by any and all terms of this Ordinance shall be cause for the
21 Village to initiate hearings to determine whether the subject Ordinance, as well as
22 any applicable business licenses, should be revised or revoked; and
23 5. The petitioners shall pay all costs related to any hearings conducted as a result of
24 non-compliance with any of the provisions of the enabling ordinance. The costs
25 shall include but not be limited to court reporter fees, attorney fees, and staff time
26 required researching and conducting said hearing.
27 Section 2: That a notice of the approval of this Ordinance incorporating the
28 conditions contained herein shall be executed by the owner of the property in writing and duly
29 recorded with the Cook County Recorder of Deeds Office at the owner’s expense.
30 Section 3: That this Ordinance shall be in full force and effect from and after its
31 passage, approval and recordation as provided by law.

AN ORDINANCE VACATING CERTAIN UNOPENED AND
UNIMPROVED RESIDENTIAL NORTH-SOUTH AND EAST-WEST
ALLEYS WITHIN AN AREA BOUNDED BY CHURCH STREET,
TERMINAL AVENUE, DAVIS STREET, AND LARAMIE AVENUE
AND IN AN R2 SINGLE-FAMILY DISTRICT
1 WHEREAS, the Community Development Department is continuing the alley
2 vacation program that was initiated in 2002, in which the Village vacates unopened and
3 unimproved residential alleys that are unnecessary for Village transportation and access
4 needs; and
5 WHEREAS, the alleys to be vacated were dedicated along with the original
6 subdivisions, however, they were never improved when the homes were constructed, and
7 the Village does not have any intent to open or improve them; and
8 WHEREAS, the alley vacation program benefits both property owners, by receiving
9 increased land area that will potentially increase the value and development potential of
10 their property, and the Village by reducing maintenance costs; and
11 WHEREAS, the Subject Property is depicted on the Plat of Vacation, dated
12 December 13, 2012, a copy of which is attached hereto as Exhibit “A”; and
13 WHEREAS, the Subject Property is located in an R2 Single-Family district within an
14 area bounded by Church Street, Terminal Avenue, Davis Street, and Laramie Avenue and
15 is legally described in Exhibit “B” attached hereto; and
16 WHEREAS, the nature and extent of the public use or public interest to be
17 subserved in the Subject Property shall warrant the vacation of the same; and
18 WHEREAS, the title and ownership of the portion of the Subject Property to be
19 vacated shall, pursuant to 65 ILCS 5/11-91-2, vest in equal proportions to the abutting
20 property owners as identified by the Permanent Index Numbers (hereinafter “PIN”) and are
21 listed by PIN block numbers in Exhibit “B” attached hereto; and
22 WHEREAS, the only structure that may be built on the vacated alleys is a fence, and
23 that any and all structures built or maintained by the property owners are done so at the
24 property owner’s risk. The Village reserves the right to enter upon vacated alleys and may
25 damage or remove the structure, should the Village need to access the area covered by the
26 easement; and
27 WHEREAS, the Village will remove any existing alley aprons and restore parkways,
28 sidewalks and any curbs, if necessary; and

1 WHEREAS, a permanent public easement for drainage purposes shall be
2 maintained by the Village, as well as easements for Village and Village-franchised public
3 utilities will remain over the entire area to be vacated; and
4 WHEREAS, no compensation shall be paid by the owners of the abutting properties
5 for the value of the real estate which may accrue to them by reason of the enactment of this
6 Ordinance, since it has been determined that the vacation of alleys and the vacated portion
7 will benefit both residents and the Village; and
8 WHEREAS, the abutting property owners of the Subject Property were duly notified
9 of the Skokie Plan Commission proceedings and presented no objection to the proposed
10 vacation; and
11 WHEREAS, the Skokie Plan Commission, at a public hearing duly held on
12 December 20, 2012, after determining proper legal notice was achieved, heard testimony
13 from one interested party who wished to inform abutting property owners regarding
14 confirmation that once the alleys were vacated, the vacated property is listed on their plats
15 and titles; and
16 WHEREAS, the Plan Commission went on and voted to recommend to the Mayor
17 and Board of Trustees that the Subject Property be vacated, subject to the conditions set
18 forth in the Plan Commission Report dated February 19, 2013; and
19 WHEREAS, the Mayor and Board of Trustees of the Village of Skokie, at a public
20 meeting duly held February 19, 2013, concurred in the recommendation of the Skokie Plan
21 Commission;
22 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
23 Village of Skokie, Cook County, Illinois:
24 Section 1: That the following portions of the alleys commonly described below,
25 and legally described in Exhibit “B” attached hereto, and depicted on the Plat of Vacation,
26 dated December 13, 2012, a copy of which is attached hereto as Exhibit “A”, located in the
27 Village of Skokie, be and the same is hereby vacated:
28 - the west 125 feet of the east-west alley in the block bounded by Church
29 Street, Terminal Avenue, Arcadia Street, and Laramie Avenue, and
30 - the western north-south alley in the block bounded by Church Street,
31 Terminal Avenue, Arcadia Street, and Laramie Avenue, and
32 - the east-west alley in the block bounded by Church Street, Terminal
33 Avenue, Davis Street, and Laramie Avenue,
34 and the title to the vacated alleys shall vest to the abutting property owners pursuant to 65
35 ILCS 5/11-91-2, as identified by their Permanent Index Numbers set out in Exhibit “B”
36 attached hereto.
37 Section 2: The aforesaid vacations are subject to the conditions set forth below:
38 1. Easements shall be and are hereby reserved on, in and over the Subject
39 Property for all Village and Village-franchised public utilities over the Subject Property. A

1 permanent public drainage easement for the benefit of the Village shall be, and is hereby,
2 reserved on, in and over the Subject Property.
3 2. Property owners shall not alter the grade or change the drainage pattern in
4 the Subject Property without a permit from the Engineering Division.
5 3. Other than a fence, no structures shall be constructed or trees planted in the
6 Subject Property.
7 Section 3: The Village, on its own behalf and on behalf of Village-franchised
8 public utilities, shall retain the right of entry upon the Subject Property in order to install,
9 repair, replace or remove, or engage in the maintenance of, any equipment or facility of any
10 such utility or the drainage conditions in the Subject Property. In the course of repair,
11 replacement or removal, or maintenance of equipment or facilities of a Village-franchised
12 public utility, or drainage conditions in, on or over the Subject Property, the Village or the
13 Village-franchised public utility shall not be held liable by any owner of the Subject Property
14 for any damage to structures, landscaping, or fences in, on or over the Subject Property.
15 Any and all structures, including a fence, built or maintained on the Subject Property are
16 done so at the owner of the Subject Property’s own risk.
17 Section 4: That the aforesaid vacation, incorporating the conditions contained
18 herein, shall be effective upon the recording of a Plat of Vacation by the Village of Skokie in
19 the Office of the Recorder of Deeds of Cook County.
20 Section 5: That no compensation shall be paid by the owners of the abutting
21 properties for the value of the real estate which may accrue to them by reason of the
22 enactment of this ordinance and that the public interest and benefit will be subserved by the
23 vacation of the properties referenced herein.
24 Section 6: It is the intention of the Village that ownership and title to the vacated
25 alleys shall pass to and vest in the adjacent property owners, as listed by the Permanent
26 Index Numbers in Exhibit “B”, in equal proportions of the vacated alleys.
27 Section 7: That this Ordinance shall be in full force and effect from and after its
28 passage, approval, and recordation as provided by law.

A RESOLUTION AUTHORIZING THE
PUBLICATION OF THE OFFICIAL ZONING MAP
FOR THE VILLAGE OF SKOKIE, ILLINOIS
1 WHEREAS, Section 11-13-19 of the Illinois Municipal Code, 65 ILCS 5/11-13-19,
2 provides that the corporate authorities shall cause to be published each year a map clearly
3 showing the existing zoning uses, divisions, restrictions, regulations and classifications of such
4 municipality for the proceeding calendar year (hereinafter the “Official Zoning Map”); and
5
6 WHEREAS, the Community Development Department staff for the Village of Skokie (the
7 “Village”) have reviewed the prior Official Zoning Map for the Village and made all necessary
8 changes, corrections and alterations that have occurred since its publication in order to prepare
9 the proposed Official Zoning Map; and
10
11 WHEREAS, the Director of Community Development has reviewed the proposed Official
12 Zoning Map for the Village, a copy of which is attached hereto and marked Exhibit “1”, and
13 recommends it be published and printed as the Official Zoning Map of the Village;
14
15 NOW, THEREFORE, BE IT RESOLVED by the Mayor and Board of Trustees of the
16 Village of Skokie, Cook County, Illinois, that the recommendation of the Director of Community
17 Development is accepted and the proposed Official Zoning Map, as prepared by the Community
18 Development Department, a copy of which is attached hereto and marked as Exhibit “1”, is
19 declared to be the Official Zoning Map for the Village.

21 BE IT FURTHER RESOLVED by the Mayor and Board of Trustees that the Director of
22 Community Development is hereby authorized and directed to proceed with the printing and
23 publication of the Official Zoning Map for the Village in accordance with law.

25 BE IT FURTHER RESOLVED by the Mayor and Board of Trustees that the Director of
26 Community Development is hereby authorized to print and publish amended Zoning Maps
27 throughout 2013 that reflect changes that may occur as a result of ordinances that become
28 effective during 2013.

AN ORDINANCE VACATING EASEMENTS AT THE
PROPERTY LOCATED AT 3536-3654 TOUHY AVENUE,
SKOKIE, ILLINOIS IN A B2 COMMERCIAL DISTRICT
1 WHEREAS, CSD Touhy, LLC, the owner of the property commonly known as 3536-
2 3654 Touhy Avenue, Skokie, Illinois (the “Subject Property”), in a B2 Commercial district, is
3 requesting the vacation of easements for all public utilities, railroads, and roadways within
4 the Subject Property that are no longer needed due to the conversion of the Subject
5 Property from industrial to commercial use; and
6 WHEREAS, included in these requested vacations are three (3) easements (the
7 “Subject Easements”) that contain Village utilities or a grant of public right of way access
8 and are depicted on the Plat of Vacation, dated November 9, 2012, and commonly
9 described as follows:
10 (i) A public utility easement for use by Lots 1 and 2 in National Wax Subdivision that
11 served the 3650 Touhy Avenue and the 3649 Chase Avenue properties,
12 (ii) A ten (10) foot wide easement for the water main running along the east side of
13 the property and adjacent to St. Louis Avenue that ran across the 3600 Touhy Avenue
14 property,
15 (iii) A ten (10) foot wide easement for a public roadway (right of way) and shares that
16 same foot print as the water main easement; and
17 WHEREAS, CSD Touhy, LLC has previously gone through the public hearing
18 process for a planned development, culminating in the adoption of Village Ordinance
19 Number 12-5-Z-3900 with regard to a new shopping center to be located on the Subject
20 Property. At the time, it was thought there was no need to vacate the above easements but
21 it has since been determined that the Subject Easements are an unnecessary
22 encumbrance; and
23 WHEREAS, the Village utilities have been abandoned and the easements are not
24 needed as they serve no public function. This vacation will subserve the public interest by
25 eliminating unnecessary claims; and
26 WHEREAS, the Subject Easements are depicted and legally described on the Plat
27 of Vacation, dated November 9, 2012, a copy of which is attached hereto as Exhibit “A”; and
28 WHEREAS, the nature and extent of the public use or public interest to be
29 subserved in the Subject Easements shall warrant the vacation of the same; and

1 WHEREAS, no compensation shall be paid by the owners of the Subject Property,
2 since it has been determined that the vacation of the Subject Easements will benefit both
3 the Subject Property owner and the Village; and
4 WHEREAS, the Mayor and Board of Trustees of the Village of Skokie, at a public
5 meeting duly held April 3, 2013, concurred in the recommendation of the Skokie Plan
6 Commission;
7 NOW, THEREFORE, BE IT ORDAINED by the Mayor and Board of Trustees of the
8 Village of Skokie, Cook County, Illinois:
9 Section 1: That the above stated Recitals are restated and incorporated as if
10 stated in full.
11 Section 2: That the following three (3) requested easement vacations, located in
12 the Village of Skokie, described below, and depicted on the Plat of Vacation, dated
13 November 9, 2012, a copy of which is attached hereto as Exhibit “A”, be and the same are
14 hereby vacated:
15 (i) A public utility easement for use by Lots 1 and 2 in National Wax Subdivision that
16 served the 3650 Touhy Avenue and the 3649 Chase Avenue properties,
17 (ii) A ten (10) foot wide easement for the water main running along the east side of

27 Section 5: That this Ordinance shall be in full force and effect from and after its
28 passage, approval, and recordation as provided by law.
